WATTS SECRETARY December 24, 1992 Mr. Chris Cutro Director of Planning City of Boynton Beach 100 East Boynton Beach Blvd Boynton Beach, FL 33425 RECEIVED oEe 18 PLANNING DEPT. - Subject N.W. 22nd Avenue Interchanqe at Interst~tp q~ Dear Mr Cutro We have recently researched our records relating to the N W 22nd Avenue Interchange project and have determined that we have not received the committed financial contributions from the city and/or the developer of the Quantum Corporate Park toward this project On December 4, 1992, when we spoke on this subject, I had not yet been able to contact our project management staff on this subject Likewise, you indicated that you planned to research this issue with City staff since that time, I have not been able to find any evidence that Deutsch-Ireland, Inc , the current developer of Quantum Corporate Park, has met its funding requirements for our interchange project It appears clear that the developer intended to furnish a financial contribution toward the cost of right-of-way acquisition and construction of the interchange as part of the Development Order issued by the City of Boynton Beach on December 18, 1984 Two contributions of $ 900,000 each according to Conditions 26 and 27 of the Development Order should have been made to the Department prior to the commencement of construction of the N W 22nd Avenue Interchange project The construction letting date for this project was February, 1991 Conditions 26 and 27 of the Development Order are cited below 11(26) When external trips generated by the project exceed 15,000 trips per day, the developer shall construct, or contribute to Palm Beach County the cost of constructing, two additional lanes on Congress Avenue, bringing it to a six-lane capacity, from Boynton Beach Boulevard to Miner Road If this improvement is constructed by others at no cost to the developer and if neither the State nor Federal government has indicated disapproval of the 1-95 interchange at Northwest 22nd Avenue, the developer shall contribute $ 900,000 toward construction of the interchange in lieu J:%\RECYCLED \V PAPER Letter to Chris Cutro December 24, 1992 Page Two of said Congress Avenue improvements, provided, however, that if the contribution is not required for the interchange due to the fact that the state or Federal Government has indicated disapproval, the developer shall provide $ 900,000 to the County to be used for improvements at the inter- section of Boynton Beach Boulevard and Congress Avenue and at the intersection of Northwest 22nd Avenue and Congress Avenue to provide additional capacity required if the interchange at 1-95 and Northwest 22nd Avenue is not constructed The contribution under this condition shall not exceed $ 900,000 00 except as that amount is adjusted for changes in the cost of living by a construction cost index using 1985 as the base year. (27) The developer shall contribute $ 900,000 00, in excess of any contribution made pursuant to Condition 26 above, for right-of-way acquisition and construction of an interchange at 1-95 and Northwest 22nd Avenue at such time that the funding is needed to commence with construction of the interchange The developer shall also dedicate to the appropriate governmental agencies any incidental right-of-way, not to exceed three acres, which is needed for the interchange and is located within the project boundaries If the interchange is disapproved by the responsible state and Federal agencies, the developer shall contribute $ 900,000 00 to Palm Beach County for improve- ments at the intersection of Congress Avenue and Boynton Beach Boulevard and the intersection of Congress Avenue and Northwest 22nd Avenue when the project generates in excess of 15,000 external trips daily. This contribution shall not be required in the event that the $ 900,000 00 contribution required under Condition 26 above is allocated to improvements at these intersections The contribution under this condition shall not exceed $ 900,000 00 except as that amount is adjusted for changes in the cost of living by a construction cost index using 1985 as the base year It is also clear that the City recognized the developer's intention to contribute funds toward the project and stated in its Resolution No 88-PP dated June 21, 1988 that "Quantum Park has set aside a financial contribution for the construction of this interchange " We are also in receipt of an Annual Monitoring Report for Year 1990 on Quantum Park which indicates that payment for Condition 27 has been made This information was obtained in early December, 1992, from the Treasure Coast Regional Planning Council We believe this information is in error Letter to Chris Cutro December 24, 1992 Page Three since the City of Boynton Beach is responsible for enforcing the requirements of its Development Order, we are asking for your assistance in obtaining the committed financial contributions for the N W 22nd Avenue Interchange and transferring