Request:
Vanance from the CIty of Boynton Beach Land Development RegulatIOns,
Chapter 2 -Zorung, SectIOn 7 - Planned lndustnal Development, H.16, to reduce
the reqUIred rear setback from 30 feet to 13 feet to allow InstallatIOn of an
alumInum pan roof over eXIstIng ground-mounted eqUIpment.
NATURE OF REOUEST
Thomas J Wilh, agent for PackagIng Concepts, IS requestIng to reduce the reqUIred rear setback
from 30 feet to 13 feet for the purpose of allOWIng a 17 foot lngh canopy to be built over the
eXIstIng ground-mounted eqUIpment. PackagIng Concepts, located In the Quantum Park PID IS a
1 48 acre SIte at 4925 Park RIdge Road (see Exhibit A - LocatIOn map)
BACKGROUND
PackagIng Concepts was ongmally approved In 1995 As a part of that development a concrete
slab was placed In the rear of the buildIng for the purpose of plaCIng eqUIpment used as a part of
the on-goIng requIrements of the bUSIness (see ExhibIt B - site plan and landscape plan) The
eqUIpment In questIOn IS open to the elements and the owner would like It to be covered.
The follOWIng is a descnption of the zorung distrIcts and land uses of the properties that surround
PackagIng Concepts

The code states that zonmg code vanances cannot be approved unless the board finds the
followmg
a. That specIal condItIOns and CIrcumstances eXIst wluch are peculIar to the land, structure,
or bUIldmg mvolved and WhICh are not applIcable to other lands, structures or bUIldmgs
m the same zorung dIstnct
b That the speCIal condItIOns and CIrcumstances do not result from the actIOns of the
applIcant.
c That grantmg the vanance requested wIll not confer on the applIcant any speCIal pnvIlege
that IS derued by thIS ordmance to other lands, bUIldings, or structures m the same zorung
dIStnCt
d. That lIteral mterpretatIon of the prOVlSlons of tlus ordinance would depnve the applIcant
of nghts commonly enjoyed by other propertIes m the same zorung dIStnCt under the
terms of the ordinance and would work unnecessary and undue hardship on the applicant.
e. That the vanance granted IS the m1ll1mum vanance that wIll make possible the reasonable
use of the land, buildmg, or structure
f That the grant of the vanance will be m harmony WIth the general intent and purpose of
tlus chapter [ordmance] and that such variance WIll not be mjunous to the area mvolved
or otherwIse detnmental to the publIc welfare.
ANALYSIS
As part of evaluatmg a vanance request, staff looks for alternatives that would mIrumIze or
negate the need for a vanance (as reqUIred by the cntena for grantmg a vanance) The requested
vanance is the mmunum that can be requested If the eqUIpment cannot be relocated. Even If
operatIOnally (such as a floor plan layout change), the eqUIpment could be relocated, there IS no
room to move It and stIll meet setbacks, unless parkmg IS elImmated (see ExhibIt C - applIcant's
JustificatIOn) There are six surplus spaces. However, tlus would make the equipment and
canopy vIsible from a street. The eXIstmg location IS m the rear yard and will be partly vIsible
from the future mdustnal development to the south. ThIs eqUIpment IS typIcal of mdustnal
developments maktng the eXIstmg location preferable. There is existmg landscapmg, comprised
ofa hedge and trees along the rear of the property (see ExhibIt B).

vanance from the City of Bovnton Beach Land Development RegulatiOns, Chapter 2 - Zonmg,
Section 7 - Planned Umt Development, H.16, to reduce the reqmred rear setback from 30 feet to

5 Statement of special conditions, hardships or reasons justifying the
requested exception or variance
A. That special conditions and circumstances exist which are peculiar to the
land, structure or building involved and which are not applicable to other
lands, structures or buildings in the same zoning district;
The day-to-day operations of the business require the use of air
compressing equipment. The operational requirements mandate the
placement of this equipment at the rear of the building The slab is existing
and would be covered with the proposed aluminum roof to protect the
components from the elements The warehouse is constructed on the
exact 30 feet rear setback requirement for a P I 0 , preventing this structure
or any other from being constructed in the rear of this building
B That the special conditions and circumstances do not result from the actions
of the applicant;
The existing conditions or circumstances are not a result of the applicant
but severely restrict the operations and expansion of the manufacturing
business The business is in the process of setting up operations and
plans to employ up to 60 people of various skill levels
C That granting the variance requested will not confer on the applicant any
special privilege that is denied by this ordinance to other lands, buildings or
structures in the same zoning district;
The granting of the variance requested will not confer any special privilege
on the applicant that is not obtainable through the variance process. The
proposed aluminum roof to cover the mechanical equipment will not be
noticed in this area of industrial type buildings and uses
o That literal interpretation of the provisions of this chapter would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning
district under the terms of the ordinance and would work unnecessary and
undue hardship on the applicant;
The literal interpretation of the provisions of this chapter would deprive the
applicant of the right to utilize the property to its fullest potential. This in
'11
I ~'
r
{
turn would limit further investment in the property and the number of
people amployed
E. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building or structure,
The vanance requested is the minimum variance possible and the
granting of same will allow full use of the land and building
F That the granting of the variance will be in harmony with the general intent and
purpose of this chapter and that such variance will not be injurious to the area
involved or otherwise detrimental to the public welfare,
The granting of the variance will result in the slightest disruption to the
present environment of Quantum Park. The completed alteration will be
harmonious with the existing environment and will in no way be injurious
to the area involved or otherwise detrimental to the public safety and
welfare
Thank you for your consideration
