The waivers will pertam to lots MU 83 through MU 88, located north of Gateway Boulevard, west of High Ridge Road, and Parcel 89B, located north of Gatewav Boulevard, east of High Ridge Road. BACKGROUNDIHISTORICAL PETITION INFORMATION Quantum Park IS a Development of RegIOnal Impact approved m 1984 The Development Order granted for the park has been amended smce ItS ongmal adoption. The amendment that allows reSidential land uses wlthm the Park IS Amendment No to that "slffiultaneously mcreased the commercial mtensltles and decreased the office and mdustnal mtensltles. The Simultaneous mcreasmg and decreasmg of the land use mtensltles resulted m no additIOnal regIOnal Impact most notably by not mcreasmg the total traffic generated" (Quantum Park Annual Status Report - March 2002) Parcels MU 83 through MU 88 have Master Plan approval that Will allow development of the proposed commercial and residential land uses. The commercial land uses will face Gateway Boulevard and the balance of the property 'will be developed as tQ\,vnhomes City Council granted WaIvers to accomphsh the development. A Notice of Proposed Change and Master Plan Amendment were approved by City CouncIl on October 15, 2002 for Parcel 89B, and waivers were granted to allow the townhomes proposed for the parcel. Smce the approvals were granted by City Council, the developer has modrfied the reSidential unitS and site plan. The proposed modificatIOns are submitted as part of the Technical Site Plan Submittal. The changes proposed bv the developer are a result of staff recommendatIOns made dunng the reView of the conceptual master plan and create a neo-traditlOnal commumty mstead of a typical townhouse tract development. JustIficatIOn. ThIs IS a residential pod that would typically be subject to the regulations contamed m the R-3 Multifamily Zomng Dlstnct, which reqUires a twenty-foot minImum buildmg separation. For s10gle famIly or duplex UnIts, a typical separatIon IS 7.5 feet from the mtenor property lIne. The twenty five foot buildmg separation reqUired m the PIDD applIes to mdustnal or commercial bUlldmgs that are allowed by Code a greater Floor Area Ratio and buIldmg height that what IS contemplated With thiS two story town home development. The greater floor area ratio and buIlding height produces a much larger build10g mass than a residential UnIt. It IS also Important to note that the City's code contemplated the separation would apply to buildings be10g on the "same lot or parcel of land" whereas the to\\-n homes Will be fee Simple ownership and will share a common wall. To reduce the size and appearance of the build1Ogs, there are no garages m the front of the homes. Pnvate space IS created through the use of courtyards and architectural details. More common open space m lOgical useable areas IS thereby created for all of the residents It IS Important to note that the seven-foot dImenSIOn eXists only 10 one locatiOn, and IS near the pedestnan connection and focal po1Ots for the commercial parcel. The buildmgs have been onentated so that VisibilIty from the UnIts to the adjacent properties IS mmImaI. INTRODUCTION Environmental Services, Inc , (ESI) conducted an environmental assessment of Quantum Park Lots 83-88 and 89-B on 23 August 2002. The lots are undeveloped land 10 portions of SectIons 16 and 17, Township 45, Range 43, Palm Beach County, Flonda (Figure 1) The site IS approximately 23 acres and Lots 83-88 are located northwest of the mtersectlOn of Gateway Boulevard and High Ridge Road. Lot 89-B IS located east of High Ridge Road and IS completely surrounded by commercial bmldmgs. Lots 83-88 are bounded on the west and north by sand pme scrub and are bounded on the south and east by roads and commerCial bUlldmgs. A dirt road runs along the northern penmeter of Lot 88 and contmues along the western penmeter of Lots 88, 87, and 83 A second dirt road follows the sectIOn lIne boundary through Lots 84, 86, 87, and 88 A dramage canal that extends along the northern perImeter of Lot 89-B drams the property and surroundmg commercial lots. The purpose of the environmental assessment was to document occurrences of any slgmficant environmental resources mcludmg vegetatIOn aSSOCiatIOns, jUrIsdictIOnal wetland areas, and listed plant or WildlIfe species. II. METHODS Pnor to the site VISit, the U S GeologIcal Survey 7.5-mmute Quadrangle TopographiC Map, Lake Worth Quadrangle (Photorevlsed 1983) (Figure 1) and the SoIls Survey of Palm Beach County Area, Flonda (U.S Department of AgrIculture, 1978) were reVIewed to determme topographiC features and site soIl mappmg unitS. Copies of the most current (1999) Palm Beach County bluelIne aerIal photographs of the parcel were obtamed and reViewed to determme potentIal location of environmental features. A pedestrIan survey of the parcel was conducted to map approximate locatIOns and boundaries of slgmficant environmental resources, vegetative aSSOCiatIOns, exotic vegetatIOn, wetland areas, and occurrence of lIsted plant or animal species. ApprOXimate locatIOns of vegetative community cover type boundaries and other features were mapped on the aenal photograph of the site. VegetatIOn asSOCiatIOns were Identified In accordance With Flonda Land Use Cover and Forms ClassificatIOns Systems Handbook (FLUCFCS) (FlOrIda Department