Site Characteristics The subject property is comprised of two (2) vacant irregular shaped parcels totaling 15 697
acres The most northern portion, 'Parcel 1" is 11 191 acres and the southern portion,
"Parcel 2" is 4 506 acres, all under the same ownership
Proposal The developer proposes to construct 312 luxury rental apartments throughout thirteen (13)
separate buildings on 15 697 acres Each building will be three (3) stories high and contain
a mix of one, two and three-bedroom units A 3,374 square foot, one-story clubhouse
building, a swimming pool, a volleyball court, and a "tot lot" are the recreational amenities
provided (see Exhibit "B" - Proposed Site Plan) In addition a 64 square foot gatehouse is
proposed at the entrance I exit of the site An aluminum gate lined with decorative foam
banding and pre-cast decorative pineapples is proposed along the front entrance
Decorative aluminum fencing five (5) feet in height is adjacent to Federal Highway and Old
Dixie Highway A vinyl coated chain link perimeter fence six (6) feet in height will surround
the entire complex, excluding those areas adjacent to the above-mentioned rights-of-way
Concurrency.
a. Traffic - A traffic statement for this project was submitted and sent to the Palm Beach County
Traffic Division for their review and approval The Palm Beach County Traffic
Division has determined that the project location falls within the coastal residential

exception area, and therefore meets the Traffic Performance Standards of Palm
Beach County
b. Drainage - Conceptual drainage information was provided for the City's review The City's
concurrency ordinance requires drainage certification at time of site plan approval
The Engineering Division is recommending that the review of specific drainage
solutions be deferred until time of permit review, when more complete engineering
documents are required
Driveways There is one (1) main entrance proposed for the development located at the southeastern
portion of the site on Old Dixie Highway This entrance will allow for both right and left turns
from the site The driveway has a 38-foot entrance and a 15-foot exit separated by a 10-foot
median The applicant is requesting an administrative waiver to allow the entrance to be
more than 32 feet wide as required by code Entrance to the development will be restricted
by an unmanned, electronically operated, security gate
Parking Facility. A total of 570 parking spaces are required for the proposed residential use based upon the
applicable per bedroom ratio required by the land development regulations In addition to
the parking allocated for residential purposes, the project exceeds the minimum number of
parking spaces required for the recreational amenities. Regarding the clubhouse and
leasing office, eight (8) parking spaces are required and thirteen (13) parking spaces have
been provided The total number of parking spaces provided for the entire project is 588
spaces including an overflow of ten (10) extra spaces Overall, two percent (2%) or twelve
(12) spaces of the 588 are designated for handicap use All spaces, except handicap
spaces, will be dimensioned nine feet by eighteen feet (9' x 18') with a two (2) foot overhang
using wheelstops
landscaping The landscaping of the site will fully meet code requirements when staff comments are
incorporated Front and side yard landscape buffers are provided as required by code
Extensive landscaping is proposed for the entrance area and will include a variety of palms,
shade trees, and shrubs The entrance area will also contain a decorative fountain and
appropriate project signage A total of 426 trees are required and 464 trees have been
provided Of the 464 trees, sixty-five percent (65%) are considered native species The
Washington Palms, Queen Palms, Cabbage Palms and Alexander Palms will be installed in
varying heights to increase the project's aesthetic quality
Building and Site Building and site regulations will be fully met when staff comments are incorporated into the
permit drawings
Community Design The proposed development has selected Buff as the predominant color with accent color
tones in Beacon Yellow (gold) and white The aluminum railing color will be Sage The roof
will be constructed with Spanish S-tile and the building fa<;ade will be made of a light texture
stucco finish Complimented with attractive landscaping and an ornate entrance feature, the
design suggests an "upscale" character The proposed architectural style is similar in
character with the recently approved development "Tuscany on the Intracoastal" near
Federal Highway and Southeast 23rd Avenue The proposed design is preferable for this
redevelopment area of the city
Signage The project is proposing to have one (1) double-faced free standing monument entry sign
five (5) feet in height, located in the median at the main entrance A decorative project
identification wall sign is proposed adjacent to U S 1 I Federal Highway The monument
sign meets the City's sign requirements for height and setbacks per Chapter 21, Article IV,

Sec. 1, however, the wall sign must be reduced in size from twenty-one (21) square feet to
no more than sixteen (16) square feet per Chapter 21, Article III, Sec. 6 C 5 (see Exhibit "C"
Conditions of Approval)
RECOMMENDATION.
Staff recommends that this site plan request be approved, subject to the comments included in Exhibit "C" -
Conditions of Approval The Technical Review Committee (TRC) recommends that the deficiencies identified in
this exhibit be corrected on the set of plans submitted for building permit.

