THE MAYOR AND CITY CLERK TO EXECUTE AN RESTORATION
AGREEMENT BElWEEN THE CITY OF BOYNTON BEACH AND
PALM BEACH COUNTY, FLORIDA, FOR THE PROJECT KNOWN
AS LAWRENCE ROAD (PROJECf NO 95511); AND PROVIDING
ANEFFECITVE DATE.
WHEREAS, Palm Beach County will widen/pave Lawrence Road, from Gateway
Boulevard to Hypoluxo Road, and is seeking permission to slope and grade where necessary
and re-establish driveWays;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BI;ACH, FLORIDA, THAT:
Section 1. The City C()mmission, upon recommendation of staff, hereby
authorizes and directs the Mayor and City Clerk to execute a Restoration Agreement between
the Oty of Boynton Beach .and Palm Beach County, for Palm Beach County Project No. 95511
for the Widening/paving of Lawrence Road.
Section 2.
That this Resolution shall become effective immediately upon passage.

citrus Glen Drive was considered by the Fire Department to
be a major access to the development pr~per and a secondary
access to Lawrence Road southbound. Since there is a public
school under our protection, to the south of this development,
the secondary access through this development is extremely
important. The Fire Department would prefer this street be left
a public way.
2- Security Gates and Guardhouse on Citrus Glen Drive as a
pri vate str'eet.
Should Citrus Glen Drive be blocked to public use the
following standard for security gates shall apply:
The Fire Department continues to have the opinlpn that
security gates are det~imental to Fire and ~escUe operations,
The minimum performance for security gates I. as follows:

1- Gates shall be openable by telephone, with a call from
Central Dispatch C~nter.
2- When the gate is opened by the call from Central
Dispatch, it shall r'em,~'in op..n until the emer'gency is over-; at

1. Site plan approval is contingent upon approval of the
abandonment requests for Citrus Glen Drive and Citrus
Avenue. Appendix C, Article X, Section lSB.
2. The guardhouse and security gates requestetl are located
solely within the Executive Estates plat, which is
controlled by a separate association. Since there is not a
master association planned for the entire planned unit
development, a maintenance association agreement shall be
filed and subject to the approval of the city attorney, that
states how said common facilities will be operated and
maintained. Appendix B, Section lID.

PARTICULARLY DESCRIBED HEREIN; AMENDING
THE REVISED ZONING MAP ACCORDINGLY;

WHEREAS, Roger Saberson, agent for Boynton Nurseries
(Citrus Park), has heretofore filed a Petition with the City
of Boynton Beach, Florida, pursuant to Section 9 of Appendix A
- Zoning of the Code of Ordinances, Ci ty of Boynton Beach,
Florida, for the purpose of rezoning a certain parcel of land
consisting of approximately 28 82 acres (+) located within the
municipal limits of said City, said property being more
particularly described hereinafter, from PUD with a Land Use
Intensity of 4 (PUn LUI 4) to PUD with a Land Use Intensity of
4 (PUn LUI 4), to allow for substantial changes to the
