The applicant has subrrntted a use request to allow the followmg uses m under SectIon D.,
INDUSTRIAL ofthe approved use lIst for the Quantum Park DRI. These uses are proposed to
be allowed on Lot 3 only
. Athletic and AerobIc Clubs/Specialized Instruction, mdudmg such uses as gymnastic
centers, cheerleading schools, karate schools, yoga centers, pilates centers, dance studio
and fitness centers, etc.
. Automobile and velncle accessones, furnIShings and supplies sales, mstallatIon, reparr, and
sefVlce, such as car alarms, wmdow tmtmg, stereo systems and custorrnzatlon.
Chapter 2.5, Sec. 4.N of the City of Boynton Beach Code requrres that all uses conform to
performance standards outlined therem. These standards are addressed below

Response The above requested uses shall be conducted entrrely WithIn the buildmg and

2. Vibrations. No use shall be camed out many zonmg dIStnct so as to create mherently and
recurrently generated ground vibrations winch are perceptible Without mstruments at any
pomt at or beyond the property lines ofthe property on whIch the use IS located.
Response. The above requested uses shall not create ground vibrations winch would be
perceptible beyond the property lmes of the subject lot.
3 Smoke, dust, dIrt, or other partIculate matter No use shall be camed out withm any
zorung dIStnct so as to allow the errnssIon of smoke, dust drrt or other particular matter
winch may cause damage to property or vegetation, discomfort or harm to persons or
aruma1s, or prevent the reasonable use and enjoyment of property and nghts-of-way, at or
beyond the property lines of the property on winch the use IS located. Furthermore, no
use shall be carned out so as to allow the errnssIon of any substances m violation of any
federal, state, county or CIty laws or penmts govermng the eInlSSlon of such substances.

create a fire or explOSIOn hazard to adjacent or nearby property nghts-of-way, or any
persons or property thereon. Furthermore, the storage, use or production of flammable or
explOSive materIals shall be m conformance With the proVISIOns of Chapter 9 of the City of
Boynton Beach Code of Ordmances.
Response The proposed uses do not create a fire or explOSion hazard. There will be no
storage of flammable or explOSIve matenals unless m conformance With Chapter 9
7 Heat, hurmdlty, or glare. No use shall be camed out many zorung dIStnct so as to
produce heat, hurmdIty or glare whIch IS readily perceptible at any pomt at or beyond the
property lme of the property on whIch the use IS located. ArtrlicIallightmg whIch IS used
to illummate any property or use shall be directed away from any reSIdential use whIch IS
a conformmg use accordmg to these regulatIOns, so as not to create a nUIsance to such

lightmg IS bemg proposed for the buildings and the site comphes With the City approved
site plan whIch reqUIred that lightmg be dIrected away from any reSidentIal use.
8 Liquid waste. No use shall be carned out many zorung distrIct so as to diSpose of liqUId
waste of any type, quantity or manner whIch IS not m conformance With the proVISIOns of

Chapter 26 of the City of Boynton Code ofOrdmances, or any apphcable federal, state or

transferred m any manner to adjacent or nearby property or nghts-of-way
Response: The proposed uses shall be m comphance WIth Chapter 10 of the CIty of
Boynton Beach Code of Ordmances and shall utilize the solid waste receptacles as
depIcted on the approved SIte plan.
10 ElectromagnetIc interference. No use shall be carned out m any zonmg distnct so as to
create electromagnetIc radIatIon whtch causes abnormal degradatIon of performance of
any electromagnetIc receptor of quality and property deSIgn as defined by the pnnclples
and standards adopted by the InstItute ofElectncal and Electromcs Engmeers, or the
Electromc Industnes AssociatIon. Furthermore, no use shall be carned out many zonmg
dIStnct so as to cause electromagnetIc radIatIon whtch does not comply WIth the Federal
CommumcatIons COmmISSIon regulatIons, or whtch causes objectIonable electromagnetIc
mterference WIth normal radIO or teleVISIon receptIon m any zorung dIStnct.

and/or meetings regarding the following petition.
Request to revise approved use list for the Quantum Park DRI to allow the

evolved from what was originally enVISIoned to be an mdustnal/office park mto more of a InlXed
use development. These changes included the addrtlon of up to 1,000 reSIdential dwelling umts to
the park. The addItIon of the aforementioned uses will be of benefit to the reSIdents reSIding m
