This letter will confirm our conversation yesterday that the
Quantum Substa~ion's buffer requirements along the south property
line will need to be resolved at a joint meeting between the City
Manager's office, Quantum Park and Florida Power Light At the
City Commission public hearing on September 18, 1990 the substation
was approved with the provision that the southern buffer
requirements would be determined at an administrative level and as
such ins~alled simultaneously with the substation's construc~ion
The purpose of this meeting will be to determine what additional
landscaping will be required wi~hin Quantum Park's adjacent Tract
51-C in order to comply with the Planned Industrial Park's twenty-
five (25) foot perimeter greenbelt requirement Please give me a
call once a meeting time is determined so we can arrange our
schedules accordingly
On a related matter, Mike Haag with the Building Department
informed me at the Communi~y Appearance Board meeting on September
17, 1990 that the substation's proposed five (5) on center
perimeter hedge would require a formal variance request and
approval Please be advised we will not be requesting this
variance and have revised our landscape plan per ~he Boynton Beach
Section 7 5-35c(3) landscape code requirements for perimeter hedge
material

I have reviewed the August 14, 1990, letter trom David Flinchum
to vince Fin1z1o regarding the application or the par>Clng Code
requirements to the above project Based upon the representation
that the sub-station is an unmannea rac11ity, I would concur that
the Section 5-139(c) exemption app11es
Vince Finizio has indicated some concern with respect to the
outside lighting of the structure (which "",ould ordinarily be
addressed by application of the Parking Code (Section S-142(a))
I have discussed that matter with Mr Flinchum and he has advised
that the facility does have some exterior lighting, but it has
been FP&L experience that exterior lighting of unmanned sub-
stations can attract vandalism rather than minimize it. I think
we should defer to their experience in this regard

Dear Jim:
As a follow up to the Planning & Zoning Public Hearing on September
11, 1990, please be advised there are a number of staff comments
that still are being listed in our site plan review report even
though many of these items were incorporated with our resubmittal
on August 23, 1990 I was surprised when some of these were
brought up again at the August 31, 1990 Technical Review Board as
I was under the impression revised staff reports would be forwarded
as part of the ongoing governmental review process This project
is currently scheduled before the September 18, 1990 City
Commission Meeting and as of the September ll, 1990 Planning &
Zoning meeting, there still are some original staff comments To
possibly help in our coordination efforts, I would appreciate if
you could review the attached listing of staff comments and advise
me if there are any remaining issues I need to address prior to the
City Commission public hearing

1 The use of nut producing vegetation is avoided to reduce the
hazard of squirrels around the substation sites We have used
Laurel Oak successfully in several substations and it is the
preferred choice due to its moderate growth rate, dense
foliage and low water demands The average life span for
Laurel Oaks is about 60-70 years and is therefore not
considered a short lived species
2 Elevations for both south and east property lines have been
provided for staff review Please advise if additional copies
are required
3 Two (2) feet on center spacing for hedge material is usually
required if eighteen (18) inch high minimum landscape code
material is to be installed We are proposing five (5) foot
tall wax myrtles planted in both staggered and linear

Please be advised of the following Planning Department comments
with respect to the above-referenced request for site plan and
use approval
1 The applicant is seeking to amend the list of permitted uses
at the Quantum Park of Commerce P I D , as referenced in
their letter of request, to allow a utility facility on lot
51 B, designated for "Industrial" use on the Qauntum Park
master plan Utility facilities, such as electrical
distribution substations, would be able to locate elsewhere
in the City in the M-1 (Light Industrial) zoning district
under Appendix A - Zoning, Section 8 A 1 d (1), without
requiring environmental review In addition, comprehensive
Plan Policy 1 14 6 states that sites for electric
substations and switching stations should be allowed in all
land use categories and zoning districts, subject to site
plan review and screening Therefore, it is the Planning
Department's recommendation that it would be appropriate to
permit this use on those parcels designated "Industrial" on
the master plan for Quantum Park Appendix A - Zoning,
Section 7 E
2 Provide verification that the agreement made between FPL and
the S F W M D , authorizing ~L'S use of the C-16 canal
easement, was recorded
3 Consistent with the greenbelt treatment that was required
for safety Kleen, it is recommended that the applicant
provide 12 1/2 feet of the required 25 foot greenbelt on lot
51 B, to include only landscaping and that the remaining 12
1/2 feet be provided on lot 51 C to consist of sod The
greenbelt design and the owner or developer agreement to
carry out and pr'ovide maintenance for the greenbelt, is
subject to planning and zoning Boar~ and Community
Appearance Board approval
This recommendation and interpretation of lot 51 B as a
perimeter lot, is based on the Quantum Park plat document
which states that the drainage easement canal (lot 51 C) is
an integral part of the corresponding lot lying north of and
immediately adjacent to said drainage easement canal and
that said integral part was therefore designated with the
corresponding lot number and letter identification This
recommendation is also based on Comprehensive Plan Policy
1 14 6 which would require screening of utility facilities,
the landscaping proposed would not adequately screen the
substation
With respect to installation of the greenbelt, it is
recommended that the greenbelt be installed when the visual
impacts of the use occur, namely prior to issuance of a

