Brueningsen I received a copy of City Ordinance #01-49 in connection with the
vacation of the old 12' drainage easement between lots 59 and 60 As
you recall as part of the vacation we recorded a new 20' drainage
easement in about the same place but to fit our site plan Attached to
the ordinance as Exhibit B is supposed to be that new 20' DE,
unfortunately the easement description that got attached is not
correct. I faxed a copy of the recorded 20' DE to Mike Rumpf just now
Let me know what needs to be done to correct this Thanks Erik

City Manager Bressner stated that we are buying the services of the company, not the
individual A contractor cannot guarantee that an employee will stay employed by the
company If this individual were to leave, we could request someone similar to him and ask to
review the credentials of that individual
Commissioner Rsher asked about the cancellation clause.
Mr Atkins stated that jf the current security individual was no longer employed there, the
company would provide a replacement and the City would make a decision whether we were
satisfied If the City was not satisfied, there are provisions to opt out of that contract. There is
wording that protects the City

VII.D.3 Villas @ Quantum Lake - (Quantum Lakes Drive) - Request _
major site plan modification for an additional 42 residential units to be located on
a 2.91-acre addition to this approved 272-unit project
City Manager Bressner stated that this 2.91-acre addition is a portion of the right-of-way being
vacated. The Planning & Development Board recommended approval of the site plan The
Board did not agree with staff's recommendation on the issue relative to park and recreation
dedications. The City and the developer are working towards a proposal that will resolve that
issue. He recommended that the Commission approve the site plan subject to the developer
and staff returning to the Commission in 30 to 45 days with a reconciliation of the park and
recreation issue.
Rick Rossi, 625 Whispering Pin~ Road, does not understand why this project is not paying
recreation fees. The City should be getting $40,000 to $50,000 for these 42 units. The Oty
lost $240,000 in recreation fees on the previous units. Mr Rossi felt that Quantum should not
be treated any differently than any other residential development. Any facilities that are
currently at Quantum, such as open spaces, came as a result of DR!. They should not be
applied now as recreation credits. Mr Rossi felt that the issu~ of recreation fees should be
worked out in public and not by the City Manager
Mayor Broening noted that the Planning & Development Board, which consists of citizens of the
Qty, did approve this. The suggestion of the Oty Manager is to approve the site plan but to
postpone determining what the recreation fees should be. He could see no reason to hold this
project back because of this issue. It will be r~lved to the benefit of the citizens.
Motion
Commissioner Ferguson moved to approve item VII.D.3, subject to reconciliation of the
recreation fees. Vice Mayor Weiland seconded the motion that carned unanimously

annex property because of the water shortage
Mayor Broening responded that the City is required to provide water within its service

VII. I. Authorize an agreement with Glen Properties for payment of Park
Fees for the 42-unit development known as the Villas at Quantum
Lakes
Enrico Rossi, 625 Whispering Pines Road, Boynton Beach, spoke about the park fees
that the City should be receiving for development in Quantum Park. Mr Rossi does not
think that the City is charging Quantum Park enough for park fees He asserted that
the City has already given away $174,000 on the first 272 units Mr Rossi stated that
the $492 per unit for the 42 units is not enough and that Glen should have to pay more
than $20,664 This fee is only 75% of the park fee and Glen should be charged the full
fee of $653 per unit.
Mr Bressner responded that back in December 2000, when the 272 units were
presented to the City Commission, staff recommended a figure close to the $653 per
unit. This figure was arrived at under the current ordinance that states the developer
would receive a 50% credit for on site recreation and staff recommended a further
reduction of 25% At that time, the Commission made a policy decision to totally waive
the fees so that Glen paid nothing Mr Bressner explained how they arrived at the
$653 per unit. The $492 is based upon a draft ordinance that will be coming before the
Planning and Development Board next month where the 25% credit was applied for the
open space area that is open to the public. Staff has been working with Quantum
regarding public access and protection of this land
Mr Bressner pointed out that the difference between applying the old ordinance and
the new ordinance comes to approximately $7,000 Mr Bressner noted that this area
was given special consideration because it is the only property in the City that has a
linear recreation corridor and publicly accessible open space. Therefore, other
developments would not necessarily receive the 25% reduction because they cannot
provide the open space.

