Please accept tills letter as my concurrence for the followmg field adjustments for landscape
installatIon on the above referenced project.
I HurrIcane cuts are acceptable for all Sabal Palms.
2. The five (5) addItional Saba! Palms added to the northern buffer area are adequate nntIgatIon
for the below heIght specificatIon of some Sabals.
3 The Washmgtonia Palms are an acceptable substItute for the PaurotIS Palms willch would not
fit mto the foundatIon plantmg area.
4 The PaurotIS Palms that replaced the Washmgtomas on Quantum Lakes Dnve will be
removed and the Washmgtomas will be planted per the plans.
Kevitp.. Item #4 IS the remainmg item and may take more than a week. I respectfully request tills Item
be placed on your overall punch hst and not for Buildmg #2, so that It can be finaled out.

Dear Mr. Hawkins:
Please be advised that I am the general counsel to the Quantum Communil)' Development District
(QCDD) and sllbmitth,s lelter on its behalf. Numerous requests and demands have been made upon Premier
Gateway Center at Quantum, LLP (Premier) for more than a year for them to construct a retaining wall to
protect the North Presen'e from erosIon on the above referenced lots. This requirenlent was based upon the
findings and direction of Donald Richardson, P.H.D. of Ecologieal Consultants, In::. This is a condition for
Premier to complete their project. Despite the numerous requests and demands, Prem ier has not even begun
construction of the retaining wall. Accordingly, the QCDD requests the City of BO}TIton Beach !O de,y
issuance of a Certificate of Completion to Premier until they have completed the n:quired retaining waI:.

As per your conversatIOns WIth Hanna Matras, we are trymg to determme the amount of
outstandmg obhgatIOns to Palm Beach County stemmmg from CondItIOns 26 and 27 of the
Development Order for Quantum Park DRI, dated December 4th, 1984, and the degree of
responsibIhty of mdIvIdual parcel purchasers for all or a portIon of thIS amount. The mqUIry
from Brady and Coker, a law firm representmg a buyer who has a contract to purchase a 23-acre
portIOn of Quantum Park, prompts us to confirm one or all of the followmg'
1 That all of the Improvements reqUIred under CondItIOns 26 and 27 have been completed
by others and the Development Order does not reqUIre any addItIonal payments or
Improvements by the developer under CondItIons 26 and 27
2 That even if the developer of Quantum Park may at some pomt be responsible for all or a
portIOn of the constructIOn or payment proVISIOns of CondItIons 26 and 27, the purchaser
and developer of thIS 23-acre parcel Will not be reqUIred to make any payments as a
condItIon of bUIldmg permIt, certIficate of occupancy or for any other reason.
3 That the proVISIOns of CondItions 26 and 27 have been fulfilled by the developer
We also understand that the ImtIal payment provlSlon as speCIfied m CondItIons 26 and 27 may
need clanficatIOn as to the exact amount of obhgatIOn under dIfferent Improvement scenanos.
At thIS pomt we presume that at least one payment, m the amount of $200,000, has been made
and could possibly be counted towards fulfillment ofthe Said condItIons. It IS the pOSItIon of the

complIance WIth CondItIons 26 and 27 of the Development Order dated December 4th, 1984 As
of today, all roadway Improvements lIsted under these condItIons have been completed. Our
imtIal conversatIOns WIth staff of the Palm Beach County Department of EngIneenng and PublIc
Works IndIcate that at least one payment, In the amount of $200,000, has been made and could

The Quantum Park DR! ongInal approval placed the lImIt for Industnal uses at 2,784,354 square
feet. The last (5/25/99) Inventory update lIsted commItted mdustnal uses for a total of
1,026,741 square feet. With regard to tnp generatIOn, the same report lIsts actual ADT(Average
Dally Traffic) at 20,123 tnps, the number of vested tnps IS 63,752. There clearly remaInS a
substantIal unused capacIty for future Industnal developments.

Dear Mr Sugarman.
This is a follow-up to our recent telephone conversation. As you know, r r~rC$ent Premier
Commercial Realty, Inc., who has a contract to purchase a 23-acre portion of Quantum Park at
Boynton Beach. We have been concerned about the unpact of Condmons 26 and 27 of the DRI
Development Order on Premier's abibty to develop its 23-aere parcel. Conditions 26 and 27
generally proVIde that when more than 15,000 external vehicle trips have been generated, the
developer must construct certain road improvements or make certaIn payments J.D lieu of road
construction in the amolUlt of $900,000.00 With respect to Conditlon 26 and pos~bly another
$900,000.00 payment under Condition 27 Your Planning Department has confmned that all of
the road improvements referred to in the Development Order in these sections have been
completed, but your staff has been unable to confmn any payments made by the developer and
what the continumg liability of the developer may be.
Premier is concerned that if It IS determined that the developer 1$ reqillred to make either or both
of these payments upon the generation of 15,000 external trips, the failure to make these
payments could result in the WIthholding of development approvals for Premier's proposed
development. In the alternative, in order to get development approvals, Premier is concerned that
it will be required to make the entire payment if any such payment is due. f.. c60)

