This letter is in response to your correspondence, dated February 18, 2003, requesting that the
Building Division place a hold on all permit activity for the permits you have obtained to perform work
on the Two George's project located at 728 Casa Loma Blvd
Please be aware that Section 104 6 1 of the City of Boynton Beach Amendments to the 1997 Edition
of the Standard Building Code notes, "Every permit issued shall become invalid unless the work
authorized by such permit is commenced within six months after its issuance, or if the work
authorized by such permit is suspended or abandoned for a period of six months after the time the
work is commenced II
If an active permit becomes invalid, then new plans, applications and fees will be required
Compliance with the 2001 Edition of the Florida Building Code and the City of Boynton Beach
Amendments to the Florida Building Code and all other pertinent laws, rules, regulations,
ordinances, etc shall be mandatory I have listed the relevant permit numbers and also the status of
each permit on the attached sheet.

Staff has reviewed the proposed improvements to the Two George s Restaurant, and the corresponding request for
waiver from the site plan review process and responds affirmatively The proposed changes as indicated in your
letters dated September 26 2000 and September 27 2000 are minor and tl,erefore not subject to the site plan review
process.
However please understand that this review and determination is only for the improvements listed in your letters and
not reflected by any other improvements represented on the drawings included with your request. Regarding the
request dated September 26 2000 staff understands that the proposed changes include
1) Expanding the existing bar and redesigning the seating area located within the 'Chickee Dining Room" which
would result in a reduction in seating of 29 seats and
2) Adding 555 square feet of deck along the existing deck on the east side of the restaurant on which 28 seats
would be added The net change in total seating would be a decrease in one (1) seat.
Those proposed improvements listed in your letter dated September 27 2000 i"c1ude.
1) Raising the floor elevation to 4.5' N G V D to match-up with the new proposed plaza elevation to the north.
2) Providing a new galvanized tin roof to match the Marina Development.
3) Replacing the wood structure with a new wood structure and concrete foundation The new structure will be
open on three sides in the character of the present structure
The subject improvements may be submitted to the Building Division for t~e necessary permits along with this letter
to confirm Minor Modification approval Please be informed that the two requests have been consolidated and

Please be notified of my request for a Waiver from Site Plan Review for the Two Georges Restaurant as is required for
the approval of the Chickee DIning Room Reconstruction (pennit 99-4849). Please also find my review of Chapter 4,
Section 2 of the Boynton Beach Development Code with regard to the Chickee Dining Room Reconstruction, the
subject ofPennit 99-4849
The proposed reconstructIon does not change the configuration of the existmg dIning room foot print or site
arrangement and does not reduce emergency vehicle access.
There is not a change of use that is going to increase the off-street parking spaces.
The applicant proposes to comply with all the development regulations of the City of Boynton Beach and the Amended
Mediation Agreement between the City of Boynton Beach, Ocean Breeze Festival Park, Inc. and the Two Georges
Restaurant.
The applicant proposes to reconstruct the Chickee Dining Room to match the spnt of the existing Chickee structure
with the following unprovemcnts:
1) The apphcant proposes to raise the floor elevation to 4.5 N G.V.D. to match-up WIth the new proposed plaza
elevation to the north.
2) The apphcant proposes to prOVIde a new galvanized tin roof to match the Marina Development.
3) The applicant proposes to replace the existing wood structure WIth a new wood structure and concrete

Dear Mr Rumph,
Please be notified of my request for a Minor Modification to the existing Two Georges Site Plan as is
required for the approval of the East Deck Addition (permit 00-3382). Please also find my review of
Chapter 4, Section 9 of the Boynton Beach Development Code below with regard to the East Deck
Addition, the subject of Permit 00-3382
Please be advised that the applicant is seeking two separate permits; Permit 99-4849 and Permit 00-3382.
The Reconstruction of the Chickee Dining Room (permit 99-4849) is a request to reconstruct the existing
Chickee Dining Room that includes the expansion of the existing bar and a new dining room seating layout
to accommodate the new bar. The net change in the number of seats, in the Chickee Dining Room due to
the expansion of the existing bar, is a reduction of (29) twenty-nine seats. The East Deck Addition (permit
00-3382), this application, proposes a 555 square foot addition to the restaurant s existing East Deck to
match-up with the new Marina Boardwalk to the north. The East Deck Addition (pennit 00-3382)
proposes an additional (28) twenty-eight seats or a net reduction between the two proposed permits of (1)
seat.
The existing Two Georges Restaurant area is 5870 square feet. The proposed East Deck Addition (Permit
00-3383) is 555 square feet increasing the restaurant floor area 945%. The applicant acknowledges that
the increase in area is greater than 5%. The applicant requests the department considers the elimination of
seats in the proposed Chickee Dining Room Reconstruction (permit 99-4849) due to the new bar
arrangement as offsetting the increase in floor area as proposed in the East Deck Addition (permit 00-
3383). The net seat count, as proposed in the East Deck Addition (Permit 00-3383) and the Chickee Dining
Room Reconstruction (pennit 99-4849), actually reduces the total restaurant seat count by (1) seat.
Please advise the applicant regarding the calculation of the parking requirement for the restaurant. Please
refer to the proposed site plan.
Please advise the applicant regarding zoning development standards and Land Development Regulations
relevant to this Minor Modification.

The applicant acknowledges that the Corps of Engineers and the Department of Environmental Protection
also have jurisdiction over this proposed work and a Standard General Application has been submitted to
the Department of Environmental Protection (File No 50-0132532-0(2) and the Corps of Engineers (No.
199801669 (lp-nn)).
The applicant feels the view from the Bridge and the Intracoastal Waterway will be improved by the
continuation of the Marina Boardwalk: along the existing eastern edge of the Two Georges East Deck. This
continuation of the boardwalk: along with the improvements proposed for the plaza east of the proposed
cul-de-sac and the improvements proposed for Casa Loma Overlook will help the Two Georges Restaurant
blend into the Marina Development. The applicant feels that the continuation of the boardwalk: along the
Intracoastal Waterway will help add continuity to the appearance of the new Marina Development and the
Two Georges Restaurant. The applicant feels the addition "ill be beneficial to the overall Marina
Development, the public and adjacent property owners.
The applicant proposes to match the existing boardwalk detail.
The applicant proposes that existing services will not be affected by the increase in the floor area of the
East Deck due to the increase in the size of the proposed bar in the Chickee Dining Room which will
eliminate more seats than the East Deck Addition proposes.
The alteration of the layout of the site is minor and in the spirit of the original layout and concept.
Based on the information above, the applicant would like to request your consideration that the proposed
East Deck Addition does not present a significant change in intensity and the Minor Modification of the site
plan will not have adverse effects on nearby property owners and will in fact improve the overall Marina
Development by conforming to the appearance of the new boardwalk:.