of TransportatIOn 1999) Wetland protection IS mandated under both federal and state regulatIOns. Listed species of plants and wIldlIfe are found m Florida's Endangered Species. Threatened Species and Species of Special Concern, Official Lists (Flonda Game and Fresh Water Fish CommISSion 1997) and Preservation of Native Flora of Florida, Chapter 5B-40 (Flonda Department of Agnculture and Consumer Services, DIVISion of Plant Industry, October 2000) Any occurrences of lIsted species were recorded. III. RESULTS A. Soils SoIl on the eastern half of the site is mapped as Paola sand (Figure 2) Typical vegetatIOn IS sand pme (Pinus clausa) and an undergrowth of scrub oaks (Quercus geminata, Q myrtifolia, and Q chapmanii), saw palmetto (Serenoa repens), and rosemary (Ceratiola ericoides). The surface IS sparsely covered by grasses, pnckly-pear cactus (Opuntia humifusa), mosses, and lIchens. Western portions of Lots 83, 87, 88 are mapped as St. LUCie sand. Natural vegetatIOn IS sand pme, scrub oak, saw palmetto, rosemary, pnckly- pear cactus, remdeer moss, and sparse clumps of wIre grass (Aristida beyrichiana) and rose natal grass (Rhynchelytum repens) Under normal conditions, the water table for both soIl types IS below SIX feet. B. Vegetative Communities In November of 1999, ESI conducted an envIronmental assessment of Lots 83-88 At that time the dommant vegetative commumty was sand pme scrub Sometime after the assessment, those SIX lots were cleared of all canopy vegetatIOn. The most current bluelme aenal photograph avaIlable (February 1999) shows the Site pnor to the clearmg. The Upland Scrub cover type IS found throughout Lots 83-88 Upland scrub IS charactenzed by no one predommant species and IS usually a disturbed site that has regenerated naturally PrevIOus to bemg cleared, thiS area was sand pme scrub While the site has smce regenerated naturally, the plants observed are not typical plants found m sand pme scrub communities. Currently, dommant vegetation m Lots 83-88 mcludes small scrub oaks (Quercus spp), rose natalgrass, field sandspur (Cenchrus incertus), caesarweed (Urena lobata), downy mIlkpea (Galactia volubilis), partndge-pea (Chamaecrista fasciculata), rattle-box (Crotalaria pumila), and torpedo grass (Panicum repens). Other species observed mclude grapevme (Vilis sp), shrubby false button weed (Spermacoce verticil/ata), hogplum (Ximenia americana), pnckly-pear cactus, dog fennel (Eupatorium sp), scattered lovevme (Cassytha filiformis), saw palmetto, and BrazIlian pepper (Schinus terebinthifolius). ThiS cover type occupies approximately 40 acres. 2 Sand Pme, Disturbed (FLUCFCS 4131) The Sand Pme cover type was only found on Lot 89-B Lot 89-B had been dIsturbed In the past but still retams the majonty of ItS ongmal canopy The dommant canopy vegetation m Lot 89-B mcludes sand pme, Brazihan pepper, and scrub oak along With scattered earleaf acaCIa (Acacia auriculiformis) and Austrahan pme (Casuarina equisetifolia) Groundcover consists of saw palmetto, pnckly-pear cactus, dog fennel, and lovevme. Giant wIld pme au plants (Til/andsia utriculata) were observed m some of the larger canopy trees. ThiS cover type occupIes 13.5 acres. 3 PnmItIve Roads / Trails (FLUCFCS 8146) Two Wide trails eXist on the property The first runs west along the northern penmeter of Lot 88 and then follows the property lIne south along Lots 88, 87, and 83 The second traIl follows the section boundary lIne through the center of the property and through Lots 84, 86, 87, and 88 Both traIls contamed scattered vegetatIOn mcludmg shrubby false buttonweed, field sandspur, dog fennel, grapevme, and torpedo grass. ThiS cover type occupies 5.5 acres. C. Listed Species One lIsted wIldlIfe speCies, the gopher tortOise (Gopherus polyphemus), was observed on the site. A burrow survey was performed to estimate the size of the gopher tortOise populatIOn. D. Wetlands No wetlands eXist on the property IV SUMMARY A. Vegetative Communities The native vegetatIOn commumtIes on the property have been severely Impacted. InvasIve exotic species that occupy slgmficant portIOns of the property mclude BrazilIan pepper, rose natal grass, and torpedo grass. PIles of constructIOn waste are found throughout the site. No undisturbed native upland habitat eXists on the site. B. Listed Species Proposed development on the site wIll Impact the gopher tortOIse populatIOn. A relocatIOn or mCldental take permit should be obtained from EFWCC for the tortOIses that would be Impacted by development. A burrow survey should be performed when the development IS approximately 60 days from recelvmg all needed permits. Gopher tortoises proposed for relocatIOn off-Site must have blood drawn and analyzed for Upper Respiratory Tract Disease Upon the receipt of blood test results, an applIcation may be submitted to FFWCC for relocation or mCldental take permit. Typical processmg time for the permit applIcatIOn IS 30 days. The giant Wild pme alf plants found m the canopy trees on Lot 89-B are regulated by FDACS as Endangered. Regulated plant species are the property of the landowner However, as a reqUIrement for development approval, the Town of Boynton Beach may reqUIre relocatIOn and preservation of the endangered alf plants that occur on the site. State law prohibits sale of regulated plants C.
