STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
SectIon 11.2.D of the Land Development RegulatIOns contams the followmg standards to whIch condItIonal uses
are requIred to conform. Followmg each of these standards IS the Plannmg and Zomng DIVlSlon's evaluatIOn of the
applIcatIon as It pertams to standards.
The Plannmg and Development Board and CIty CommISSIOn shall conSIder only such condItIonal uses as are
authonzed under the terms of these zomng regulatIons and, m connectIon therewIth, may grant condItIonal uses
absolutely or condItIoned upon the condItIons mcludmg, but not lImIted to, the dedIcatIOn of property for streets,
alleys, recreatIon space and SIdewalks, as shall be determmed necessary for the protectIOn of the surroundmg area
and the cItIzens' general welfare, or deny condItIonal uses when not m harmony wIth the mtent and purpose of thIS
sectIOn. In evaluatmg an applIcatIOn for condItIonal use approval, the Board and CommISSIOn shall conSIder the
effect of the proposed use on the general health, safety and welfare of the commumty and make wntten findmgs
certlfymg that satIsfactory prOVlSlons have been made concernmg the followmg standards, where applIcable:
1 Ingress and egress to the subject property and proposed structures thereon, wIth partIcular reference to
automobile and pedestrIan safety and convemence, traffic flow and control, and access m case of fire or
catastrophe
The subject property has one point of ingress/egress off of the access road to the Wal-Mart site. This
driveway is located to the south of the site. It is a 35-foot wide opening providing one entrance and one exit
lane. A signed agreement between Steak 'n Shake and Sonny s Bar B-Q is recommended to open the
vehicular access way between the two sites. This recommendation is included in Exhibit 'C Conditions of
Approval. Administrative approval will be required for the driveway since it exceeds the 32-foot maximum
opening allowed by the code.
The proposed on-site traffic circulation system consists of one (1) two-way drive aisle 27-feet wide,
extending from the northern to the southern property line. Connecting to this drive aisle are two (2), two
drive aisles which provide continuous traffic circulation to the parking areas around the Sonny s
restaurant building

above, and the economIC, glare, nOIse, and odor effects the condItIonal use will have on adjacent and
nearby propertIes, and the CIty as a whole
The number of off-street parking spaces provided for the proposed use is 100 including four (4)
handicapped spaces A total of 82 spaces are required per code. With respect to a loading area, none has
been identified on the site plan, as required per code. However a I2-foot wide by 35-foot long loading
area must be provided as specified in Exhibit 'C Conditions of Approval. If proposed parking spaces are

to be used for the loading area, appropriate signage should specify the hours that this space is reserved for
loading purposes The loading area may be used for regular parking at all other times
The drive-through, which is proposed as an ancillary use to the Sonny s Bar B-Q restaurant, would have
negligible effects on nearby properties. Being located along the north and east side of the property it will
not be highly visible from Old Boynton Road and Winchester Park Boulevard. The 12-foot landscape buffer
with a continuous line of existing and new trees along the eastern property line will further mitigate any
possible impacts Negative effects such as glare and noise from other proposed uses, will be alleviated by
that landscape buffer
In terms of economic impact on the city as a whole, the proposed Sonny's Bar B-Q restaurant should have
a minimal impact but with the recent operational changes announced by Motorola, any investment, which
would help create employment opportunities, will have beneficial effects for the city The Sonny's Bar B-Q
restaurant will provide an additional choice for residents and visitors in search of a culinary diversity

There is one (1) dumpster proposed on the site plan. The dumpster is located in the parking area on the
west side of the Sonny s Bar B-Q restaurant. It will be screened and landscaped per code requirements

The project perimeter landscaping includes a 12-foot wide buffer along the eastern (front) property line, a
26-foot wide buffer along the western (rear) property line, a IO-foot wide buffer along the northern (side)
property line and an II-foot wide buffer along the southern (side) property line. Buffer plantings include
trees placed a minimum of 32- feet on center and a continuous hedge of varying species. The number of
trees for perimeter landscaping significantly exceeds code requirements However staff is recommending
that the landscaping which has been installed in conjunction with the Wal-Mart site plan be maintained, as
per Exhibit 'C" Conditions of Approval.
Extensive foundation landscaping is provided around all sides of the building The drive-through window
located on the western building elevation is buffered by a continuous hedge, a small grouping of palm trees
and a row of parking
6 SIgnS, and proposed extenor hghttng, WIth reference to glare, traffic safety, economIC effect, and
compatibihty and harmony WIth adjacent and nearby propertIes.
At the time of permitting, security lighting levels will be evaluated for excessive glare. It is recommended
that the light levels not exceed building code maximums.
Two wall signs and one freestanding monument sign have been submitted for review Sonny s Bar B-Q
restaurant will feature two (2) wall signs, one above the main entrance (south elevation) and the other sign
on the eastern elevation, facing Winchester Park Boulevard. The proposed wall signs and the freestanding
sign meet the allowable requirements including sign face area and height dimensions as set forth in the
Land Development Regulations, Chapter 21