them to the Department As you know, the Department was responsible for the costs of the right-of-way and construction phases of the inter- change project. RE Quantum Park - Clearing Limits for Roadway Construction Dear Mr Hallahan Pursuant to discussions with Mr Zimmerman and Mr Flotz of Quantum Assocs , we have reviewed the clearing limits along the proposed roadways within the referenced project and have set forth below a description of what the approved plans call for The Typical Section for the 100' rights of way Sheet 49 of 68 provide for a maximum slope of 1 on 6 when roadway is in cut and a maximum slope of 1 on 10 when roadway is in fill We have revised the fill section slopes from 1 on 10 to 1 on 6 which still meets current design standards and would be less disrup- tive of existing vegetation on fill areas Based on a cut and fill section with side slopes of 1 on 6 and since the roadway profiles provide for cut and fill by as much as 5 feet, a limit of construction line will protrude beyond the road right of way lines For example, if the roadway is in cut by 4 feet the required top of cut line will be 24 feet outside the right of way with a 10 foot clearing beyond the cut line for a total of 34 feet wide limit of construction The same would be true for establishing limits of construction for fill areas since the slope is equal for cut and fill Limits of construction for general filling of low areas will require a limit of construction of 10 feet beyond the fill contour line Areas abutting water management tracts will require a 10' limit of construction line outside of platted tract lines Utility easements and drainage easements identified on the plans are to be cleared and graded within the limits of the width of platted easement Deep sanitary sewer and storm sewer lines may require additional clearing to provide for minimum ditch side slopes of 1 on 1 At the pre-work meetings held at the City, the contractor was cautioned to utilize a movable ditch excavation steel box to keep the top width of trench to a minimum For short distance of deep cut between lots or on the rear of lots, the limit of construction will go beyond the easement lines ROSSI AND MALA V ASI ENGINEERS. ENVIRONMENT AND NATURAL RESOURCES: AIR 13-A Estimate average daily emissions in pounds per day by type and source. As a result of the Boynton Park of Commerce development an increase in automobile emissions will be realized. These emissions have been calculated for hydrocarbons, nitrogen oxide, and carbon monoxide. These rates are based on two phases and an average trip length of 7 5 miles. A complex source permit application requirement in accordance with Chapter 17- 2.04 of the Florida Administrative Code was abolished in 1981, thereby eliminatiI1g this requirement. 13-1 13-C What steps will be taken to reduce emissions and to minimize adverse effects? The following measures will help reduce emissions and minimize adverse effects to the air quali ty: (1) The land use mix will develop internal non-vehicle trips which will help reduce auto emissions. (2) Improvements to the area's road network will enhance traffic flow (3) More stringent federal emission standards will help reduce vehicle emissions. 13-2 31. PUBLIC TRANSPORTATION CONSIDERATIONS FACILITIES: TRANSPORTATION 31-A Using Exhibit J as a base, indicate existing conditions on the highway network within the primary impact area (as previously defined by Exhibit J, including ADT, peak-hour trips, directional traffic load, level of service, and roadway capacity. What improvements or new facilities, which will have an influence on this proposed development, are planned or programmed? Attach a letter from the appropriate agency stating the current status of the planned improvements. EXISTING CONDmONS Primary Impact Area Based on discussions with the Regional Planning Council staff and the Palm Beach County Engineering Department, the primary impact area of the Boynton Beach Park of Commerce project was identified. The primary impact area extends from Boynton Beach Boulevard to Hypoluxo Road and from Military Trail to U.S. 1 This area includes all roadway links that will be significantly affected by the project. Existing Roadway Network The physical and operational characteristics of the existing roadway facilities within the primary impact area were examined in order to analyze current levels of service and roadway capacities. The analyses utilized traffic volume data obtained from the Area Planning Board of Palm Beach County and supplemented with manual traffic volume counts made by Kimley-Horn. 31-1 Based on an analysis of the traffic data, including a review of actual 24-hour machine counts on an hourly basis, the period of highest weekday activity was determined to be between 4:00 and 6 00 PM. The directional distribution of traffic during the peak period ranged from 60%/40% to 55%/45%. Peak hour intersection turning movement counts were made by the consultant