The proposed building is situated on a 1 13-acre parcel currently zoned PID The proposed development will consist of a 3,701 square foot convenience store with gasoline sales (Mobil Station), and car wash. The use includes a 4,140 square foot canopy over the pumps between the building and Gateway Boulevard. Conditional use approval for a convenience store with gasoline sales and car wash facility within a PID Property size 49 488 square feet (1 13 acre) Land use Industrial Zoning Planned Industrial Development District (PID) Location. A portion of Lot 65-B at the southwest corner of Gateway Boulevard and High Ridge Road intersection. Building area 3,701 square feet (See Exhibit "B" - Proposed Site Plan) Surrounding land uses/zoning North - Gateway Boulevard and farther north is vacant Lot 85, zoned PID East - High Ridge Road and farther east is vacant Lot 82, zoned PID South - Vacant Lot 67-B, zoned PID West - Vacant Lot 65-A, zoned PID I Mobil ~tation at Quantum Park- CO~V 99-002 Memorandum No PZ 99-108 Page 2 STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS Section 11 2 D of the Land Development RegulatIOns contains the following standards to which conditional uses are required to conform. Following each of these standards is the Planning and Zoning Division's evaluation of the application as it pertains to standards The Planning and Development Board and City CommissIOn shall consider only such conditional uses as are authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose of this section. In evaluating an application for conditional use, the Board and Commission shall consider the effect of the proposed use on the general health, safety and welfare of the community and make written findings certifying that satisfactory provisions have been made concerning the following standards, where applicable 1 Ingress and egress to the subject property and proposed structures thereon, with particular reference to automobile and pedestrian safety and convenience, traffic flow and control, and access III case of fire or catastrophe The property is located at the southwest corner of the intersection of Gateway Boulevard and High Ridge Road. The location and configuration of the lot provide the opportunity for access on three sides of the property The site plan has been designed to accommodate three driveways each providing ingress and egress, with one access on Gateway Boulevard, one on High Ridge Road, and one provides cross-access to the adjoining property As proposed in the plan, both access and site circulation afford sufficient automobile and pedestrian safety and convenience Access and circulation accommodate traffic for both service delivery for the gas station and fire trucks 2 Off-street parking and loading areas where required, with particular attention to the items in subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and nearby properties, and the city as a whole The proposed Mobil Station will be located within the Quantum Corporate Park There is no impact on any residential use The site has been designed to meet all peiformance standards of the City code with respect to glare, noise, and odor effects There will be no adverse condition associated with the proposed development of this site 3 Refuse and service areas, with particular reference to the Items in subsection 1 and 2 above The proposed development consists of a facility offering the retail sale of gasoline and a convenience store The proposed dumpster is located at the southwest corner of the site where the refuse may be collected with minimal backing-up of vehicles and minimal traversing of the site 4 Utilities, with reference to locations, availability and compatibility The site will be serviced for water and sewer by the City of Boynton Beach Water Utilities Utilities systems will be designed to meet the criteria and standards for City of Boynton Beach and the Quantum Park utility master plan. !:V Mobil "$tation at Quantum Park- COL,v 99-002 Memorandum No PZ 99-108 Page 3 5 Screening, buffering and landscaping with reference to type, dimensions, and character Native shade trees and native shrubs, as well as accent trees and palms, will be utilized around much of the site A native Ure-creation" area is planned east of the building and will consist of under story mid story and canopy native plant material Perimeter shade trees will be 12 feet tall at installation. 6 Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and compatibility and harmony with adjacent and nearby properties Site signage, in contrast to the sign program, will be internally illuminated as noted on the detail plans (see conditions of approval) Exterior lighting will meet national and local standards to provide safe and convenient visibility No off site light will effect residential areas since this site is located in the core of the Quantum Industrial Park. 7 Required setbacks and other open spaces The site design meets all the required setbacks Nearly 21 % of this site area is dedicated to landscape buffers (a total of 10305 square feet) Additionally 12 2% of the site is reserved in other open space 8 General compatibility with adjacent property and other property in the zoning district. The proposed development will be entirely consistent and compatible with development of adjacent properties within Quantum Park. An application for use approval, presented as an amendment to the Quantum Park master plan, is submitted simultaneously with this application for conditional use approval. The proposed facility consists of covered pump islands, a car wash and a 3,054 square foot convenience store The development is entirely consistent with the general development of the area with respect to both the proposed use and its appearance 9 Height of building and structures, with reference to compatibility and harmony to adjacent and nearby properties, and the city as a whole The proposed building will not exceed one story There are no adverse impacts on the PID or the general area caused by the building height 10 Economic effects on adjacent and nearby properties, and the city as a whole Both residents of the general area and employees of businesses within the PID will benefit from the convenient availability of a gasoline and convenience store at this location. Gateway Boulevard is a major arterial road that serves rapidly growing West Boynton. There are no gas stations located along this segment of Gateway Boulevard which extends between 1-95 and Hagan Ranch Road. 11 Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19, Article II of the City of Boynton Beach Code of Ordinances (Part III Chapter 4 Site Plan Review) The proposed site plan will fully comply with the standards and requirements which apply to site plans as set forth in the Land Development Regulations once all conditions are met :3 Mobil-Station at Quantum Park- COu~ 99-002 Memorandum No PZ 99-108 Page 4 12 Compliance with, and abatement of nuisances and hazards in accordance with the performance standards within Section 4 of the zoning regulations, also, conformance to the City of Boynton Beach Noise Control Ordmance The site development as proposed will meet all of the standards of Section 4.N of Chapter 2, as well as the City Noise Control Ordinance RECOMMENDATION Based, in part on the justification for this facility at this location, use compatibility, compliance with development regulatIOns, and consistency with the Comprehensive Plan, staff recommends that this project be approved This recommendation for approval is conditioned upon satisfying all conditions of approval as contained in Exhibit "C" Furthermore, pursuant to Chapter 2 - Zoning, Section 11 2 Conditional Uses, a time limit is to be set within which the proposed project is to be developed Staff recommends that a period of one (1) year be allowed to develop this project. As long as 25 % or more of the total cost of the improvements are completed within one (1) year, this condition is met.