7 RequIred setbacks and other open spaces.
The required setbacks for a C-3 zoning district are. 20 feet for the front yard, zero feet for the side yard
and 20 feet for the rear yard. The proposed project exceeds these requirements The peripheral greenbelt
dimensions as well as the vehicular use area landscaping meet the code. The total lot coverage is
approximately seven (7) percent, well below the 40 percent maximum set by the code.
8. General compatibihty wIth adjacent property and other property m the zomng dlstnct.
The Wal-Mart Super Center design standards generally consist of terra cotta and earth tones for the roofs,
pale earth tones and pastels for the primary building and various brighter accent colors on building signs
Individual buildings with corporate or trademarked colors are permitted as part of the accent colors on
buildings, but as long as the corporate colors do not represent extreme color contrast and are limited to the
entrance areas and sign age.
The exterior building colors of the proposed Sonny s Bar B-Q restaurant, including body trim and roof
colors are a composition of tan, oyster, morocco red, white, and Chicago rustic brick. In general, the
proposed project is compatible with surrounding developments such as the Wal-Mart Super Center and the
Boynton Commons shopping center
9 HeIght ofbuildmg and structures, WIth reference to compatibihty and harmony to adjacent and nearby
propertIes, and the CIty as a whole.
The proposed Sonny's Bar B-Q restaurant is designed as a one-story building The proposed height of the
building is approximately 25 feet 5 inches The maximum height allowed per code for commercial zoning
districts is 45 feet. The proposed height is compatible with nearby properties
10 EconomIc effects on adjacent and nearby propertIes, and the CIty as a whole
As stated in the Section 2 above, any negative effects such as glare and noise, will be alleviated by both a
I2-foot landscape buffer along Winchester Park Boulevard and by a 26-foot landscape buffer along the

ancillary use to the pnmary use of the Sonny's Bar B-Q restaurant. As per staff analysIs, the potentIal negatIve
Impacts of the proposed facihty wlthm the Wal-Mart Super Center sIte are well mItIgated.
Based on the dIscussIOns contamed herem, comphance wIth development regulations, and the consistency wIth the
ComprehensIve Plan, staff recommends that thIS request be recommended for approval condItIOned upon satIsfYmg
all condItIons of approval as contamed m ExhibIt "c" Furthermore, pursuant to Chapter 2 - Zomng, SectIon 11.2
CondItIonal Uses, a tIme hmIt IS to be set wlthm whIch the proposed project IS to be developed. Staff recommends
that a penod of one (1) year be allowed to ImtIate thIS project (thIS tIme hmlt apphes only to the dnve-through
portIon of the restaurant) As long as 25% or more of the total cost of the Improvements are completed wlthm one
(1) year, thIS condItIon IS met.

cut through the Sonny's project at that long narrow end of the parcel (north side) to link with the Wal-Mart parcel I

INTRODUCTION
A Sonny's Real PIt Bar-B-Q restaurant is proposed to be located on an outparcel of
the approved Wal-Mart Supercenter sIte west of Winchester Park Boulevard
between Boynton Beach Boulevard and Old Boynton Road m Boynton Beach,
Flonda. The proposed sIte plan consIsts of an approximately 6,000 square foot
restaurant. ThIS site was previously approved for a 236,762 square foot Wal-Mart
Supercenter This supercenter is currently under constructIOn and was mcluded as
proposed development m thIs analYSIS as requIred by the Palm Beach County
Traffic Performance Standards ordinance.
Klmley-Hom and AsSOCIates, Inc. was retamed to prepare a traffic Impact analYSIS
for the project. This document presents the methodology used and the fmdings of
these analyses.
The traffic impact analysis was conducted in accordance WIth the updated Traffic
Performance Standards of Palm Beach County The analysis used current data
available from Palm Beach County The buildout year for the proposed development
is 2001

Access to the development will be provided through two full access driveways on
Winchester Park Boulevard and one right-in, left-in, and right-out only driveway on
Old Boynton Road. The two dnveways on Winchester Park Boulevard are located
at existing median openmgs. These dnveways were approved as part of the Wal-
Mart Supercenter currently under construcb.on. All access to the Sonny's Real Pit
Bar-B-Q restaurant will be contained on site. No additional external site access is
proposed.