VIII CITY MANAGER'S REPORT
A. Development of a procedure whereby the City Commission can designate
certain honorary streets within the City
Mr Bressner noted that in the agenda packet there is a report from the Public Works
Department regarding the naming of public streets as honorary streets. This would not
replace the legal street name, but would provide recognition for individuals that have
contributed significantly to the community based upon a set of criteria that Mr
Livergood prepared If the Commission decided to proceed with this, it would have to
be presented in resolution form and individuals that are being considered to be honored
would have to be reviewed by an outside organization
As an alternative, Commissioner Fisher suggested naming parks after citizens, rather
than streets
Commissioner McCray stated that the request was brought before the Commission
because the parishioners of St. John/s Missionary Baptist Church would like to name an
honorary street after the late Reverend Dr R.M Lee, who served the community for 43
years
Motion
Commissioner McCray moved to direct staff to develop a resolution to name honorary
streets after deceased persons, who have contributed many years to the community
Mayor Broening passed the gavel and seconded the motion The motion failed 2-3
(Vice Mayor Weiland and Commissioners Ferguson and fisher dissenting.)
Commissioner Fisher requested that staff work with Commissioner McCray to find a
suitable way to honor the late Reverend Dr Lee. There was a consensus to proceed
with this method

PARTICULARLY DESCRIBED HEREIN,
AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A DISCLAIMER, WHICH SHALL BE
RECORDED IN THE PUBLIC RECORDS OF PALM
BEACH COUNTY, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Mark M. Hansen of Olen ResIdentIal Realty CorporatIOn, agent for

NOW, THEREFORE, BE IT RESOL YED BY THE CITY COMI\-IISSION

RE. Abandonment Application - VILLAS AT QUANTUM LAKE

Since Jose provided this department with additional information and data not attached to the
documents that the City Clerk's office provided, we will withdraw our denial recommendation as noted
in our Memorandum #01-128 dated July 20th The superceding 20-foot drainage easement covers
that portion of the existing storm conduit to be utilized in the relocation effort. Therefore, the
department will change its position to no objection to the applicant's request for an abandonment. If
you need any other information regarding this matter, please advise me

Quantum Park at Boynton Beach, P.I.D., Plat No 6, as recorded m Plat Book 57, Pages 191 through 193,
PublIc Records of Palm Beach County, specIfically'
All of the 12.00 feet WIde dramage easement m favor of the CIty of Boynton Beach, lymg
6 00 feet on each SIde of the north lme of the aforementioned Lot 59
Please be adVIsed that the west 60 feet of thIS easement IS to remam actIve (accordmg to the development
for the pavmg and draInage portIOn), therefore cannot be abandoned. The legal descnptIOn submItted
identIfies the total easement. The ongmal utIlity easement was mtended to be for stormwater draInage
from Quantum Lakes Dnve to a water retentIOn tract. However, the re-design of the tracts for thIS
development has rerouted a major portion of the 12-foot Dramage Easement and the eXIstmg 54-inch
CMP dramage condmt mto a new 20- foot Dramage Easement to accommodate the proposed SIte plan. To
thIS end, the re-routmg should be approved by the CIty as a portIOn of the eXIstmg easement reflects
proposed bmldmg(s) on same as well as the proposed clubhouse
Therefore, havmg stated the above, thIs department recommends denial of the applIcatIOn for easement
abandonment as submItted. As an alternatIve, the proposed legal description needs to be changed to
reduce the proposed abandonment leavmg the west 60 feet actIve, before reconsIderatIOn. If you have any