Enclosed for your consideration are the Site Plan submittal
revisions and the Environmen~al Review application for the proposed
Quantum Substation The si te plan was ini tially reviewed by
Departmen~al staff a~ the Augus~ 6, 1990 Technical Review Board
meeting with many of the staff comments being incorporated into
this second submi~~al Also, ~o provide more detailed information,
we will be filing a simultaneous Community Appearance Board
application wi th the Building Depar~men~ so tha~ ~hose staff
members will have suppor~ive documents to respond to their comments
concerning ~he eleva~ion, color and ma~erials used for ~he
substation's relay vault
You will recall there were ~wo main issues raised by staff at the
initial TRB mee~ing ~he paved areas being subjec~ to s~andard
parking lot regulations for lighting and striping requirements
together wi ~h the second s~aff concern as ~o Lot 51-B being
considered a per imeter lo~ of the Quantum Park PID and thereby
subjec~ ~o the twenty-five (25) foot perimeter greenbelt
requirement along the Lot 51-B southern property line
I~ is my unders~anding that ~he in~erim Ci~y A~torney, Jim ~heroff,
has determined the substation's paved areas are to be considered
non-public and ~hereby exemp~ed from some of the s~andard parking
lot requirements raised at the August 6th TRB meeting In response
to Lo~ 51-B being considered the sou~hern perimeter of Quantum Park
PID, we have confirmed with the developer tha~ lot 51-C to our
south and adjacent to ~he SFWMD C-16 canal was platted as the
project's southern perimeter Please no~e we have added the
reference for Lot 51-(' on ~he si te plan and also inrluded the
statement on our landscape exhibit ~hat the required ~wenty-five
(25) foo~ sodded greenbel~ requiremen~ will be provided wi~hin Lo~
51-C
Please review the enclosed Technical Review and Environmental
Review submittals as we would like both items to be scheduled for

Parking Ordinanre, I would appreciate if you would forward our
request' t'o C"onsider t'his subst'ation under t'he exempt' ion C" lause
Chapter 5, Article X, Section 5-139(r), page 448, such that due to
the unique nat'ure nf t'his part'icular land use, many of t'he st'andard
parking lot regulations are not' applicable

trained personnel only Artirle X, Sect'ion S-139(c) st'ates t'hat'

Please be advised that the plans submitted for site plan review
of the above-referenced request cannot be processed further due
to the lack of required information and insufficient parking (see
comment #3 below for details) Six sets of revised plans
addressing these comments, as well as the attached comments from
other departments, will need to be resubmitted to the planning
Department no later than 5 00 P M on any given deadline listed
on the project review schedule available in the planning
Department
1 Lot 51 C lies immediately south of lot 51 B, the subject
parcel, and has a 144+ foot S F W M D , C-16 canal, drainage
easement on it According to the plat (Quantum Park at
Boynton Beach, P I D Plat No 4), lithe drainage easement
canal is an integral part of the corresponding lot lying
north of and immediately adjacent to said drainage easement
canal 11 Said integral part was therefore, designated with
the corresponding lot number and letter identification Add
a note to the plans regarding FPL's future intent with lot
51C Clarify whether this lot will be purchased by FPL or
owned and maintained by the Quantum Park Property Owners'
Association Inc and what improvements will exist on it
Also, as a point of information, please provide answers to
the following questions
a) Has the FPL easement for electric transmission and
distribution lines, recorded in 0 R B 672, PG 40, been
abandoned? The legal description provided includes it, the
survey provided does not and the plat states that it is
proposed to be abandoned

2 Based on the findings in item #1 above, a 25 foot peripheral
greenbelt is required along the south and east property
lines, which shall be the responsibility of the owner or
developer to carry out and to provide such maintenance or
guarantee of maintenance I subject to planning and zoning
board and community appearance board approval Appendix A

3 As required by Appendix A - Zoning, Section 11 H 5 and
section 7 H 2 I a minimum of 4 parking spaces is required
Therefore, as itemized on page 6, item # 26 on the site plan

our discussions regarding the operation of this facility,

for a parking space variance from the Board of Adjustment,
