Thank you for meetmg with me and representatives from Olen Development last Fnday
to mspect the eXistmg/relocated trees, as well as the Banyan preserve area. As we
discussed, there were some adjustments from the ongmal plan to reflect additional trees
found dunng the cleanng process and trees damaged by severe weather The Banyan
preserve area sustamed considerable damage from last year's hUITlcane. We have
replanted the damaged areas with Strangler Fig trees, Royal PomCiana trees, Chmese Fan
palms, and numerous shrubs and ferns. You mdicated that the eXistmg/relocated trees
and the Banyan preserve area pass mspectiOn and you would sign-off on the permits.
Please confirm the above mformation is correct at your earliest convemence I look
forward to workmg With you on our next Boynton Beach project.

posItIon that the RecreatIOnal Impact Fee for the Manatee Bay project should be $229,865
Staffs posItIOn IS based on the follOWIng
1 The number of umts has mcreased the Impact to the CIty because the 180 umts are bemg
bUIlt on the uplands creatmg a density of 16.36 umts per acre rather than the allowable
10 8 umts per acre for your zonmg.
2 The submerged lands are of relatIve lIttle value except for the dock out mto the
Intracoastal Waterway and cannot be valued at the same acre pnce as the bUIldable
uplands.
3 Upon revIewmg the first phase of the abuttmg Via Lago development, there was no credIt
gIven for addItIonal umts for the 3 6 acres of submerged lands.
4 TheoretIcally, the Impact fee IS to be used to mcrease recreatIOn resources WIthm the
vicImty from WhICh the fees are collected, WhICh could mclude land acquisItIOn. A fee
collected based, m part, on submerged lands, may be msufficIent to acqUIre eqUIvalent
land on whIch a park could be developed.

mcluding mangrove preserve area) were subtracted as mdicated m your correspondence, then the denSIty
allowed would be 119 umts (17 13 AC - 6 lAC = 11 03 AC x 1O.8DU/ Acre = 119 umts). The value of
the property was based on the number of umts achIeved on the property We chose to restnct the
development to 180 umts and two and three story product rather than the four story allowed by the

Dear Mike,
Please find enclosed reduced copy of our proposed plat for "Manatee Bay" We will be processIng the
boundary plat for approval by the CIty CommISSIon upon completion of our reView and appropnate
SIgnatures on the plat. It IS our understanding that the park fee IS normally reqUIred as a condition of the
plat approval process. 'Ne have had several dIScussIons wIth Ken Hall and John Wildner With the CIty
of Boynton Beach regardIng the park fee and we will proceed to conclude the payment of the fee upon
agreement by all partIes. We have calculated the fee based upon ArtIcle V of the Boynton Beach Code
and our recent closmg on the property ($1,890,000 for 17 13 acres or $110,333 per acre). USIng the
formula In the code together With the pnvate space, we have estimated the Park Fee to be approXImately
$148,950
We have submItted sewer, water, paVing and draInage plans to the CIty for reView and approval as well
as the archItectural plans for the prInCIpal buildings. Smce tImIng becomes an Issue With regard to
ordenng utihty structures and start of the underground work, we would commIt to finalizmg the payment
of the park fee at eIther the plat approval process or pnor to the Issuance of a C 0 for the pnnCIpal
buildIngs. If you are m agreement wIth the payment schedule enclosed, please notIfy me and we will

An HRS permit for water and sewer will be obtained.
Fire flow calculations will be submitted with HRS submittal that will meet or exceed
city code minimum requirements.
The capacitv reservations fee will be paid upon final determina:ion of fee.
Engineers certification for drainage is included herewith.
The utilitv easements are shown on the conceptual engineering plans.
All points of the building will be within 200' of the proposed hvdrants as reflected on
the plans.
Back flow precentors are included on the fire sprinkler lines as reflected on the plans.
