Hazardous Waste Contamination Response Plan by the Palm Beach
County Division of Emergency Management If you do not wish to
be involved in the approval of such plans, please direct a letter
to Mr Daniel Cary, Director of the Treasure Coast Regional
Planning Council so stating This, I believe, would be the most
efficient means of removing the request for such approval from
Development Orders as they are issued
I appreciate your help on this matter We will also try to
contact Mr Cary to eliminate the requirement for your approval,

We have received the Master Site Development Plan for the
above-referenced development of regional impact (DRI) that you
submitted to the Departnlent of Community Affairs with your letter
of July 7, 1986. We disagree with your belief that the plan is
not a change from the Amended Master Site Plan approved by the
City of Boynton Beach in an an~ndment to the DRI development order
for the project on June 3, 1986. As summarized in the information
you submitted to the Department, there are changes in the amount
of acreage designated for commercial development, office develop-
ment, light industrial development, open space, and roads. A
comparison of the actual site plans indicates proposed changes in
the location of lakes, a realignment of roads, and a reallocation
of land for the commercial, industrial and office development
from that depicted on the site plan approved on June 3, 1986.
Pursuant to Subsection 380.06(19), Florida Statutes (F.S.),
it is the position of the Department that any change to an
approved specific development plan for which a development order
has been issued must be reviewed and approved by the local govern-
ment as an amendment to the DRI development order. If the pro-
posed change does not meet or exceed any of the criteria listed
in the develol,ment order or in Paragral h 380 06 (19) (b), F S ,
pert~ining to substantial deviations, then the local government
having jurisdiction over the development nlust make a determina-
tion, pursuant to Paragraph 380 06(19) (f), F.S., as to whether
such proposed change constitutes a substantial deviation and thus
requires further DRI review. The Department therefore requests

for the above captioned project. Since it indicates a redistribution of
previously approved land uses within the project boundaries, we are seeking
City Approval of this Master Plan in accordance with the City's subdivision
and platting regulations
There appears to be some question concerning the order of appearance before
City Council and the Planning and Zoning Board since this is a DRI project
Please proceed with the schedule that you deem appropriate, understanding that
time is of the essence
We anticipate submittal of the preliminary plats, prepared in accordance with
this Master Plan, before August 1st, 1986.

Kimley-Horn, dated 3 July, 1986 addressing the consistency
between the proposed plan and the original DRI, as well as

recommend that as soon as the D R I land swap is finalized we proceed with
the master planning effort

future public park, we do not have a specific completion schedule
established at this time
I would not anticipate development occurring until at least
50% of your development is completed and occupied
We have two other undeveloped public recreation sites in your
general area and are considering another It is our intention to
master plan these sites (including yours) together to ensure
effective needs analysis and avoid duplication of ,ublic facilities
As these four sites will provide the CORE for public recreaiton
services in northwest Boynton Beach, this master plan approach is
most logical
Prior to development of the site as a public park, it is our