You and your Plarmmg staff have confirmed that xf there are any outstandmg fees to be paid
under the Development Order, those fees would be ClS$cssed on an equitable basis to all property
owners and that PremIer would not be forced to bear the entire burden or a disproportIonate

Regarding the attached master plan and correspondence from MFT Development, Inc dated July 12,
1999 which indicate that the use options for lots 32 through 38 are lImited to "IndustrIal", I have reviewed
relevant documents and fmd contradictmg mformatIon. Accordmg to Ordinance No 96-65, adopted on
June 3, 1997, the subject lots are designated "Office/Industrial" The subsequent modificatIOn to the
DR!, which Just preceded the most current modification processed as Amendment #9, was processed by
Ordmance 97-20 and dId not modify the subjects lots. As Amendment #9 dId not affect lots 32 through
38, the use options should currently remain as "Office" and "Industrial"
I am certam that staff overlooked thIS error on Amendment #9 as our attentIOn was focused on those
specific lots affected by the applIcatIOn rather than those many other lots and use designatIOns that should
have remamed unaltered by this recent amendment.
Unless you possess documents that accurately contradict the findmgs stated herem, please assist me With
correctmg thiS error by providing me With a revised master plan which I will use to update the files held
by the City and the Treasure Coast RegIOnal Planmng Council.

Dear Ms. Delegal.
As requested, I am providing you with a statement of our position as it relates to the above-referenced
lots. Although I am sure you would have preferred a summary of this mformation, I was able to prepare
thiS letter more qUickly usmg this text that had been prevIOusly prepared for a similar purpose. However,
please note that I have provided you with the SIgnificant facts in bold text.
Amendment #7
Ordinance No 96-65, representmg the seventh amendment to the DR!, adds both the "Industrial" and
"Research and Development" (R&D) use options to lots #32 through #38. At the time of the amendment,
those lots already mcluded "Office" use.
At the time when Amendment #8 was filed, the use options for lots #32 through #38 included
"Office"
Amendment #8
The staff report (Memo No 97-213) for Amendment #8 lIsted all requested lot use modifications
including the deletion of the "Office" use from lots #32 through #38. The same report contained a staff
recommendation that the "Office" use should be retamed on lots #32 through #38. The minutes of both
the May 13, 1997 Planning and Development Board Meeting, and May 20, 1997 City Commission
meeting, and the mitial draft of Ordmance No 97-20 all confirm that the request mcluded the deletIon of
the "Office" use optIon on lots #32 through #38
Amendment #8 originally included the request to omit "Office" from the list of use options for lots
# 32 through #38, and the staff opposed this modification.
The turnmg pomt in this process occurred between first reading and second reading of Ordinance No 97-
20, when a decision was made by the applicant to accept certain staff recommendations including
retaming the "Office" use option on the subject lots. ThIS deCISIon IS supported by a document prepared
by the applicant consenting to changes to the application, handwritten revisions to the original draft
Ordinance No 97-20, the final Ordmance No 97-20, and correspondence from the applicant accepting
the reviSIOns made to, and the final verSIOn of Ordinance No 97-20

Ordinance No. 97-20 was amended between first and final readings to revise, in part, the
amendment to omit the revision to lots # 32 through #38, therefore leaving them with the "Office"
and "Industrial" use options. "Industrial" use is now a broader designation and includes
"Research and Development" as indicated in the NOpe, filed on March 17' 1997
Amendment #9
Neither the NOPC, staff report, nor Ordinance No. 99-005 proposed, described or affected lots #32
through #38. The master plan submitted WIth the application for Amendment #9 was m error by showmg
only the "Industnal" use optIon on lots #32 through #38 Your chent error m this regard cannot take the
place of the formal amendment process.
The facts stated herein provide clear evidence that the "Office" use optIOn was not omItted from the
subject lots by Amendment #8 to the Quantum Park DR!, despIte what may be represented by data tables
which may not be consIstently maintamed. The master plan, without a proper NOPC application, legal
notice, and ordinance, was changed to show lots #32 through #38 without the "Office" use option.
Therefore, WIthout the legal steps taken to officially amend the master plan, the use optIons currently
available on lots #32 through #38 remain "Office" and "Industrial" The city IS therefore obligated to
revise the current master plan to reflect its offiCIal status, and represent It accordingly to those who
inqUIre.

