RE. Quantum Overlay Dlstnct

On behalf of the Board of SupervIsors of the Quantum Commumty Development Dlstnct
(the "Dlstnct"), please accept thIS letter as the formal petItIon of the DIStrIct to the CIty
for the creatIon of a dependent dIstnct pursuant to the proVIsIOns of Chapter 189, Honda
Statutes. The boundarIes of the proposed dependent dlstnct would be co-termmus WIth
the boundarIes of the Quantum Park at Boynton Beach (the 'Park')
In support of thIS request, please consIder the followmg. The ongmal plan of the
Quantum Commumty Development Dlstnct contemplated the development of an
mdustnal and commercial park. However, the land use of the Dlstnct has changed over
tIme and reSIdentIal development has been permItted m portIons of the Dlstnct. ThIs has
created a 'mIxed use' sItuatIon that will soon result m a votmg dilemma.
Chapter 190, Honda Statutes proVIdes for the electIon of SupervIsors on the baSIS of one
vote per acre (or portIOn thereot) untIl 6 years have elapsed after the date of creatIon and
there are at least 250 qualIfied electors. Once these two condItIons are met, the Board of
SupervIsors begms to transItIOn qualIfied electors onto the Board.
The Dlstnct has surpassed the SIX year reqUIrement and most likely has m excess of 250
regIstered voters. ThIS IS now being evaluated. Assummg there are m excess of 250
regIstered voters, the electIon currently scheduled for this November WIll begm to phase
m reSIdents of the DIstnct onto the Board. ThIS process WIll contmue for the next several
years untIl all members of the Board of SupervIsors are popularly elected from the
reSIdentIal commumtIes only At that tIme, the commercial and mdustnal property
owners WIll have no representatIon on the Board.
Chapter 190, F S offers no optIOn to thIS converSIOn of representatIOn, therefore, the
Board of SupervIsors of the DIstnct has developed a plan that offers faIr representatIon
on the Board. If the CIty CommISSIOn would consIder creatmg an overlay dependent
dIstnct co-termmus WIth the boundanes of the eXIstmg Park as mdIcated m the enclosed
ordmance, the Board has agreed to convey all of ItS assets to the overlay dlstnct.

The overlay dlstnct would then be responsible for the operatIon and mamtenance of the
publIc mfrastructure prevIously owned by the Quantum CDD As mdIcated m the
enclosed draft ordmance, the Board of the overlay dIstnct would be made up of
representatIves of both the resIdentIal commumtIes and the non resIdentIal commumtIes.
The Quantum CDD would contmue to eXIst only for the levy each year of the non ad
valorem assessments reqUIred to retIre the outstandmg debt of the DIstnct. Once the debt
has been satIsfied, the Quantum CDD WIll have no reason to remam m eXIstence and
dIssolutIOn procedures could be mitIated.

accomplIsh the purposes stated herem. The CIty Attorney has prevIOusly revIewed thIS
proposed ordmance and If you like, I can forward the proposal ordmance and the