orderly phySical patterns, prevent haphazard, premature, uneconomIC or scattered land
development; msure safe and converuent traffic control, encourage development of an
economIcally stable and healthful community; msure adequate utilIties, prevent penodIc and
seasonal floodmg by providmg protectIve flood control and dramage facllltles, prOVIde publIc
open spaces for recreation, msure that CItIzens of Boynton Beach WIll not bear the costs of
haphazard land development, proVIde the authonty to direct the constructIOn of Improvements;

comprehenSIve plan adopted by the City of Boynton Beach. In order to
provIde water-based recreatIon m accordance wIth the CIty'S
comprehenSIve plan, waterfront park Sites acceptable to the CIty shall be
proVIded.
b REQUIREMENTS As a conditiOn of issuance of a land development
order, the subdIVIder shall dedicate land, pay a fee m heu thereof, or
both, at the optIon of the City, for park or recreatIonal purposes and
accordmg to the standards and formula In thIS ordmance.
c. GENERAL STANDARD It is hereby found and determmed that the
pubhc mterest, converuence, health, welfare and safety reqUIre that SIX
(6) acres of property for each one thousand (1,000) persons be devoted
for neIghborhood park and recreatiOnal purposes.
d. FORMULA FOR DEDICATION OF LAND Park and recreational land

Natural resource credIt. On any sIte subject to development whIch
contaInS natural resource areas of native plant vegetation such as
Pine Flatwoods, Sand Pme Scrub, Xenc Oak Forest or Hardwood
Hammock where such natural resource area exceeds 10 acres,
twenty-five (25) percent of the natural resource area shall be
preserved and may be credIted a maxImum of twenty-five (25)
percent towards the parks and recreatIOn dedIcation reqUirement.
Such credIt shall require the approval of the CIty ConumssIOn after
reVIew and recommendatIOn of the TRC and the plannIng and
development board. The reqUIrements of thiS subsection shall be
In addItIOn to any other reVISIOns adopted by the CIty whIch
encourage the preservatIon of natural vegetation. In detenmmng
the amount of credIt, the TRC shall make a recommendatIOn to the
comnllSSIOn WhICh shall take mto account the follOWIng factors
(a) PublIc access.
(b) Management and maIntenance plan.
(c) ExistIng condItion of the natural habitat.
(d) Proposed restoration methods.
(e) The proportionate Size of the habitat to the entire
development.
(f) The eXistence of protected species Within the habitat.
e. FORMULA FOR FEES IN LIEU OF LAND DEDICA nON

(I) GENERAL FORMULA. If no park or recreatIOn facilIties are
proposed Withm the subdiVision, the subdiVider shall pay a fee
equal to the value of the land. The fee Will be used to acqUire
and/or develop park and recreational land to serve reSidents of the
subdiviSion.
(2) USE OF MONEY The money collected hereunder shall be paId to
the City of Boynton Beach and placed In a trust fund to be known
as the reserve for parks and recreational faCIlIties. This account
shall be used solely for the acqUisitIOn, Improvement, expanSIon or
ImplementatIOn of parks and recreational faCIlIties in the City of
Boynton Beach. Funds shall be used first for the purpose of
providing park or recreatIOnal facilities reasonably related to
serving said subdiVision by way of the purchase ofland, or for
improving SaId land for park and recreational purposes. Ifboth
adequate land and Improvements exist in the area, funds may be
spent to acquire or Improve park and recreational facilities
elsewhere In the CIty

(3) CRITERIA FOR REQUIRING BOTH DEDICATION AND FEE.
The subdIvIder shall both dedIcate land and pay a fee In heu
thereof In accordance wIth the folloWIng formula.
(a) When only a portIon of the land calculated by the formula for
park and recreational use IS to be dedIcated, such portIon
shall be dedIcated for local park purposes and a fee computed
pursuant to the prOVIsIons set out above shall be paJd for any
additIonal land that would have been requIred to be dedIcated
pursuant to the saId above provlSlons.
(b) When suffiCient park and recreatIonal land In the VICInIty has
already been acqUIred by the City and only a small portIon of
land IS needed from the subdIVISIon to complete the SIte,
such remaInIng portIOn shall be dedicated and a fee
computed pursuant to the formula provided above shall be
paId In an amount equal to the value of the land WhICh would
otheIWlse have been reqUIred to be dedIcated pursuant to SaId
above prOVISIon.

