We have been requested to approve minor changes in species for the proposed cassia
Fistula to 8' cassia surattensis, Also, the proposed hedge along the east buffer oflot 3 to
be changed from proposed ficus hedge to eugenia hedge as planted on other sides. We
also want to let you know that additional trees will be planted on site to make up the
difference in caliper required by the city and which have not been covered by the planted
material, Our office has no problems with the requested changes and it would be in the
better interest of the project to have this change made. However, before authorizing the
changes we wanted to have the requested change reviewed and approved by the City
to eliminate any issues at time of inspection,

along the western edge of this project along the canal. Due to overhead FPL lines and
berm height in this area we wish to switch species from Dahoon Holly to Cattley Guava
for aesthetics, buffer and better suitability to these conditions. This species change will
not affect the native requirement quantities on the site as the project exceeds the
requirements. Our office has no problems with the requested change and it would be in
the better interest of the project to have this change made. However, before authorizing
the changes we wanted to have the requested change reviewed and approved by the City
to eliminate any issues at time of inspection.

The Parks Department has reviewed the plans for the plating of the Quantum
Town Homes East/West Development. The following comments are submitted
1 The plans indicate that there will be 271 fee simple town homes in this
development. According to Chapter 1, Article V, of the Land Development
Regulations the formula for single family attached homes is applied
towards the calculation of the Park and Recreation Facilities impact Fee
as follows
271 single family attached homes X $771 each = $ 208,941
2 The fee is due at the time of the first applicable building permit.

Dear Mr Palumbo:
A field survey of the above referenced lots was conducted on the 09 Apri12002 to
determine the presence of listed plant or animal species. Visua11ine transects were
conducted every 10 meters in an east-west direction over the entire project site.
The vegetation is dominated by ruderal or weedy species due to past clearing of
the site. Most of the overstory canopy trees have been removed. The most common
species include Australian pine (Casuarina equisetifalia), carleaf acacia (Acacia
auriculaefarmis), Braziliail pepper (Schinus terebinthifolius), scattered slash pine (Pinus
elltotti.), and cabbage palm (Sabql palmetto). The shrub layer is sparse except fOr
isolated cocoplum (Chrysobalunus icaco) and a few seagrape (Coc%ba wi/era). The
herbaceous layer is a mixture ofbahia grass (Paspalum notatum), Bermuda grass
(Cynodon dactyl on), periwinkle (Caihranthus roseus), ragweed (Ambrosia
artemisiifolia). wild grape (Vilis munsoniana), silkgrass (Pityopsis graminifolia), prickly
pear cactus (Opu,ztia humifUsa), rosary pea (Abrus precatorius), dogfennel (Eupatorium
capillifoliurn). No listed plant species were observed dming the field survey of this site.
Based on previous studies of animal populations within the distuIbed plant
communities, a gopher tortoise (Gopherus polyphemus) survey was conducted for this
project. Here we report the prelinrinaIy findings of field mvestigations conducted in April
2002, 1999 for all listed ~n1ma1 species.
During the field survey of the vegetation, all gopher tortoise (Gopherus
polyphemus) burrows were located and mapped within the cleared lots. A total of 13
burrows were distributed as follows: 5 active, 2 inactive, and 6 abandoned. Active burrows
were identified by the presence of tracks. cleared openings or recently excavated soil.
Inactive bUlTOWS usually showed no signs of soil excavation and were frequently littered
with fallen leaves and other debris. Abandoned burrows were often caved-in or covered
with leaves with no sip of activity

Since gopher tortoises utilize more than one burrow, estinu'ltes of aburuiance were
based on a multiplier of 0.6 x active and inactive burrows (Auffenber;g and Franz 1982). If
we \ assume that the multiplier is an accurate estimate of tortoise populations throughout
Florida, 7 burrows represents an estimated population of 4 or 5 gopher tortoise. Most of
the active burrows are located in areas supporting a dense assemblage of woody species at
the north end of the project. The relocation of possibly less than 5 gopher tortoise would
require a special on-site permit from the Florida Game and Fresh Water Fish Commission
(FOFWFC
Other burrow ~als such as the gopher frog (Rana areolata) and eastern
indigo snake (Drymarchon corais couper) as well as the Florida ~crub lizard were also
looked for at the time of the gopher tortoise study. but no additional 8n1mals were
observed.

REQUEST FOR WAIVER, JUSTIFICATION
for
QUANTUM PARK TOWNHOMES - EAST & WEST
LAND DEVELOPMENT REGULATIONS, Ch 2, Sec 7, H 15
Requesting a waiver of 5' to allow a reduction in the minimum distance
between buildings from 25' to 20'.
This request is justified based upon the present 20' minimum separation allowed in
the R-3 Multi Family Zoning District. The 25' in the Planned Industrial Development
District contemplates much more intense uses with larger structures, truck traffic, etc
It is also of interest to note that townhouses may be separated by only 15' in the Palm
Beach County Code
LAND DEVELOPMENT REGULATIONS, Ch 2, Sec 7, H 16
Requesting a waiver of 10' from side setbacks in order to allow a 10' side
setback when a 20' setback is required
This request is only for one of the eight setback situations (2 parcels, front, rear and 2
sides each) that occur between the two site plans submitted. The particular building in
question is located at the northeast corner of the east parcel and only encroaches at
one comer The average setback of the building is 32' since it sits on an angle to the
side property line. This particular orientation is as a result of an attempt to shield the
front living areas of these townhomes (by rotating the building axis clockwise) from
passing vehicular traffic on Quantum Boulevard.
This situation may also be justified because the adjacent property is a platted wetland
area several hundred feet in width that is owned and maintained by the Quantum Park
COD
LAND DEVELOPMENT REGULATIONS, Ch 2, Sec 11, H.2
Requesting a waiver of 3' from the minimum 12' width required for the
first parking space not within an enclosed garage.
The imposition of this regulation serves no useful purpose in a townhouse community
with garages. In the west tract each unit has a one car garage with a separate double