Traffic Generation
The daily traffic generatIon for the development was based on tnp generatIon rates
pubhshed by Palm Beach County Peak hour charactenstics were based on
mformation pubhshed m the Institute of TransportatIon Engmeers' Trip Generation
Report (6th Edition). Table 1 presents the proposed potentIal tnp generatIon for the
project site. Pass-by rates published by Palm Beach County were used in the
analysis. The restaurants were analyzed as general commercial retail because they
are a part of a larger shoppmg center and are not fast food restaurants.
Traffic Distribution
From a reVIew of the existIng and approved development in Palm Beach County and
considering the arterial network with its travel tIme charactenstics, the external
traffic distribution was calculated. These were swnmanzed by general direction and
are depicted below'

Traffic Assignment
The dIstributed external trIps for the project m 200 1 were assIgned to the roadways
withm the radms of mfluence, both m terms of daily external trIps and peak hour
volumes. The project assIgnment IS illustrated m Figure 2.
Based on the net Impact of the proJect, it was determined that the maximum radius
of development influence for Test 1 and Test 2 of the traffic performance standards
is three (3) miles.

BACKGROUND TRAFFIC
Background traffic IS comprised of two components.
. Traffic from the unbuilt portIons of approved major developments
· Histoncal growth
Projects found m the Palm Beach County spreadsheet "Approved Development
Traffic in West Boynton/Delray Area" and traffic from the proposed BJ's
Wholesale Club on Boynton Beach Boulevard were also included in the analysis.
A summary of traffic from these projects is included in the AppendIX. Traffic from
the proposed Lowes on W oolbnght Road was also reviewed. Histoncal growth was
found to be sufficient to account for traffic from this project. No other major
projects would contribute greater than ten percent (10%) of the level of ServIce
standard on any link significantly Impacted by the project dunng Its buildout time
frame.
Accordmg to the requrrernents of the Traffic Performance Standards of Palm Beach
County, existmg traffic volumes were grown by factors determined by a review of
growth data published by Palm Beach County
The total background traffic was determined for each lInk WIthm the radms of
development mfluence by applying the historical growth rate through the buildout
year and adding approved project traffic.

The existmg laneage for each lmk analyzed was IdentIfied. A reVIew of the Five-
Year Plans of Palm Beach County and the Flonda Department of TransportatIOn,
as well as those improvements committed by the developers of projects m the area

Test 1
A link performance standard evaluatIOn was undertaken for each link consIdering
ItS total traffic volume and the roadway laneage to be m place m 2001 Project
traffic and total traffic for 2001 are shown in Tables 2 and 3 for daily and average
peak hour condItions. As can be seen, all of the roadway links upon whIch the
project has significant impact meet the daily level of service standard through 2001
Table 3 shows that the same links meet the average peak hour hnk standard for
2001
Test 2
The Model Test 2 indicates a radms of mfluence of two miles from the site. No
roadway segments on the Test 2 failure list lie WIthin the project's two miles of
development influence. Smce the project generates more than 7,000 net new
external daily trips, Palm Beach County will need to run the Test 2 model to
determme compliance WIth the Test 2 standards.

Using these cntena, the dnveway on Old Boynton Road and the north dnveway on
Winchester Park Boulevard would be classIfied as major The south dnveway on
Winchester Park Boulevard would be classified as minor
Turn Lane Requirements
FIgure 3 presents the proposed project AM and PM peak hour total volumes
assIgned to the project's access dnveways. ConsIderation of these volumes with
respect to the Palm Beach County access deSIgn standards results in the
determmatIon that a nght-turn mgress lane will be requtred at the driveway on Old
Boynton Road and the north dnveway on Winchester Park Boulevard. Left-turn
mgress lanes will be required at the north driveway on Winchester Park Boulevard
and the driveway on Old Boynton Road. All requtred turn lanes either eXIst or will
be constructed with the Wal-Mart Supercenter Egress left-turns will be prohibIted
at the dnveway on Old Boynton Road.