(4) AMOUNT OF FEE IN LIEU OF LAND DEDICATION Where a
fee is reqUIred to be paid In lieu of land dedication, the amount of
such fee shall be based upon the fair market value of the amount of
land which would otheIWlse be requued to be dedicated pursuant
to the formula prescribed in ArtIcle V, SectIon 3, paragraph A.2.d.
above. The fee shall be paid pursuant to the prOVIsions contaIned
in this ordinance. At the time of filing of the plat for approval, the
Department of Development shall, In those cases where a fee In
lieu of dedIcatIOn IS required either In whole or m part, determme
the fair market value of the land In the proposed SUbdIvisIOn, and
this detemunatIOn shall be used In calculating the fee to be paId. If
a subdiVIder objects to the fau market value determmatIon, he may
at lus own expense, obtain an appraIsal of the property by a
qualified real estate appraiser approved by the CIty, wroch appraIsal
of fair market value may be accepted by the CIty CormmsSlOn, If
found reasonable. Alternatively, the CIty and the subdIVIder may
agree as to the faIr market value.
(5) DETERMINATION OF LAND OR FEE. The City CommIssion
shall determme whether it accepts land dedication or elects to
require payment of a fee in lieu thereof by consIderatIon of the
followmg:

(a) Topography, geology, access and locatIOn of land m the
subdIvIsIon available for dedIcatIOn. In order to provIde
water-based recreatiOn m accordance wIth the CIty'S
comprehenSIve plan, waterfront park SItes acceptable to the
CIty shall be provIded.
(b) Size and shape of the subdIvisiOn and land aVailable for
dedIcatIOn.
(c) The feasibIlIty of dedIcatiOn.
(d) A vailabIhty of prevIously acqUIred park property
(e) In conformity WIth the recreatIon land use plan.

(6) CREDIT FOR PRIVATE OPEN SPACE. Where open space for
park and recreatIonal purposes IS provIded m a proposed
subdIVISIOn and such space IS to be pnvately owned and
mamtaIned by the future resIdents of the subdIvISIon, partIal credIt,
not to exceed fifty per cent (50%) may be gIVen against the
reqUirement of land dedicatIon or payment of fees m lIeu thereof If
the CIty COmrnISSIOn finds It IS In the publIc mterest to do so and
that all of the follOWIng standards are met:
)
(a) The yards, court areas, setbacks and other open areas
reqUired to be mamtamed by the zonmg and bUIldmg
ordmances and regulatIons shall not be 10cluded 10 the
computation of such pnvate open space; and
(b) That the pnvate ownershIp and maintenance of the open
space IS adequately prOVIded for by recorded wntten
agreement, conveyance, or restrictions; and
(c) That the use of the pnvate open space is restncted for park
and recI~atlOnal purposes by recorded covenant, whIch runs
WIth the land in favor of the future owners of property and
whIch cannot be defeated or elImmated WIthout the consent
of the city or ItS successor; and
(d) That the proposed pnvate open space IS reasonably adaptable
for use for park and recreatIonal purposes, talong mto
conSIderatIOn such factors as size, shape, topography,
geology, access, and locatIon, and
(e) That the open space for whIch credIt is given prOVIdes a
mInImum of five (5) of the local park basIC requirements
lIsted below, or a combination of such and other recreational
Improvements that will meet recreation park needs of future
residents of the area.

f. PROCEDURE. The CIty Commission shall detemune pursuant to
subsectIon B.5.e hereof the land to be dedicated and/or fees to be paId by
the subdiVIder
At the time of the filing of the subdiviSIon final plat for approval,
the subdivider shall dedicate the land, pay the fees as preVIously
determined by the City Commission, or furnish surety m the amount of
one hundred ten per cent (110%) of the fees which shall become a hen
upon the property and shall be paid prior to issuance of the first
certificate of occupancy or the transfer of title to any parcel or unit of the
land or improvements thereto.
g. COMMENCEMENT OF DEVELOPMENT At the tIme of proposal of
the final subdivisIOn plat, the City Commission shall speCIfy when
development of the park or recreational facilIties shall be commenced.
h. NONRESIDENTIAL SUBDIVISIONS The provlSlons oftlus sectIon
shall not apply to nonresIdential subdiVIsions.
B Adequacy of sites for utihties and public facIlIties.
As part of the reVIew and approval of development projects, the CIty shall evaluate
the need for sites for major utility and publIc faCIlities and require dedication of
same, WIthout penalty for the densIty or intensity of use, where domg so would be
reasonably possible; otherwise consider the purchase of property, If dedication of
land is not feasible.

into two categories, code deficiencies with code sections referenced and recommendations that
you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval
1 Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments
2 The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by
the reviewer by contacting Lusia Galav, or myself
3 Each comment shall reference the section of the code that is incorrectly depicted on the
documents

4 Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with
other departmental improvements
5 When a TRC Member finds a code deficiency that is outside of his/her review responsibility the
comment and the specific code section may be included in their review comments with the name
of the appropriate TRC Member that is responsible for the review specified
6 If a TRC member finds the plans acceptable, he/she shall forward a memorandum within the time
frame stated above, to me The memorandum shall state that the plans are approved and that
they do not have any comments on the plans submitted for review and that they recommend the
project be forwarded through the approval process
All comments shall be typed, addressed and transmitted or e-mailed to Blythe Williamson and I for
distribution to the applicant. Please include the name and phone number of the reviewer on this
memorandum or e-mail Lusia Galav will be the Planning and Zoning staff member coordinating the
