(contract purchaser of Lots 68A, 68B, 69 70 and 72 - containing four existing industrial buildings with a total area of approximately 268,500 square feet, and Lots 73A, 73B, 74, 75 and 76 - vacant lands with an approved site plan for 1 96 486 square foot industrial building) Please accept this letter as our formal request to allow for "outdoor storage" within the aforementioned property located within the Quantum Corporate Park PID Our request for outdoor storage" pertains only to those products, materials supplies, equipment, and/or vehicles that are authorized and approved pursuant to the M-1 Industrial District portion of the Boynton Beach, Florida Code of Ordinances ("Code") The purpose of the Use Approval Application is to allow a use that we understand is not currently defined in the City of Boynton Beach Code The proposed use is ancillary to the uses approved within industrial use zones in the Quantum Corporate Park PID This proposed use is intended to be supplemental to and complementary with the office, warehouse, industrial, and wholesale sales uses currently allowed within industrial use zones In accordance with provisions of the Planned Industrial Development District section of the Code, the following criteria will be complied with regard to any proposed outdoor storage a Any outdoor storage proposed on a particular property will not exceed 15% of the total square footage of that particular building site, and, NOTE The products/materials to be stored shall be identified on the plans for Tenant Improvements where such "outdoor storage" is being requested b Any outdoor storage proposed on a particular property shall be fully screened and fenced to preclude exposure to the public from offsite roadways and adjacent properties, NOTE Details of the methods of providing such screening (generally a 8' high chain link fence with opaque inserts or screening) will be included on the plans for Tenant Improvements where such "outdoor storage" is being requested Michael Rumpf, Planning and Zoning Director - City of Boynton Beach Use Approval Application Outdoor storage within industrial use zones Quantum Corporate Park PID August 10, 2001 Page 2 This proposed use (limited "outdoor storage") will comply with all the City's performance standards They are individually addressed as follows 1 Noise No sound will be created which is in violation of Section 15-8 of the City of Boynton Beach Code of Ordinances. 2. Vibration No ground vibrations will be generated by the proposed uses 3 Smoke, Dust or other Particular Matter' The proposed uses will not allow the emission of any substances in violation of any federal, state, county or city laws or permits governing the emissions of such substances 4 Odors and Fumes. No objectionable or offensive orders will be readily perceptible at any point beyond the industrial district. 5 Toxic or Noxious Matter' The proposed use will not allow any toxic or noxious matter to be discharged in such concentrations as to cause damage to property or vegetation discomfort or harm to persons or animals, or prevent the reasonable use an enjoyment of property or right-of-way at or beyond the property line or to contaminate any public waters or any groundwater 6 Fire and Explosion The proposed uses will not create a fire or explosion hazard 7 Heat, Humidity or Glare The proposed uses will not produce hear, humidity or glare which is readily perceptible past the property boundary The lighting will conform to the City of Boynton Beach's standards. 8 Liquid Waste Any disposition of liquid waste will be in conformance with the provisions of Chapter 26 of the Boynton Beach Code of Ordinances of any applicable federal, state or county laws or permits g Solid Waste Any accumulation or disposal of solid waste will be in conformance With Chapter 10 of the City of Boynton Beach Code or Ordinances and will not be transferred to adjacent or nearby property or right-of-way 10 Electromagnetic Interference No electromagnetic radiation or interference will be created 11 Hazardous Materials and Hazardous Waste No hazardous materials or hazardous waste will be created, stored or handled with the proposed use Michael Rumpf, Planning and Zoning Director - City of Boynton Beach Use Approval Application Outdoor storage within industrial use zones Quantum Corporate Park PID August 10, 2001 Page 3 In addition to compliance with the above listed performance standards, the proposed use will comply with other relevant City requirements. including the issuance of an environmental review permit as may be required pursuant to the Code The implementation of any outdoor storage will take place primarily or exclusively on the concrete truck service court aprons located in the rear of each building Any proposed outdoor storage will not interfere with normal vehicular traffic, or emergency vehicle traffic patterns or flow Any proposed outdoor storage will not extend over any public utility easements, and will not interfere with any trash dumpsters or the operation of drainage or any other utilities Any proposed outdoor storage will not disturb any landscaping required by Code Any proposed outdoor storage will not reduce the amount of parking or loading areas required for any building below the minimum number required by Code Any proposed outdoor storage will not restrict or inhibit access from any required emergency exit from the building We would propose to keep an ongoing accounting, in conjunction with the execution of lease agreements/amendments, of the amount of outdoor storage authorized for each of the referenced properties at this project to assure that the 15% limitation is not exceeded Such documentation could be submitted to the City in conjunction with any tenant's request for fencing approval related to outdoor storage Please find enclosed a check in the amount of $250 00 as processing fee for this approval use request.
