Reference is made to your April 30, 2002 letter, to Wayne Johnson, Parnell-Martin Companies,
LLC ("Tenant"), and my August 30 2002 letter to Michael Rumpf regarding the subject matters
The purpose of this letter is to provide the necessary support information that you have
requested in order to attempt to resolve these matters without the need to either revise the site
plan or make any further adjustments to the traffic study or impact fees pertaining to this project.
As you are aware, this request by Parnell-Martin involves the installation of an 844+1- square
foot mezzanine racking system in the non-air conditioned warehouse area of their lease space
premises at Gateway Business Center Building No 1
I am once again writing as authorized representative of Premier Gateway Center at Quantum
LLP (formerly known as Quantum Business Park L.C), the owner of Lots 32 through 38,
Quantum Park PID, Plat No 6 - an approved industrial development containing three buildings
with a total area of approximately 336,050 square feet, and Landlord of the referenced building
I am respectfully requesting that you reconsider the findings and recommendations included in
your letter of April 30, 2002, based upon the explanations contained herein, and provide us with
either a letter of authorization or a letter of "no objections" regarding these matters.
In our previous letter we attempted to justify our position and this request based upon the
premise that the proposed improvements were simply an enlarged racking system, similar to
other racking systems routinely approved by the City for use in similar non-air conditioned
warehouse applications, solely for the storage of materials We noted that this racking structure
would be subject to review/approval by the City Building Department and be provided with
lighting and fire protection in full compliance with all applicable current Codes and requirements

In follow-up telephone discussions with me, you have indicated that the City Planning and
Zoning Division disagreed with our position that the proposed mezzanine racking system
qualified as some sort of hybrid racking system. Your position remained that the mezzanine
racking system would have to be considered as "potential" usable building area.
You indicated, however, that if supplied with the appropriate back-up materials you would
consider approving this particular mezzanine storage racking system without requiring any
additional changes to the project site plan, parking requirements, and/or road impact fee
requirements.
In terms of Building No 1, on April 18, 2000, the City issued a Development Order (NWSP-OO-
001) authorizing Site Plan Approval for the referenced project. On May 2, 2002, the City issued
a Certificate of Completion for the base building construction of Building No 1 at the subject
property' an office/service industrial building containing a total (gross) building area of
approximately 142,202 square feet ("SF")
Please be advised that the reported total gross area of the building (142,202 SF), as indicated
on the plans approved by the City includes 416 SF located in the meter and fire pump room,
and 840 SF of exterior covered entry area in the seven front entrance ways to the building, as
well as the thickness of the exterior walls (amounting to approximately 1,400 SF of floor area
assuming 8" thick walls) All parking calculations as well as all permit fees and impact fees
were computed and paid based upon the gross area of th~ building (142,202 SF) Therefore,
the actual net usable area of the building (140,946 SF) is actually 1,256 SF less than the
reported area, not even considering the fact that the thickness of the exterior walls are also not
usable area
Since the City considers the proposed mezzanine racking system as a "building improvement"
as opposed to a racking system (although portable and removable), we would respectfully point
out that the area of the racking system (844 SF) is less than the excess area for this building
(i e pump/meter room and covered exterior entries - combined total of 1,256 SF) already
included in the parking counts and impact fee calculations
Given the above, we would respectfully conclude that the installation of this mezzanine racking
system should not require any site plan modifications for this particular building or this three
building project. Accordingly, we respectfully request that you provide us with a letter either
approving the proposed mezzanine racking system or providing a letter of no objection to such a
facility so that Parnell-Martin can proceed with the Building Permit process and install the
proposed mezzanine storage facilities in a timely manner