Our Engineering Comment #14 requires an approval from the Department Director for our south
driveway along Quantum Blvd to exceed 32' In width at the property line
Although the 32' width is met at the return radius of the entrance, It does not meet the 32' at the
property line Due to the unique nature of the curb cut location on a curved section of the approach
roadway, coupled with the proposed function of this driveway as the main entrance for large seml-
tractor trailer traffic, the proposed turning radius is the minimum that can accommodate the trucks
wheelbase It is this turning radius and the curvature of the roadway that makes it impossible to
meet the 32' maxImum at the property line Only at the radius return can thiS 32' standard be met.

In response to your request for confirmation that the above-referenced project will not initiate the
need for zoning code variances relative to the number of driveways and orientation of
loading/unloading areas I have prepared this letter
As recently discussed with you the number of proposed driveways do not exceed the maximum
number allowed by Chapter 2. Zoning section 7 (H) (3) and that the loading/unloading areas that
are in view from Quantum Boulevard do not conflict with Chapter 2 Zoning, section 7 (H) (11)
As previously discussed, this position is based on the interpretation of code which allows a
maximum of 2 driveways within a PID per developable parcel despite land assemblage, and the
loading areas within view of Quantum Boulevard as it is a private rather than public street.
However as also discussed variance applications will be required to request necessary relief
from the zoning code to allow a reduction in the peripheral greenbelt from 40 feet to 25 feet
(Section 7 (H) (17)) and to avoid the requirement for a buffer wall along the project's east
boundary (Section 4 (L)
I would recommend that the processing of the site plan be delayed to allow the advertising and
concurrent processing of the variance requests. You will recall that, based on characteristics of
the previous approval on this site where said variances were not processed, I am still attempting
to confirm that the buffer and wall variances are required for the current proposal. If I am able to
confirm that these variances are not required prior to forwarding to the Board, they will be
withdrawn. Please contact this office for further assistance.

It is proposed to develop 336,050 SF of Industrial use on lots 32 - 38 of Quantum Park In
the City of Boynton Beach The site is located in the northeast quadrant of Quantum
Boulevard and Gateway Boulevard Access to the site is via four (4) driveway connections to
Quantum Boulevard and two (2) connections to Gateway Boulevard consistent with the
Master Plan for Quantum Park.
The proposed development IS projected to generate 2,342 daily trips, 309 AM peak hour
trips and 329 PM peak hour trips as shown on Attachment 1 Driveway volumes are
provided on Attachment 2
The Quantum Park DRI is an approved project, and is considered a Previous Approval under
Article 15, Traffic Performance Standards, of the Palm Beach County Unified land
Development Code (ULDC) The proposed land use and intensity are within the limits of the
original approval of the Quantum Park DRI, as shown on Attachment 3, therefore, the
proposed project is not subject to the Traffic Performance Standards.

Ladies and gentlemen
Please accept this letter and attachments as a statement of the existing engineering
and environmental conditions at the subject property in support of a request for site
plan approval by Premier Asset Management, Inc. (contract purchaser)
Based upon recent site inspections, and the review of relevant surveys, reports and
historic aerial photographs I am able to confirm the following regarding the engineering
and environmental conditions at the subject property.
a. There are no jurisdictional wetlands or open water areas on the property;
b No development is proposed to take place within any areas previously defined as
an environmental preserve pursuant to the DRI Development Order or other
requirements of the City or other regulatory agency - NOTE. There is an existing
environmental preserve located adjacent to both the northern boundary and a
portion of the eastern boundary of the property but the preserve area is separated
from the proposed development parcel by an existing chain link fence
c. There is no DRI Development Order requirement to provide for any on site
environmental preserve areas on this property;
d Any proposed removal of native vegetation from the property, in order to facilitate
development activities will comply with all City Tree Permit requirements applicable
to the Quantum Park DRI project and this specific development parcel,
e An investigationlreport by Blythe Environmental (Blythe), dated September 29, 1999
(copy enclosed), indicates that there are a number of active/in-active Gopher
Tortoise burrows on the property PAMI has engaged Blythe to secure approval
from the Florida Game & Fresh Water Fish Commission to provide for the removal
and relocation of all Gopher Tortoises and commensals to an acceptable offsite
location prior to the initiation of project development activities, ·

the current separation requIrement In code, I believe that the approval of the Quantum Park
