Packagmg Concepts, located m the Quantum Park PID IS a 1 48 acre sIte at 4925 Park RIdge Road (see ExhibIt A - LocatIOn map) BACKGROUND Packagmg Concepts was ongmally approved m 1995 As a part of that development a concrete slab was placed m the rear of the bUIldmg for the purpose of placmg eqUIpment used as a part of the on-gomg reqUIrements of the busmess (see ExhibIt B - sIte plan and landscape plan) The eqUIpment m questIon IS open to the elements and the owner would like It to be covered. That specIal condItIons and CIrcumstances eXIst whIch are peculIar to the land, structure, or bUIldmg mvolved and WhICh are not applIcable to other lands, structures or bUIldmgs m the same zomng dIstnct b That the specIal condItIOns and CIrcumstances do not result from the actIOns of the applIcant. c. That grantmg the varIance requested wIll not confer on the applIcant any specIal pnvIlege that IS demed by thIS ordmance to other lands, bUIldmgs, or structures m the same zonmg dIstnct d. That lIteral mterpretatIOn of the provIsIons of thIS ordmance would depnve the applIcant of nghts commonly enJoyed by other propertIes m the same zonmg dIstnct under the terms of the ordmance and would work unnecessary and undue hardshIp on the applIcant. e. ANAL YSIS As part of evaluatmg a vanance request, staff looks for alternatIves that would mmImIze or negate the need for a varIance (as reqUIred by the cntena for grantmg a vanance) The requested varIance IS the mImmum that can be requested If the eqUIpment cannot be relocated. Even If operatIOnally (such as a floor plan layout change), the eqUIpment could be relocated, there IS no room to move It and stIll meet setbacks, unless parkmg IS elImmated (see ExhibIt C - applIcant's JustIficatIOn) There are SIX surplus spaces. However, thIS would make the eqUIpment and canopy vIsible from a street. The eXIstmg locatIOn IS m the rear yard and WIll be partly vIsible from the future mdustnal development to the south. That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands, structures or buildings in the same zoning district; The day-to-day operations of the business require the use of air compressing equipment. The operational requirements mandate the placement of this equipment at the rear of the building The slab is existing and would be covered with the proposed aluminum roof to protect the components from the elements The warehouse is constructed on the exact 30 feet rear setback requirement for a P I D I preventing this structure or any other from being constructed in the rear of this building B. That the special conditions and circumstances do not result from the actions of the applicant; The existing conditions or circumstances are not a result of the applicant but severely restrict the operations and expansion of the manufacturing business The business is in the process of setting up operations and plans to employ up to 60 people of various skill levels C That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same zoning district; The granting of the variance requested will not confer any special privilege on the applicant that is not obtainable through the variance process The proposed aluminum roof to cover the mechanical equipment will not be noticed in this area of industrial type buildings and uses. o That literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of the ordinance and would work unnecessary and undue hardship on the applicant; The literal interpretation of the provisions of this chapter would deprive the applicant of the right to utilize the property to its fullest potential This in IV ~~ ... r' c' turn would limit further investment in the property and the number of people employed E.
