as a Minor Site Plan Revision As discussed, the building elevations have not been significantly
altered, the building square footage has been slightly decreased and the parking provided is still
significantly above code, the dumpster location has remained unchanged, and the parking lot
has been slightly altered in the rear Overall only minor modifications have been implemented
Per your request, I have enclosed one site plan package including the Site Plan
Engineering Landscaping, Floor Plans, Elevations, Photometrics and a Survey I have also
included the $100 00 review fee
Per your recommendation we will be processing building permits concurrently with this
review

Based, m part, on the presence of proposed dnveways shown at theIr locations on the approved
master plan (WIth separations less than the 150 feet required by current PID zoning regulatlOns),
and based, m part, on the absence of documentation mdicating that the park would be subject to
the current separation reqUIrement m code, I believe that the approval of the Quantum Park
master plan represented the simultaneously approval of driveway locations. Further supporting
thIS opIllion IS the fact that the dnveways are mtentionally aligned with median openmgs. GIven
the current vested status of dnveway locatIons and medIan openings, the locations, and issue of
code complIance WIll only be evaluated If saId features are proposed to be relocated or modIfied.

I have researched the Development Order and Amendments for the Quantum Park Project.
Begmnmg with Amendment No 4, the Master Plan (as revIsed), mcluded dnveway locatIOns for
lots wIthm the Development. The ordmance approvmg the Development Order Amendment IS not
specIfic as to the reason why the dnveway locations were shown on the submItted Master Plan.
ThIS reason may be IdentIfiable m the backup mformatIOn contamed wIthm the City files m support
of that Development Order Amendment.
The current DesIgn Cntena used as a basIs for reVIew by the DesIgn RevIew Comrmttee of
the Property Owner's ASSOCiatIOn does reqUIre that access to the lots within the development only
be allowed at the locatIons shown on the Master Plan. I belIeve thIS reqUIrement was wntten mto
the deSIgn cntena and the dnveway locatIOns shown on the Master Plan followmg the deSIgn,
permlttmg and constructIOn of the roadways servIcmg the lots The Record Drawmg for the
constructIOn of Quantum Boulevard m the vIcImty of Lots 15 & 16 show the dnveway locatIOn
conSIstent WIth the locatIOn of the dn veway shown on the Master Plan.
It IS my contention that the dnveway locatIOns for the lots wIthm Quantum Park were
establIshed at the time the constructIOn plans for these roadways were permItted. I further contend
that these locatIOns by VIrtue of the approval are vested and any subsequent development ordmance
amendment by thIS City does not apply As the maJonty of the roadways provIdmg vehIcular
access to the lots wIthm Quantum Park are dIVIded streets WIth landscape medIans and constructed
left turn arcess at sper1fic locatIons any deV!(ltlOn from the perrmtted and approved location of the
dnveway access to the vanous lots IS dIscouraged.
Please conSIder thIS mformatIOn m your determmatIon of the need for variances regardmg
the dnveway locatIOns for lots wIthm Quantum Park. The acknowledgement of the permItted

Regardmg the locatIOn of dnveways wlthm the Quantum Corporate Park please confirm, m
wntmg, the vestmg of the drIveway locatIOns for the access to each lot within the park as shown
on the design drawmgs of the constructed roadways. The vehIcle access management for each lot
wIthm the Park was an Issue dunng the master planmng of the Park. The planned access pomts
for each lot are also shown on the ProJect's Master Plan.
The roadways wIthm the Park were deSIgned, penrutted and constructed as four lane
boulevards WIth a landscaped median provIded. Numerous medIan opemngs and turn lanes have
been penrutted and construct. The locatIon of these turn lanes and opemngs were coordmated WIth
the park lot layout. The access to each lot was identIfied on the constructIOn plans. The dnveway
locatIons were planned to proVIde full traffic movement at the main entrance to each lot.
For example, the access to Lot 15 was penrutted to be at the northern end ofthe lot and the
left turn lane wlthm the boulevard was deSIgned and constructed to proVIde access to the lot at that
locatIon.
By virtue of the approved constructIOn plans, the planned driveway locatIOns are vested.
The planned driveway locatIOns may not be m accordance WIth the current City codes for drIveway
locations. ThIS IS problematIC m that the City Staff IS requesting an applIcant apply for a varIance if
the permitted dnveway location is not conSIstent WIth the current CIty codes. Please confirm a
varIance need not be granted for Lot 15 or any other of these vested locatIOns.

3 0 Quantum Limited Partners, Ltd. agrees to grant to Coiltronics, Inc., its successors
and/or assigns, a drainage easement onto Lots 15A and 16A, as may be reasonably
required by Coiltronics, Inc., its successors and/or assigns, and for the purpose of all
drainage required pursuant to the plans prepared for Lots 15 and/or 16 by Coiltronics,
Inc.. or any successor in interest, for the purpose of drainage (and as may be required
by any governing municipal entity) at no cost for said drainage easement, to be
entered into and recorded prior to or at c1osmg~ and
~ Coiltronics, Inc. bas been informed that a variance may be necessary to position their
~ drive at the North end of Lot IS CoiItronics, Inc. shall require that they be able to
obtain the variance either prior to closing, or obtain satisfaction of this condition
acceptable to Coiltronics, Inc.. that they are able to legally position their drive at the
North end of Lot 15 prior to closing. In the event the variance is determined to be
required by the City of Boynton Beach, at the option of Coiltronics. Inc., the closing
may be delayed until such variance is obtained, with all due diligence.
The foregoing represent the conditions which my client shall require to proceed in this transaction.
My client desires to purchase the property, but in the event the foregoing conditions are not agreed
to in writmg by Quantum Limited Partners, Ltd., this correspondence shall seIVe as notIce of
termination of the Agreement for Purchase and Sale of Real Property in accordance with Article 3.2.
As I have stated, the foregoing items, due to certain conflicting opinions which have been obtamed
between certain engineers and the CIty of Boynton Beach, must be resolved, but notwithstanding the
foregoing, my client would like to proceed with the transaction, provided the Seller can accommodate
these concerns and agree to the condItions set forth herein.

project. We are requesting a variance as follows. Variance of Chapter 2 Section 7 H, 2 of the
Land Development Regulations of the City of Boynton Beach, Florida, to permit a driveway
located less than the 150 feet minimum, from center line to center line from another driveway
The responses to the six questions of section 5, items A-F, of the Zoning Code Variance
Application are outlined below
A. That special conditions and circumstances exist which are peculiar to the land,
structure or building involved and which are not applicable to other lands, structures or
buildings in the same zoning district.
The median system within Quantum Park is designed to accommodate the driveway access at
the northeast property corner of Parcel 15 and the southeast property corner of Parcel 16 The
driveway locations are shown on the Master Plan of record (Amendment Number 8, dated May
20, 1997) The condition, as proposed, has previously been permitted in Quantum Park.
B. That the special conditions and circumstances do not result from the action of the
applicant.

Dear Thomas,
I received your note concerning the entrance curb cut for Lot 15 at Quantum Park. It
appears that the distance to the property line from the curb cut may not satisfy the
code on several parcels at Quantum Park. These curb cuts were made and installed
many years ago before new dimensions took effect.
I suggest that MFT and Coiltronics proceed with the closing, understanding that a
similar case in Quantum Park was given a variance in the past. Based on this
precedent, a variance could be granted to Coiltronics. But the variance process must
be followed This might take about one month