width driveway for that living unit, thereby accomodating three vehicles. Requiring a
12' width for the first driveway space only serves to reduce landscape open space that
is desirable in the front yard areas. Furthermore each driveway is for the use of that
residence only and will not have a turnover of vehicles using the spaces. In fact a 16'
wide double driveway has become the industry standard in townhome and single
family home situations.
In the case of the east tract, all units contain a two car garage with access from private
parking aisles. All guest parking is parallel to interior roadways and measures 9' x 25'
These dimensions are equal to or exceed industry wide standards and to require that
the first space in each group be 12' in width serves no purpose It is also clear that this
requirement contemplated 90 degree parking areas rather than parallel parking.

Requesting 8 waiver 01 51 to allow a reduction in the minimum distance
between buildings from 25' to 20'
This request is justified based upon the pr6sent 20' minimum separation allowed in
the A.3 Multl Family Zoning District. The 25' ln the Planned Industrial Development
District contemplates much more intense uses with larger structures, truck traffic, etc.
It Is also of interest to note that townhouses may be separated by only 15' !n the Palm
Beach County Code.

Requesting a waiver of 10' from aide setbacks in order to allow a 10' side
setb.ck when . 20' setback is required.
This request is only for one of the eight setback sItuations (2 parcels, front, rear and 2
sides each) that occur between tl'le two site plans submitted The particular building in
question -is IOCElted at the northeast corner of the east parcel and only encroaches at
one corner The average setback of the building Is 32' since it sits on an angle to the
side property line. This particular oriematlon Is as a result of an attempt to shield the
front living areas of these townhomes (by rotating the building axis clockwise) from
passing vehicular traffic on Quantum Boulevard.
This situation may also be justified because the adjacent proPElrty Is a platted wetland

family home situations.
In the case of the east tract, all units contain a two car garage with access from private

These dimensions are equal to or exceed industry wide standards and to require that

ARTICLE I. IN GENERAL
Sec. 1 Purpose.
The purpose for construction of these required
improvements is as stated in Chapter 1, Article IV of
these Land Development Regulations of the City of
Boynton Beach.
Sec. 2. Commencement.
Construction of required improvements shall not
commence until a land development permit has been
issued
Sec. 3. Administration.
For the purpose of coordinating, enforcing and
administering this chapter the director of development
shall be the administering officer
ARTICLE II. APPLICABILITY
Tangible improvements are required as described
in this chapter in conjunction with the development of
every subdivision within the incorporated area of the
City of Boynton Beach whether the subdivision is
platted or unplatted
ARTICLE DI. IDENTIFICATION OF
REQUIRED IMPROVEMENTS
Sec. 1 Alleys.
Ic
Alleys are required along rear lot lines of
commercial subdivisions and are permitted in
industrial subdivisions
Sec. 2. Bridges and culverts.
Bridges or culyerts shall be provided as
necessary to facilitate the proposed street system
whenever a subdivision is traversed by or contains
canals, watercourses, lakes, streams, waterways or
channels Bridges or culverts are subject to approval
by agencies having jurisdiction.

Sec. 3 Buffer areas (screening). .)
Subdivisions shall be buffered to separate
residential developments from commercial and
industrial developments with a five-foot high masonry
wall or landscaped chain link fence, or some other
equivalent buffer which shall also be at least five (5)
feet in height, except where such developments are
separated by a golf course or other equivalent barrier
Residential developments shall also be buffered and
protected from adjacent expressways, arterials and
railroad rights-of-way with a five-foot limited access
easement, which shall be shown and designated on the
plat, except where access is provided by means of a
marginal access road or where such expressway,
arterial or railroad right-of-way abuts a golf course.
As an alternative, a five-foot high decorative masonry
wall or landscaped chain link fence or other
equivalent buffer, which shall be at least five (5) feet
high, may be provided in a limited access easement
up to five (5) feet wide

5 Technical SIte Plans review and

Development Director or his/her designee The
contents of such submittal shall conform to the site
plan requirements set forth in LOR, Chapter 4 The
Development Director or his/her designee shall
determine in writing within fifteen (15) business days
of said submittal, whether the submittal is consistent
with the Master Site Plan, and if found inconsistent,
shall specify the inconsistency If determined to be
consistent with the Master Site Plan, the final review
and approval shall be through the TRC review portion
of the Site Plan review process for determining
compliance with the LDR. A site plan submitted for
review which is determined, by the Development

the permit ptocess for obtammg approval to connect to and use District facIlities. District facilities include the

Jim we received an application for a new site plan on the 2nd mixed use pod in Quantum Park. This site plan is for
townhomes on all lots within the mixed use area. There is no non-residential element to be combined with it that would
help it meet what we understand to be the definition or intent of a "mixed use" pod I understood that Lusia had discussed
this with you and confirmed that the code would have to be amended to allow the mixed use areas to be used solely for
residential land uses I do not recall in detail what Lusia had shared with me, but thought it also included the requirement to
file yet another NOPC Quintus recommended we hold the submittal until we can answer these questions but I don't know
