Here IS a copy of that report for your convemence along with an update based on discussIOns held today wIth the developer (Original Report from last week --) Developer for Quantum Proposes Deal for Open Space Obligations - Last week, the P&D reVIew of an addltlOnal 42 multI-family UnIts at Quantum generated dIscussIon regardmg the applIcabilIty of park Impact fees for the development. In December 2000, the CIty CorrurusslOn granted an exemptIon for 272 umts of the Grotto Bay development. TIns was the first phase of 500 multi-family UnItS that had been approved m the March 2000 amendment to the planned development. Staff has mterpreted the exemptIon to be specI1icaIly for these 272 umts leavmg the remamder of the first 500 umts (228 umts) and the second 500 umts as approved m the 200 I amendment to the planned development, subject to the terms of the park lDlpact ordmance. The developer had 1ll1t1ally taken the posture that none of the 1ll1t1al500 umts should be subject to a park lITlpact fee. However, the developer has moderated their VIew Last week, I mformally met Wlth the developer because they knew the 47 umts would be potentially an Issue owmg to the SIte plan approval requested. ImtIally, the developer asked IfI would support exemptIng these 42 umts that are an addltIon to the 272-umt development. I told the developer that I mterpreted the Clty ComrmsslOn action m December 2000 to be IIrmted to the 272 umts. Based on prelumnary calculatIons, the 42 umts would result m a park lITlpact fee of about $27,000 or $653/umt. ThIs IS based on the development receIVIng the 50% credIt for on-SIte pnvate recreatIonal amemtIes and acceptance of an addItIOnal 25% credIt for the preserve area. The latter was accepted very reluctantly m 2000 by staff when we were trymg to resolve the fees for the 1ll1t1aI272 umts. The developer now has mfonnally suggested a flat $475/umt fee to be paId for all umts constructed after the 1ll1t1aI272 umts. Based on the possible constructIon of 728 umts for both amendments to the planned development, tlle $475 fee would generate $345,800 A projectIon based on the current ordrnance ? V\. f"(~ and an asswnptlOn ofIand cost of$4 OO/sq ft, would generate $475675 However staff IS finalmng a change m the Park Impact Ordmance that bases the Impact on a flat per urut rate rather than the current complIcated system based on land values. Under the draft ordmance, the Park Impact fee for the remammg 728 umts would be $491,368 ThIS IS based on not grantmg the developer any credIt for the preserve and Imear recreatIOn comdor area that was done m the 2000 dIscussIOns. If a 25% credtt were mcluded, the total Park Impact fee for the 728 uruts would be $368,500 compared VVlth the offer of the developer of $345 800 Unfortunately, neIther staff nor the developer has accepted the Idea of applymg the new ordmance WIth a 25% credIt for the preserve and lmear recreatIOn comdor I'm hopmg to have the Issue resolved by next Tuesday s meetmg and wanted to know where the conversatIon has been gomg. I ve attached a data sheet that shows how the costs stack-up. Update of February 4th discussions - I met WIth Mr McDonald and Mr McGilhcudy today to find out If the developer was receptIve to the payment of$368,500 based on a per UnIt formula for up to 728 UnIts They were, subject to the followmg: The developer would convey to the Development DIstrIct tItle to Lot 34C WIth the stIpulatIOn that It would not be developed Rather thIS parcel would be part of the preserve area. ThIS IS the lot on Mmor Road next to the Sand Pme Preserve that the developer had deSIgnated as "reserved" dunng the most recent plan amendment. ThIS way the property would be protected and mcluded In the mamtenance responsibIlIty of the Development DIstnct. ThIS parcellS 6 5 acres m SIze and has been sought by preservatIOnIsts 2 The Developer would request approval of a zonmg deSIgnatIon of MIxed Use for parcel 89-B, whIch IS about 4 acres m SIze ThIS parcel IS currently zoned as Office and IS located on the east SIde of HIgh RIdge Road Just next to the Tn- Rail statIon and south of the old emISSIOn control statIOn. The developer would like to add fee-SImple reSIdentIal here because of the locatIOn next to the tram statIon. They understand that the reSIdential uses stIll would not exceed 1,000 umts total. 3 The Developer IS lookmg for CIty approval for developmg lots 23-31 and Lots 7- 11 m the NW sectIOn of the development as fee-SImple reSIdentIal ThIS IS not a change or addItIOn to the number of resIdentIal UnIts but It does represent 100% use of the lots for reSIdentIal mstead of some other uses allowed m the MIxed Use category Staff has mterpreted the development order approved by Ordmance 0 I-54 as requmng some other land uses beSIdes reSIdentIal m addItIOn to reSIdentIal on these lots reasonIng that a mIxed use "pod" must have more than one land use to be a "mIxed use" The developer has rejected thIS mterpretatIOn and would be lookmg to the CIty to cure thIS matter eIther by re- zonmg the Lots 23-31 and 7-11 as reSIdentIal or to support the developer's America s Gateway to the Gulfstream mterpretatIOn. Accordmg to verbal mformatIOn provIded by the developer today, the proposal IS to construct about 120 fee-sImple townhouses m thIS area wIth a pnce pomt InItIally of about $120,000/UnIt. Interestmgly, WIth the addItIOn of the 42 umts on the south sIde of Gateway, there would be 542 rental UnIts constructed m thIS area and 458 fee-sImple umts north of Gateway The developer verbally commItted to all umts north of Gateway bemg fee-sImple rather than rental. 4 CommercIal and Office Development - The developer recognIzes the pnor approval of the mIxed-use classIficatIOn assumed commercIal and office uses Today the developer confirmed that they would be pursumg these land uses along Gateway Boulevard basIcally east of Quantum Lakes Dnve to HIgh RIdge Rd The developer was not specIfic as to the commercIal. I thmk some progress has been made on thIS project today However, staff IS still not convmced that the formula I developed IS a faIr compromIse for the open space reqUIrements. It may take some tweakmg and perhaps the CIty CommISSIon can approve the SIte plan subject to the developer and staffworkmg out an outlIne for a final development package ThIS may reqUIre a tImelme for final amendment to the Planned Development. Prior Discussions with Quantum on Lot 31 Wilfred - We did meet with the Winston Lee (consultant for Quantum) quite some time ago We were supposed to discuss the possibility of Quantum dedicating land south of the future park site Unfortunately the plan Mr Lee showed us only provided for the wetlands north of the site to be filled in and turned into recreation areas This solution was not acceptable to the city Even though they have talked about dedicating parts of several lots south of the park site to us they have never gotten serious about it. Recommend Placing "Road Closed Ahead" signs for Quantum Boulevard southbound traffic . Recommend using painted directional arrows instead of tape This will be a long term set-up and paint will be more durable . Indicate, by note, that all signs are to be post mounted and will be placed in accordance with the applicable FOOT standards for offset and mounting height. . Only 2 (two) Type III barricades are shown at either end of the closure area Will this be adequate? The plan shows the portion of Quantum Lakes Drive closed just northward of Quantum Blvd. and just southward of the median at Lot 61/62 property line, using type m barriers. Additionally, we will be installing a construction chain lmk fence with gates at both ends for trucks and emergency vehicles. The temporary construction chain link fence will also contmue along the lake bank, just outsIde the construcnon limits of the additional buildings, in order to protect the existing vegetation. Quantum Lakes Dnve is a Quantum Community Development District roadway and was approved by the dIStrict for closure at the November district meetmg. The closure will help facilitate the constructIon of the apartment commumty, lessen the confhcts WIth vehicular traffic, and reduce the liability to the dIStrICt.
