NATURE OF REOUEST Thomas J Wilh, agent for PackagIng Concepts, IS requestIng to reduce the reqUIred rear setback from 30 feet to 13 feet for the purpose of allOWIng a 17 foot lngh canopy to be built over the eXIstIng ground-mounted eqUIpment. PackagIng Concepts, located In the Quantum Park PID IS a 1 48 acre SIte at 4925 Park RIdge Road (see Exhibit A - LocatIOn map) BACKGROUND PackagIng Concepts was ongmally approved In 1995 As a part of that development a concrete slab was placed In the rear of the buildIng for the purpose of plaCIng eqUIpment used as a part of the on-goIng requIrements of the bUSIness (see ExhibIt B - site plan and landscape plan) The eqUIpment In questIOn IS open to the elements and the owner would like It to be covered. The follOWIng is a descnption of the zorung distrIcts and land uses of the properties that surround PackagIng Concepts North - Park RIdge Boulevard and farther north IS the Pubhx DIstributIOn Center and undeveloped land In Quantum, zoned PID South - Undeveloped land In Quantum Park, zoned PID / Page 2 Packagmg Concepts FIle No ZNCV 98-005 East - Beta Dnve and farther east IS undeveloped land m Quantum Park, zoned PID West - Flowers DIstnbutIon m Quantum Park, zoned PID The code states that zonmg code vanances cannot be approved unless the board finds the followmg a. That specIal condItIOns and CIrcumstances eXIst wluch are peculIar to the land, structure, or bUIldmg mvolved and WhICh are not applIcable to other lands, structures or bUIldmgs m the same zorung dIstnct b That the speCIal condItIOns and CIrcumstances do not result from the actIOns of the applIcant. c That grantmg the vanance requested wIll not confer on the applIcant any speCIal pnvIlege that IS derued by thIS ordmance to other lands, bUIldings, or structures m the same zorung dIStnCt d. That lIteral mterpretatIon of the prOVlSlons of tlus ordinance would depnve the applIcant of nghts commonly enjoyed by other propertIes m the same zorung dIStnCt under the terms of the ordinance and would work unnecessary and undue hardship on the applicant. e. That the vanance granted IS the m1ll1mum vanance that wIll make possible the reasonable use of the land, buildmg, or structure f That the grant of the vanance will be m harmony WIth the general intent and purpose of tlus chapter [ordmance] and that such variance WIll not be mjunous to the area mvolved or otherwIse detnmental to the publIc welfare. ANALYSIS As part of evaluatmg a vanance request, staff looks for alternatives that would mIrumIze or negate the need for a vanance (as reqUIred by the cntena for grantmg a vanance) The requested vanance is the mmunum that can be requested If the eqUIpment cannot be relocated. Even If operatIOnally (such as a floor plan layout change), the eqUIpment could be relocated, there IS no room to move It and stIll meet setbacks, unless parkmg IS elImmated (see ExhibIt C - applIcant's JustificatIOn) There are six surplus spaces. However, tlus would make the equipment and canopy vIsible from a street. The eXIstmg location IS m the rear yard and will be partly vIsible from the future mdustnal development to the south. ThIs eqUIpment IS typIcal of mdustnal developments maktng the eXIstmg location preferable. There is existmg landscapmg, comprised ofa hedge and trees along the rear of the property (see ExhibIt B). J Page 3 Packagmg Concepts FIle No ZNCV 98-005 RECOMMENDA TION Based on the above analysis, staff recommends that this request by Packagmg Concepts for a vanance from the City of Bovnton Beach Land Development RegulatiOns, Chapter 2 - Zonmg, Section 7 - Planned Umt Development, H.16, to reduce the reqmred rear setback from 30 feet to 13 feet to allow mstallatiOn of an alummum pan roof over the eXistmg ground-mounted mechamcal eqmpment be granted (see Exhibit "D") S. \projects \Packaging Concepts\ZN CV\staffreport 3 EXHIBIT "A" Lf -...... - - - - PAC'J{AGING CONCF-PTS t:::j111t I Il111J '-.: . ... , ~;- ~_.s- - '--4 NOT IN CITY I j r I , I - ~~ )) \ .)' \ ~ /J I \, .;J \; I "- I \ - PIC r r. / i / I ----- i<Y~~-C~M~E:~' '~f ~ I UANTUM PARK) I , I I \(j ~ > I~ "I ,--; /- "MCTOROLAt.,. \~J SITE ' I~ / )I\~. :\1 ~ '- _ 1// ~___ /.. ~~-"'-:: ~" ~:-\ ~ \',\/ ! ~ _1~_! v ['t:-~ _ I~ I ri , !