THIS AMENDED AND RESTATED ASSIGNMENT OF PALM BEACH COUNTY
ROAD IMPACT FEE CREDITS (the "Assignment") is made and en.tered into this_
day of January, 2001, by and between QUANTUM LIMITED PARTNERS, L TO , a Florida
limited partnership, whose address is 2500 Quantum Lakes Drive, #101, Boynton Beach,
Florida 33426 (hereinafter referred to as the "Assignor"), and GATEWAY BUSINESS
PARK, L.C., a Florida limited liability company, whose address is 2100 Park Central
Boulevard, North, Suite 900, Pompano Beach, Florida 33064, (hereinafter referred to as
the "Assignee"), provides as follows
WITNESSETH
WHEREAS, Quantum Associates, a Florida general partnership ("Quantum
Associates") was the developer of that certain planned industrial development commonly
known as Quantum Park PI D located in the City of Boynton Beach, Palm Beach
County, Florida, and
WHEREAS, in consideration for the construction of various road improvements,
Palm Beach County, a political subdivision of the State of Florida, pursuant to Section
10 1 K.1 of the Palm Beach County Unified Land Development Code, granted to
Quantum Associates certain road impact fee credits ("Credits") for utilization within
Quantum Park P I D , and
WHEREAS, Quantum Associates has previously assigned said Credits to
Assignor, and,
WHEREAS, Assignor is now desirous of transferring and assigning a portion of
the Credits to Assignee
NOW, THEREFORE, in consideration of the premises, Assignor hereby transfers
and assigns to Assignee that portion of Assignor's Credits equal to Ninety-Five Thousand
Eight Hundred Ninety-One and 07/100 Dollars ($95,891 07) for the specific use and
benefit of that certain parcel of land within Quantum Park PI D, more particularly
described in EXHIBIT "A" attached hereto (the "Property")
ASSIGNOR hereby covenants with the Assignee that Assignor is lawfully seized
of said Credits, that Assignor has good right and lawful authority to sell and convey said
Credits, and hereby warrants the title to said Credits and will defend the same against
the lawful claims of all persons claiming by, through or under said Assignor and none

matters. The request by Parnell-Martin involves the installation of an 844+/- square foot
mezzanine racking system in the non-air conditioned warehouse area of their lease space
premises at Gateway Business Center Building No 1
At Tenant's request, I am writing as authorized representative of Premier Gateway Center at
Quantum, LLP (formerly known as Quantum Business Park L.C ), the owner of Lots 32 through
38, Quantum Park PID, Plat No 6 - an approved industrial development containing three
buildings with a total area of approximately 336,050 square feet. I am respectfully requesting
that you reconsider the findings and recommendations included in your letter of April 30, 2002,
based upon the explanations contained herein, and provide us with either a letter of

With regard to the proposed mezzanine racking system, please be advised of the following
a. This is a portable/removable steel frame structure (with wood decking) that the Parnell-
Martin Companies purchased and used at their previous lease location - the cost of the
structure was reported to be in excess of $15,00000 This system is currently being
stored, in a dismantled condition, in an off-premises rented warehouse space for its
intended installation in this location At the time of lease termination, the mezzanine
storage system will be removed from the subject building in the same manner that all
racking systems are routinely removed at the end of the term of a lease,

area of the Parnell-Martin lease space and used solely for storage of materials (items for
sale/distribution) used in the normal course of Parnell-Martin's business,

would respectfully point out that racking systems, that don't require any zoning
consideration or approval, could (in composite total) cover a much more substantial area
of the warehouse as compared to the proposed 844 square foot system, and,
d This racking structure would be subject to review/approval by the building department
and be provided with lighting and fire protection so as to be in full compliance with all
applicable current Codes and requirements.
In terms of Building No 1, as you are aware on April 18, 2000, the City issued a Development
Order (NWSP-00-001) authorizing Site Plan Approval for the referenced project. On May 2,
2002, the City issued a Certificate of Completion for the base building construction of Building
No 1 at the subject property" an office/service industrial building containing a total building area
of approximately 142,202 square feet ("SF")
Please be advised that the reported gross area of the building (142,202 SF), as indicated on the
site plan approval submittal to the City, includes 416 SF located in the meter and fire pump
room, and 840 SF of exterior covered entry area in the seven front entrance ways to the
building, as well as the thickness of the exterior walls All parking calculations as well as all
permit fees and impact fees were paid based upon the gross area of the building (142,202 SF)
Therefore the actual net usable area of the building (140,946 SF) is actually 1,256 SF less than
the reported area, not even considering the fact that the thickness of the exterior walls are also
not usable area.
As such, even if the City was to determine that the proposed mezzanine racking system did not
qualify as a racking system, and (although portable and removable) must be considered as a
"building improvement", the area of the racking system (844 SF) is less than the excess area for
this building (i e pump/meter room and covered exterior entries - combined total of 1,256 SF)
already included in the parking counts and impact fee calculations
Given the above, we would respectfully conclude that the installation of this mezzanine racking
system should not require any site plan modifications for this building or this project. We
respectfully request that you provide us with a letter either approving the proposed mezzanine
racking system or providing a letter of no objection to such a facility so that Parnell-Martin can
proceed with the Building Permit process and install these storage facilities in a timely manner