at the following locations: Hypoluxo Road and Military Trail Hypoluxo Road and Congress A venue Hypoluxo Road and 1-95 N W 22nd Avenue and Congress Avenue N W 22nd Avenue and Seacrest Boulevard Boynton Beach Boulevard and Military Trail Boynton Beach Boulevard and Congress Avenue Boynton Beach Boulevard and 1-95 The peak hour directional volumes are depicted on Map J-1. Also depicted on Map J-l are twenty-four hour 1983 yearly average traffic volumes. All of these volumes are actual counts as reported by the Area Planning Board with the exception of the volumes depicted on the following links which were determined assuming the adjacent peak hour counts are 9 percent of the 24-hour traffic: Military Trail south of Hypoluxo Road N W 22nd Avenue west of Congress Avenue N W 22nd Avenue east of Congress Avenue N W 22nd Avenue east of Seacrest Boulevard Seacrest Boulevard north of N. W 22nd Avenue Seacrest Boulevard south of N W 22nd Avenue 31-2 Capaci ty and Level of Service Analyses of existing capacities for the study area roadway network were based on the Urban Transportation Planning System (UTPS) daily capacities for various levels of service. The UTPS capacities were developed assuming a ten percent peak hour percentage. Since a nine percent peak is typical in Palm Beach County, the UTPS capacities were adjusted to reflect local peaking conditions. The capacities are shown in Table 31-1 for each of the facility types in the study area. These capacities serve as a basis for generalized assessment of the levels of service on the areawide roadway network. Existing daily traffic volumes were compared with the daily capacities identified in Table 31-1 to identify the levels of service currently provided throughout the study area. Current Network Improvements There is a current roadway improvement I?roject underway in the study area. Congress Avenue is being upgraded to a four-lane facility from Lantana Road to NW 22nd Avenue. Programmed Network Improvement Several roadway improvements are programmed in the study area. Hypoluxo Road will be widened to four-lanes from US 1 to Congress Avenue. Boynton Beach Boulevard will be widened to four-lanes from Congress Avenue to Military Trail. Military Trail is also programmed to be widened to four-lanes from Old Boynton Road south to Steiner Road. Data on these programmed network improvements was provided by the Palm Beach County Engineering Department (see Appendix). 31-4 31-B Provide a projection of traffic not generated by this development, on the highway network within the primary impact area at the end of each phase of development. TRAFFIC PROJECTIONS Traffic not generated by this develo[)ment was estimated based on existing traffic volumes and projections of future travel made by the Area Planning Board of Palm Beach County and the Florida De[)artment of Trans[)ortation. Phase 1 of the development is expected to be fully occupied in 1993. Traffic for that year was estimated using a straight-line inter[)olation between existing traffic and projected Year 2000 traffic volumes, after adjusting the Year 2000 volumes for assumed development within the Park of Commerce area. Because full occupancy of Phase 2 is not expected to occur until the Year 2013 (30-year horizon), the Year 2000 projections could not be used. After discussions with Palm Beach County staff it was determined that thoroughfare plan volumes (full build-out) would be an appropriate estimate for that time period. As in Phase 1, the input socio-economic data used in the thoroughfare plan were reviewed and the traffic volumes adjusted to eliminate double-counting of the project traffic. One analysis of Phase 2 traffic was based on construction of a new interchange at N W 22nd Avenue and 1-95 Because the [)roposed interchange would affect traffic not related to this development, the thoroughfare plan volumes were also adjusted to account for the effect of the interchange. 31-5 31-C Provide a projection of vehicle trips expected to be generated by this development at the end of each phase of development. State all standards and assumptions used, including trip generation rates by land use types, modal split, persons per vehicle, etc. PROJECT TRAVEL PROJECTIONS Vehicle trip generation for the Boynton Beach Park of Commerce was estimated based on projected land use for the development and the trip rates shown below All trip rates were based on available information from the ITE Trip Generation Manual. Office trip rates per acre were not available from ITE, therefore, a generation rate was determined assuming a floor area ratio (FAR) of 30 percent and a rate of 12.3 trip ends per 1,000 square feet. The FAR was based on a survey of over one dozen office parks in Florida and is consistent with the developer's plans for this site. Many of these sites included two, three and four story buildings (see appendix) The following lists the assumed trip generation rates by land use. Use the format below