HTEX 00-001 Memorandum No PZ 00-218 ANAL YSIS ~and Development Regulations Chapter 2 Zoning Section 4 F 3 Height Limitations and Exceptions states that In considering an application for exception to the dlstnct height regulation the City Commission shall make findings indicating the proposed exception has been studied and considered in relation to minimum standards where applicable Exhibit "C lists those standards and how the applicant addressed them According to the application With the exception of the turret entry features which measure approximately 25 feet x 25 feet the remainder of the structure is proposed to have a roof height of 19 feet-6 inches (19 -6 ) which is well within the maximum of twenty-five (25) feet permitted by Code Actually only a very small portion of the roof peaks Will exceed twenty-five feet. The C-1 dlstnct does permit a maximum height of 30 feet for buildings that include underground parking In addition the City recentfy amended the Land Development Code for single-family districts which now permits a maximum height of 30 feet. Actually only the ndge, which IS a very small portion of the roof, will reach the 30 feet height, then the hIpped roof slopes back to 25 feet or less We belIeve the height exceptIOn is minimal and Will not have an adverse effect on the eXlstmg land use, surroundmg bUildings or properties. As a matter of fact, the five feet height exception requested IS so mInImal that It Will not be noticed. Furthermore WithIn the ImmedIate VICInIty there are buIldmgs that exceed the 30 feet height. Also 10 thIS dlstnct (C-l) bUIldIngs deSIgned With a parkmg structure wlthm are allowed to a maxImum height of 30 feet. B The height exceptIon is necessary to create architectural interest in the bUilding. ThIS IS also necessary to conform to the CIty'S objective of encouragIng archItectural relief to break up what would otherwIse be a plaIn stnp plaza. Therefore thiS project will compliment the architectural style of the area and will not be a deterrent to the improvement or development of adjacent properties. E. ThiS style of architecture IS well accepted In South Flonda and the surroundmg areas and It will make the project "fit In" which In turn should help increase property values and thus Increase the tax base of the City F The height exception will not adversely mfluence the hvmg condition of the neighborhood, except that It WIll provide a more InterestIng and distingUished buIldmg to look at. G The height exception does not constitute a special privilege to the client since the maximum height allowed in the district is 30 feet, in the City is 45 feet, and there are surroundIng structures In the Immediate area that are taller than our proposed buildIng. H. Recent code reVlSlons have relaxed the maximum allowed height requlfements In residential dlstncts by penmttIng bUildings up to 30 feet height. We believe that sufficient evidence has been presented to justify the need for a height exceptIOn and hope that you are In agreement and will support thiS "Height ExceptIon" request.
