Please consider tins letter as a request for a SIX (6) month time extension on the above project. A
filmg fee check m the amount of$400 00 has been submItted hereWith as requIred.
Chapter 4, Section 5 of the City's Zonmg Code defines the lITe ofa SIte plan approval as one year
from the date of the approval of the City COtnmlSSIOn, Wlthm such time the apphcant must secure a
buildmg penmt. It also allows the apphcant to request up to a one year time extension at any tIme
pnor to the expIration date. TIns letter meets that reqUIrement.
Tins project was originally approved by the City CommisSIon on August 7, 2001 under petItIon
number NWSP 01-003 The site layout on tins approval had the bay doors facmg 1-95 Subsequent
to that approval, the applicant made a request for a reVISed site plan approval, along With a request
for a Waiver to the CommUnIty DeSign Plan to allow the bay doors to face High RIdge Road, winch
was approved by the CIty CornnusslOn on November 6, 2002 under petition number NWSP 02-016,
winch established our current site plan expIration date of November 6, 2003
On July 17, 2003, a request for a mmor modIfication to the approved site plan was made to the City
Due to market condItions, the applicant had requested that the project be allowed to be phased and
tins request was approved on August 5, 2003, under petition number MMSP 03-058. Tins approval
did not extend the site plan expIration date. However, m anticipation of the approval, the applicant
submItted buildmg penmts for reVIew winch mdIcated phasmg on July 31, 2003 Buildmg pemut
comments were Issued and reVIsed plans were submItted on October 15, 2003 The delay m
resubmIttmg the reVISed plans was due to work schedules of our engmeermg consultant and was

beyond the control of the applicant. As the situation eXISts today, the plans are bemg reVIewed by
the Buildmg Department and we were hopeful that they would be approved pnor to our site plan
expIration date of November 6th However, as that can not be relied upon, and as the applicant does
not Wish to be m the situation oflosmg the approval while the permIt plans are under reVIew, and as
the applicant has every mtentIon of startmg construction on the project as soon as possible, we are
hereby respectfully requestmg an extensIOn to the approval. You will note that SIX (6) months IS
bemg requested, rather than one year, as we antiCIpate that the permIt will be ISsued shortly
As part of tIns request, I would like to request any flexibility that staff can gIve the application as to
the ultImate public hearmg schedule It will follow for approval. Site plan tIme extension applications
do not reqUIre TechnIcal ReVIew Comrmttee (TRC) reVIew, do not reqUIre advertismg, and reqUIre
mmrrna1 staff review As such, I would like to request that tins Item be placed on the November 25,
2003 Plannmg & Development Board agenda, and be heard by the City ComrmssIon on December
2,2003
I understand, per the Zoning Code, the City can not allow a building permIt to be ISsued after the date
ofthe site plan expIration, even With a request for extensIon bemg made. However, I would like to
verIfy that the Buildmg Department's reVIew of the permIt will contmue past that date. Our goal IS
to have the permIt completely reVIewed and ready to be Issued, so that we may secure the permIt the
day followmg the City Comrmsslon meetmg.
