Variance
Request:
VarIance from the CIty of Boynton Beach Land Development RegulatIons,
Chapter 2 -Zomng, SectIOn 7 - Planned IndustrIal Development, H.16, to reduce
the reqUIred rear setback from 30 feet to 13 feet to allow mstallatIOn of an
alummum pan roof over eXIstmg ground-mounted eqUIpment.
NATURE OF REQUEST
Thomas J WillI, agent for Packagmg Concepts, IS requestmg to reduce the reqUIred rear setback
from 30 feet to 13 feet for the purpose of allowmg a 17 foot hIgh canopy to be bUIlt over the
eXIstmg ground-mounted eqUIpment. Packagmg Concepts, located m the Quantum Park PID IS a
1 48 acre sIte at 4925 Park RIdge Road (see ExhibIt A - LocatIOn map)
BACKGROUND
Packagmg Concepts was ongmally approved m 1995 As a part of that development a concrete
slab was placed m the rear of the bUIldmg for the purpose of placmg eqUIpment used as a part of
the on-gomg reqUIrements of the busmess (see ExhibIt B - sIte plan and landscape plan) The
eqUIpment m questIon IS open to the elements and the owner would like It to be covered.
The followmg IS a descnptIOn of the zomng dIstncts and land uses of the propertIes that surround
Packagmg Concepts
North -
Park RIdge Boulevard and farther north IS the PublIx
DIstributIOn Center and undeveloped land m Quantum,

South -

The code states that zomng code vanances cannot be approved unless the board finds the
followmg
a. That specIal condItIons and CIrcumstances eXIst whIch are peculIar to the land, structure,
or bUIldmg mvolved and WhICh are not applIcable to other lands, structures or bUIldmgs
m the same zomng dIstnct
b That the specIal condItIOns and CIrcumstances do not result from the actIOns of the
applIcant.
c. That grantmg the varIance requested wIll not confer on the applIcant any specIal pnvIlege
that IS demed by thIS ordmance to other lands, bUIldmgs, or structures m the same zonmg
dIstnct
d. That lIteral mterpretatIOn of the provIsIons of thIS ordmance would depnve the applIcant
of nghts commonly enJoyed by other propertIes m the same zonmg dIstnct under the
terms of the ordmance and would work unnecessary and undue hardshIp on the applIcant.
e. That the varIance granted IS the mInImum varIance that WIll make possible the reasonable
use of the land, bUIldmg, or structure.
f That the grant of the varIance wIll be m harmony wIth the general mtent and purpose of
thIS chapter [ordmance] and that such varIance WIll not be mJUrIOUS to the area mvolved
or otherwIse detnmental to the publIc welfare.
ANAL YSIS
As part of evaluatmg a vanance request, staff looks for alternatIves that would mmImIze or
negate the need for a varIance (as reqUIred by the cntena for grantmg a vanance) The requested
varIance IS the mImmum that can be requested If the eqUIpment cannot be relocated. Even If
operatIOnally (such as a floor plan layout change), the eqUIpment could be relocated, there IS no
room to move It and stIll meet setbacks, unless parkmg IS elImmated (see ExhibIt C - applIcant's
JustIficatIOn) There are SIX surplus spaces. However, thIS would make the eqUIpment and
canopy vIsible from a street. The eXIstmg locatIOn IS m the rear yard and WIll be partly vIsible
from the future mdustnal development to the south. ThIS eqUIpment IS tYPIcal of mdustnal
developments makmg the eXIstmg locatIOn preferable There IS eXIstmg landscapmg, compnsed
of a hedge and trees along the rear ofthe property (see ExhibIt B)

RECOMMENDATION
Based on the above analysIs, staff recommends that thIS request by Packagmg Concepts for a
vanance from the CIty of Boynton Beach Land Development RegulatIOns, Chapter 2 - Zomng,
SectIOn 7 - Planned Umt Development, H.16, to reduce the reqUIred rear setback from 30 feet to
13 feet to allow mstallatIOn of an alummum pan roof over the eXIstmg ground-mounted
mechanIcal eqUIpment be granted (see ExhibIt "D")
