RE QUANTUM PARK OF COMMERCE-MASTER PLAN AMENDMENT NO 3
INTRODUCTION
George Zimmerman, Vice President of Development, Deutsch-Ireland
Properties, has requested amendments to the Development Order,
Ordinance No 84-51 as amended by Ordinances No 86-11 and 86-37
The proposed amendments are as follows
(I) Section #3 The City Commission find that the
amendment application procedure and the subse-
quent proceedings have been duly conducted
pursuant to the provisions of Florida Statutes,
Chapter 380
(2) Section #4 subsection (1) Paragraph (E) shall
be added as follows (E) Quantum Park at
Boynton Beach, Amended Master Site Development
Plan submitted November 12, 1987.
(3) References throughout the Development Order shall
be revised to conform to the Amended Master Site
Development Plan #3, as approved. Such revisions
shall be made in the interest of consistency and
clarity
The proposed amendments are submitted in connection with a request
that the City Commission make a determination that the amendments
are not substantial in nature and that the proposed changes do
not require further Development of Regional Impact review The
Commission must conduct a public hearing on this matter prior to
making a determination
PROCEDURE
The amendment request to the approved development order is
governed by Section 7 of Appendix A, Zoning, City of Boynton
Beach Code of Ordinances, which establishes Planned Industrial
Development Districts and by Chapter 380 06(19), Florida
Statutes, for a determination of substantial deviation
As previously outlined, the City commission must conduct a public
hearing, at which time a determination is made as to whether or
not the proposed change requires further Development of Regional
Impact review. If no further review is required, the City
Commission shall issue an amended development order which, in
this instance, requires the passage of an ordinance which amends
the original development order If a determination is made that
the proposed change requires further development of regional
impact review, the review shall be conducted only on those
aspects of the development order required to be changed The
required public hearing shall receive a fifteen (15) day public
notice, following the passage of thirty (30) days, but not more
than forty-five (45) days after receipt of the amendment
materials It is anticipated that the City Commission will
conduct its hearing on January 5, 1988

This amendment procedure will require a one-time change to our
development regulations. For non-development of regional impact
planned industrial developments, the City Commission must make a
finding related to the degree of change, that is, whether or not
it is substantial, and then, the Planning and Zoning Board approves,
approves with modifications, or denies the request In this
instance, the City Commission must approve any change
Therefore, the Planning and Zoning Board must act in an advisory
capacity to the Commission, as the State Statutes prevail over City
ordinances.
LAND USE
The amended master site development plan submitted by Quantum
Associates reflects a redistribution of uses within the park,
including a redistribution of the Sand Pine Preserve Acreage, and
the creation of additional development parcels through
subdivision The mix in acres of land use as currently approved
and as proposed is as follows

RECOMMENDATION
It is the consensus of the Technical Review Board that the
Planning and Zoning Board and the City Commission should make a
finding of no substantial change with respect to the requested
changes to the Development Order, and that this project be
approved subject to the comments from the City Forester/
Horticulturist contained in the attached memorandum

Modification for the Quantum Park of Commerce The proposed
changes are outlined in the letter of submission from George
K Zimmerman, Vice President of Development Please review
the attached plans and documents and prepare your comments for
review at the December 1, 1987 regular meeting of the Technical
Review Board This request must go before the City Commission
for a determination as to whether or not it constitutes a
Substantial Deviation