GENERAL BUILDING LIMITATIONS
SECTION 501
GENERAL
501.1 Scope. Provisions of this thapter shall govern the
height and area of buildings.
SECTION 502
DEFINITIONS
For definitions, see Chapter 2.
SECTION 503
HEIGHT AND AREA
503.1 Application
503.1.1 For the purpose of this code, 'height" and 'area,
as applied to a building, have the meaning designated in
Chapter 2.
503.1.2 The height and area for buildings or structures of
the different types of construction shall be governed by the
intended occupancy or use of the building, as provided for
in this chapter and shall not exceed the limits set forth in
Table 500 except as modified in 503.2 and 503.3 and the
specific use provisions of this chapter. For the purpose of
this code, each part of a building or structure included
within fire walls shall be considered a separate building.
Exception. A building permitted to be unlimited in
area by 503 4 1 shall be permitted to have interior fire
walls.
503.1.3 A building heretofore erected shall not be extend-
ed to exceed the allowable floor area set forth in this chap-
ter governed by the occupancy and type of construction.
A building heretofore lawfully erected, which exceeds
such area, may be extended horizontally provided such
extension does not exceed the area prescribed and provid-
ed such extension is separated from the existing building
by a fire wall as set forth In 503 1.2.
503.2 Height modifications
503.2.1 Rooftop structures. Church spires, chimneys.
tanks and supports, aerial supports, parapet walls not over
4 ft (1219 mm) high, bulkheads and penthouses used sole-
ly to enclose stairways, tanks, elevator machinery or
shafts, or ventilation or air conditioning apparatus, need
not be considered In determining the highest point of the
building, provided that the highest point shall be taken to
be the highest pOInt of the roof of the highest penthouse
when the aggregate area of all penthouses and other roof
structures exceeds 1/3 of the area of the roof upon which
they stand. (See 1511)
FLORIDA BUILDING CODE - BUILDING
503.2.2 Parking under Group R. Where a one story
automobile parking garage, enclosed or open of Type I or
II construction, or open of Type III construction, with
grade entrance, is provided under a bUildIng of Group R
occupancy the number of stories to be used in determin-
ing the minimum type of construction may be measured
from the floor above such parking area. The number of
stories to be used in determining the height in stories In
accordance with 903 8 shall include the parking area as a
story The floor/ceiling assembly between the parking
garage and the Group R occupancy above shall comply
with the type of construction required for the parking
garage and shall also provide a fire resistance rating not
less than the occupancy separation required in 704 1 1
503.2.3 Mezzanines. A mezzanine shall not be counted as
a story when it meets the following requirements.
503.2.3.1 The construction of a mezzanine shall be
consistent with the type of materials and fire resistance
ratings required for the building in which it is con-
structed.
503.2.3.2 The total area of mezzanines within a room
shall not exceed 113 that of the room or space in which
they are located. Enclosed space under a mezzanine
shall not be included in a determination of the size of
the room or space in which the mezzanine is located.
503.2.3.3 All portions of a mezzanine shall be open and
unobstructed to the room in which it is located except
for walls not more than 42 inches (1067 mm) high,
columns and posts.
Exceptions:
1 Mezzanines or portions thereof need not be
open to the room in which they are located,
provided the occupant load of the aggregate
area of the enclosed space does not exceed 10
2. In sprinklered buildings, a mezzanine having
2 or more means of egress need not open into
the room in which it is located, if at least 1 of
the means of egress provides direct access to
an exit at the mezzanine level.
503.2.3.4 Means of egress shall be in accordance with

503.2.4 Basements. A basement of a building shall not
count as a story when applying Table 500 for allowable
building height, if the upper surface of the first floor above
such basement complies with all of the following:

This letter shall serve as our request for a Minor Site Plan Modification for the above
referenced project
We request this minor modification to allow for our installation of a storage mezzanine
within our premises as is shown on the attached four (4) sets of drawings.
This mezzanine will be used to store packaged water heaters, sinks, and other
miscellaneous small items for sale and distribution as part of our business as a
wholesale plumbing supplies distributor There will be no personnel occupying the
mezzanine and lighting and fire protection will be provided below the mezzanine as is
required by code
According to our architect, the mezzanine will be 844 square feet in size, which works
into the overall space calculations as follows