and include a discussion of what aspects of the development (i.e., provision of on-site shopping and recreational facilities, on-site employment opportunities, etc.) will account for this internal/external split. INTERNAL/EXTERNAL SPLITS It is estimated that 75 percent of the trips generated in Phase 1 and 69 percent of the trips generated in Phase 2 by the Boynton Beach Park of Commerce will have an external impact. The external impact will show a relative decline over time because the commercial and hotel areas will develop before the office development increases. Also, a greater proportion of the trips generated by the commercial and hotel uses will originate from the internal office and industrial development. In addition, as the industrial and office growth increases more of the needs of those firms will be able to be served within the development. The estimated internal/external split by land use is shown below for each phase. If necessary, provide a separate Exhibit J for each phase of development showing expected conditions at the end of each phase. TRAFFIC ASSIGNMENTS External trips generated by the project were distributed geographically The distribution analyses considered population, dwelling unit and employment projections for the Year 2000 within a 2-1/2, 5 and 10 mile radius of the project. Further, a general review of areas which are primarily retirement oriented was also undertaken in an attempt to identify a realistic geographic distribution of trips which would most likely be attracted to the Boynton Park of Commerce. The actual distribution of trips generated reflect a general zone-to-zone relationship by major geographical area and considers the minimum travel time paths between these areas. The overall distribution for Phases 1 and 2 (percent of project traffic by cardinal direction) are listed below: North 40 Percent South 30 Percent East 05 Percent West 25 Percent Using the distribution above, the trips generated by the proposed development were assigned to the impact area roadway network. Two separate assignments 31-9 were made for Phase 2 development traffic one assuming construction of an interchange at NW 22nd Avenue and 1-95, and the other assuming no interchange. The impact traffic volumes and background traffic volumes for development phases are shown in Maps J2-A through J4-B. The external peak hour vehicle trips generated by the development project and their directional split were estimated by utilizing the Institute of Transportation Engineers trip generation characteristics listed below Land Use Commercial Hotel Office Light Industrial % Peak 10 7 18 19 In/Out 50/50 50/50 15/85 34/66 For internal trips, 10 percent were assumed to occur during the peak hour, with a 50/50 split. It should be noted that these traffic generation rates reflect the typical experience with low auto occupancy and little or no transit use. It is anticipated that promotion of transit use, ride-sharing programs and staggered work hours at this project could significantly reduce peak hour vehicle trips. 31-10 31-F Based on projected trips as shown in (E) above, what modifications in the highway network (including intersections) will be necessary as a result of this development? Specify improvements needed initially and at the end of each phase of development. STREET AND HIGHWAY IMPROVEMENTS In order to identify the roadway improvements required to accommodate the projected traffic volumes resulting from the Boynton Beach Park of Commerce and areawide growth at the end of each phase, detailed peak hour intersection analyses were conducted at critical intersections in the study area which will experience the most significant impact from the development. These analyses were supplemented by generalized capacity analyses on remaining links within the study Detailed intersection analyses were conducted at the following intersections for each phase of the development: Congress A venue and Hypoluxo Road Miner Road North Access Road NW 22nd Avenue Boynton Beach Boulevard 1-95 and Hypoluxo Road NW 22nd Avenue (with interchange) Boynton Beach Boulevard 31-11 t - -1 Mili tary Trail and Hypoluxo Road Boynton Beach Boulevard Miner Road, High Ridge Road and NW 22nd Avenue and Internal Drives (2) High Ridge Road Seacrest Boulevard Other access points to the development Based on the peak hour analyses and comparison of the generalized roadway capacities with the projected traffic volumes on the remainder of the links, the areawide roadway and intersection link improvements were identified. With the improvements shown on Maps J-5A through J-7B, Level of Service "D" or better will be provided throughout the roadway network during the peak traffic hours, for Phase 1 and for Phase 2 with the interchange at N W 22nd Avenue and 1-95. Without the interchange, severe congestion will occur at Congress Avenue and N W 22nd Avenue and at Congress Avenue and Boynton Beach Boulevard, even with the improvements shown.
