The above referenced sIte plan was granted approval by the Boynton Beach CIty CommISSIOn on
Apnl 3, 200 I and IS currently scheduled to expIre on April 3 2002 ThIs letter IS to request a one
year time extenSIOn to the sIte plan approval as allowed for m Chapter 4, Section 5 of the zonmg
code
Durmg the process of assemblmg the constructIOn documents necessary to submIt for bUIldmg
permIts for thIS project, It came to the developer S attentIOn that an error m the tItle work for the
property resulted m the surveyor not locatmg an eXIstmg easement on the survey, and, therefore, It
was also not located on the sIte plan, landscape plan or pavmg and dramage plans WhICh were
approved. Due to thIS easement bemg m the area of the proposed expanSIOn tor the bUIldmg, It has
been necessary to submIt an easement abandonment and relocatIOn applIcatIOn to the CIty, WhICh
IS currently m process The property owner and theIr consultants have been dIlIgently workmg to
revIse the drawmgs, as well as obtammg the necessary Quantum Commumty Development Dlstnct
permIts to enable thIS project to begm constructIOn. The SIte plan, landscape plan and pavmg and
dram age plan wIll be submItted to the Zonmg DIVISIOn shortly to accommodate desIgn changes due
to the relocated easement and WIll be processed as a mmor modificatIOn to the approved plans.
The problem anses m the fact that the approval process for the abandonment WIll not be finalIzed
untIl the June 4 2002 City CommISSIOn meetmg and the site plan expIres on Apnl3 2002, thus the
reason for thIS tIme extensIOn request. Staff has mdIcated that thIS tIme extensIOn request WIll be
follO\vmg same approval schedule as the abandonment applIcatIon.
