abandonment ordinance - Packaging Concepts - Lot 47-8 Quantum
Jim, an abandonment ordinance was processed and approved on June 4th 2002 It was in connection with a major site
plan modification which got approved but never built and therefore expired A condition of the abandonment ordinance was
to establish a new replacement easement. This did not happen and therefore the ordinance for abandonment was not
recorded
What is the best way to reverse this action proactively rather than just filing it away until it becomes a problem or issue
when someone goes to subsequently repeat the process?

This is an item that was approved by the City Commission on June 4 2002. However the Ordinance specifically states
that final approval is based on the recording in the records of Palm Beach County a "replacement easement for a new
water main." As I recall, this is a condition that the applicant must comply with Patricia Tucker was following up on this
item and we checked it on a number of times and my last conversation with her was that she would advise me when this
condition had been complied We are still holding this Ordinance and the disclaimer which has not yet been recorded in
the Records of Palm Beach County
I hope this clarified the situation a little bit from our end Perhaps someone needs to get with the applicant to check on the
status of this item Please keep us advised

Dear Mike, Rosemarie, Janet and Dave
Please recall that the application for abandonment of this easement proposed a replacement easement for a new water
main to be constructed with the project. Unfortunately the ordinance abandoning the existing easement does not clearly
refer to the replacement easement.
It is critical that the existing water main remain in service until the new main is completed so as to provide sufficient fire
flow to the adjacent Safety Kleen property
One way we can protect the City's rights in this matter is to include a motion in the approval delaying the recording of the
abandonment until the new water main and easement are fully accepted In this way the 10' easement to be abandoned
remains the easement of record!
If this idea is not acceptable, then I suggest the ordinance be re-written to reflect the completion and acceptance of the
replacement water main and easement.
Please advise as to your decision
