Dear Mr Greenberg:
After careful review, this department has determined that, in spite of the adoption of the new
Florida Building Code on March 1, 2002, the above referenced building permits can, in fact,
be extended under the provisions of the previous code. Accordingly, the department will
immediately re-activate and extend these permits for a period of 180 days.
The department has also taken steps to cancel the scheduled meeting of the Building Board
of Adjustments and Appeals that was called to appeal the initial staff decision to cancel these
permits. The required $100 fee for this meeting will also be refunded.
We trust that these departmental actions will adequately address the immediate concerns of
both you and your client in this matter

ThIS meetmg was held to address concerns of Mr Burrow on hIS property, Lot 3 m
Quantum Park - PermIts #00-2992 & #01-3431
Mr Burrow expressed concern about bemg able to secure financmg for an office/
mdustnal project on hIS sIte, m lIght of the Issue mvolvmg the land use desIgnatIOn on hIS
property He wanted to know what hIS optIOns are as of today Mr Greene and Ms
Galav explamed to hIm that the land use changes m hIS lot from Office/Industnal to
Industnal means that:
1 Another NOPC IS reqUIred to change hIS land use back to 01 m order to go
forward with his plans.
2. The status of Mr Burrows approved sIte plan has techmcally expIred.
3 Current perrmts now must meet all new code standards m order to be m
complIance WIth new 2001 Flonda BUIldmg Code changes.
Therefore, the current buIldmg permIts and SIte plan are now null and void.
If Mr Burrow WIshes to obtam a new NOPC It would be up to MFf (Quantum Park
Developers) to take the ImtIatIve to request that the land use be amended WhICh may take
between three and four months. He would be able to do thIS concurrently whIle
resubmIttmg his site plans.
Mr Burrow was mformed that the Development Department could only aSSIst hIm at thIS
pomt If the NOPC and SIte plans are approved. However, smce Mr Burrow has been
granted numerous extenSIOns, we are unable to grant hIm addItIonal ones and stIll comply
WIth CIty ordmances and State codes.
If Mr Burrow can comply by obtammg a new NOPC and submIttmg a new SIte plan
Development wIll work WIth hIm to get the SIte plan approved.

I am sorry to inform you that I can no longer grant you an extension on the above
referenced permits On March 1, 2002 the entire State of Florida adopted the 2001
Florida Building Code I can no longer extend applications under the old code, as the
new code demands more stringent requirements for wind load and extensive changes in
the technical codes (plumbing, mechanical, electrical and building)
If you decide to go forward with your project, you must submit new permit applications
and plans that comply with all the requirements of the 2001 Florida Building Code

In response to your letter dated May 2, 2002 I closed on lot 3 in July of 1999 after I had
obtained site plan approval for the 46,600 sq ft. office warehouse project that you
referenced in your letter That plan indicates a 50% warehouse and 50% office
approval even though I was providing parking to allow even a greater office percentage
I did not provide written permission to have the land use on my property to be changed
I am being told by the building department that I will be charged impact fees for 100%
office I do not believe Boynton Beach should have allowed the land use on my
property to be changed Why would the city of Boynton Beach allow the land use to be
changed to industrial which allows 20% office when I had a site plan approved with 50%
office
This mistake is reducing the value of my property I would like the land use on my
property changed back to office-warehouse, as it was when you approved my site plan
and I purchased my property This problem will prevent my obtaining financing or
selling my property
I would appreciate this being resolved immediately so legal fees can be spared

TIus letter IS a response to your request for clanficatIon of the CIrcumstances regardmg the above referenced
property receivmg an Industnal (I) desIgnatIOn on the Quantum Park Master Plan. Pursuant to SubsectIOn
38006 (19) Flonda Statutes, all changes to an approved Development of RegIOnal Impact (DR!) reqUIre a
Notice of Proposed Change (NOPe) be submItted to the governmg ]UflsdIctIOn and to the Flonda Department of
Commumty AffaIrs. Quantum Park IS an approved DR! and must follow thIS procedure.
On July 6, 1999, the CIty of Boynton Beach Issued a development order for a 46,660 square foot office/
warehouse buildmg to be constructed on Quantum Park Lot 3 At that tIme you were the applIcant for the SIte
plan approval and Quantum Lumted Partners, Inc was the owner of record. Quantum LImIted Partners, Inc IS
the developer of record for Quantum Park.
On January 11, 2000, Mr Douglas MacDonald, PreSIdent of MFT Development, Inc., the Quantum LImIted
Partners, L.C General Partner submItted a NOPC ApplIcatIon for Amendment #10 to the Quantum Park DR!.
Amendment #10 mcluded several changes to the master plan mcludmg the reaSSIgnment of Lot 3 from
Office/Industnal (01) to Industnal (I) The request mdIcated thIS change was bemg made "to be conSIstent WIth
the approved SIte plans for warehouse, storage and dIstributIOn" The CIty CommIssIon approved Amendment
#10 on March 7, 2000 per Ordmance No 00-02 A notIce ofpubhc heanng was publIshed m the February 26,
2000 edItIOn of the Palm Beach Post pursuant to Chapter 380 06, Flonda Statutes.
The current deSIgnatIOn for Lot 3 on the Quantum Park Mater Plan IS Industnal (I) A change to that deSIgnatIon
