Issue #1 Traffic Signals at Quantum Blvd/Gateway and Quantum Blvd/Congress
At the last meeting, it was suggested that I review the NOPC #12 file to obtain information on
traffic signal warrants and requirements for Quantum. If you will recall at the meeting, Mr. Gerlica
suggested that I review the file. I did.
NOPC #12 was approved by the City Commission on October 16, 2001. The NOPC was a major
change from office and industrial land uses on the Quantum pro to 'mixed use" that would allow
the construction of residential. The previous cap of 500 dwelling units of 500 units was raised to
1,000 units.
The traffic signal issue in 2001 was called out under condition #1 _
When warranted the developer and the existing occupants of Quantum Park will be responsible
for the cost of construction of traffic-actuated signals and the intersections of Quantum Boulevard
with Gateway and Congress Avenue. See attached memo from Jeff Livergood, Public Works
Director, dated August 29, 2001/revised October 4, 2001 located in Exhibit G."
The recommendation from page 3 of the October 4, 2001 memo from Jeff Livergood was as
follows:

It is very clear that traffic signals are either currently warranted, or will be warranted in the future
at both Gateway Boulevard and Congress Avenue. These signals will be necessary entirely
because of development in Quantum Park. Thus staff believes that the cost of constructing these
signals should be borne by future builders as well as by those tenants of the industrial park that
are presently generating traffic. It would not be appropriate to have the City of Boynton Beach pay
for the traffic signals when other capital improvements are either more important or have been
delayed in prior years awaiting funding.
If the City does not obtain surety for the installation of a traffic signal at this time, it will be virtually
impossible to assess the requirement for traffic signal construction to each individual that may
purchase mixed use lots from Quantum then subsequently develop them. The burden of traffic
signal construction should fall upon the developer of the whole rather than the individuals that
choose to acquire and develop lots in the future. Quantum could easily distribute the cost equally
to future buyers whereas the City could not. Likewise Quantum has significant control over the
property owners association and has the ability to initiate a special assessment of existing
properties for their share of the traffic signal construction.
Staff recommends that the developer and the existing occupants of Quantum Park be held
responsible for the cost of construction of traffic actuated signals at the intersections of

Based on the above, I recommend that the City Commission include the following basic condition
for NOPC #16 for traffic signals per my earlier memo dated July 31, 2006 to the City Commission:
I was pleased to see that the Planning and Development Board took note of the
traffic signal
situation at Quantum Boulevard/Gateway and Quantum Boulevard/Congress. I
recommend that if
the City Commission is going to favorably consider the application for the
additional 800 dwelling
units on the Quantum parcels that MFT Development, Inc. be responsible for
posting a letter of
credit in the amount of $440, 000 for a five-year period in a form approved by the
City. This
translates into $220,000 for each signal. In the event that traffic warrants are not
met in the five year
period (tested annually), the letter of credit can be released. If the warrants are
met, the traffic
signals should be installed and paid by MFT Development, Inc. If they wish to
assign this obligation
to successors in interest, this can be accommodated if the transfer of the
financial obligation is
approved by the City Commission.
I believe the City Commission should include the requirement for a letter of credit posted
by MFT Development, Inc. as outlined above as a surety for the two traffic signals. Staff
observed this In 2001, and the situation has not changed.
Issue #2 -Inclusion of the Transit Oriented Development Housing In NOPC #16
The developer has requested 800 additional dwelling units to the Quantum area. The developer
indicated at the last City Commission meeting that they would "allocate" or otherwise identify 400
units to the Tri-Rail parcel for a future Transit Oriented Oevelopment there. The petitioner, MFT
Oevelopment, Inc. does not own property at the Tri-Rail station. They must negotiate the
development with Tri-Rail and the RTA. What MFT does effectively control is the process by
which amendments to the Quantum PIO would be handled. In the past, these have been in the
form of NOPC's or notices of proposed changes. We are now up to #16. Because the legal
notice for NOPC #16 did not include the Tri-Rail parcel there must be a subsequent request. The
placement of 400 units potentially at the Tri-Rail site by the NOPC #16 allows MFT to be the
developer of choice as they have the units accounted for by approval of the City. They can do so
because the vested traffic counts for the development have been met. Unless Tri-Rail or the
County grant's a traffic concurrency exception area for the Tri-Rail site, the vested traffic counts
attributed to Quantum have value. At present, there is no official statement by Tri-Rail, Treasure
Coast Regional Planning or the County as to whether they will be considering extending a traffic
currency exemption area to transit oriented development (TOO) sites. If they do, the Quantum
vested traffic counts won't be of value to them. However, the main issue is the process by which
future NOPC's are processed. I believe that MFT Oevelopment Inc. effectively controls any future
NOPC applications for the Tri-Rail parcel even though they don't own it. For the, City's part, any
consideration for a TOO at this location should include a guarantee of a supply of affordable
housing in a manner that preserves these units in the future and shields them from real estate
speculation. So, the answer this question is that the TOO is officially not part of the NOPC #16.
MFT, I believe, effectively controls the future process for another NOPC/ORI amendment
specifically for the Tri-Rail site. The 400 non-Quantum new units proposed are available for the
TOO but cannot be specifically assigned to the TOO until there is a valid petition to convert the
Tri-Rai/ site to a TOO. Commission will need to condition approval of the NOpe to a maximum of
400 new units on the balance of Quantum and understand that the other 400 units are effectively
not allocated at this time. The second set of 400 units is essentially unallocated units with
nowhere to go unless a TOO is approved at the Tri-Rail site later. I believe Section 3 8 of the
draft ordinance effectively handles this by the following language:
"Of the 800 additional units approved pursuant to this Ordinance, 400 units shall be placed on
Lots 17, 52, 58, 102 and 103. II (Page 4 of draft ordinance in packet).

I was surprised to see this item on the agenda for August 1 st instead of August 15th, hence this short
memo. The reason the item is on the agenda for August 1 st is the need to have the documents
transmitted to the Florida Department of Community Affairs (DCA) by mid-August. Otherwise, our
customary application review period would have been deployed.
We have a situation where the P&D Board did not concur with a staff recommendation to deny the
applicant's petition. In essence, staff felt the conversion of non-residential land to residential land an
800 additional dwelling units in the 553 acre Quantum Development was not appropriate. The
developer has pointed out, without specifics, that their intent is to make a portion of these units
"affordable." In my opinion, this needs to be specified as part of any City approval of any additional
conversion of land to residential. This should include the number of units to be designated
affordable and the price point of the units.

At this point, the proposal of a "Transit Oriented Development" for up to 500 residential units is in
the planning stages. MFT Development Inc., the applicant in this petition has approached the RT A
and Tri-Rail to see if there is interest in partnering on a development using the air rights over the Tri-
Rail property. If there is progress on this proposal, it would take the form of another NOPC in the
future. As I understand it, MFT Development has vested development rights for related to traffic
concurrency, which would make them developer of choice should an agreement between MFT and
Tri-Rail and the RT A be negotiated. MFT could then either develop the units or transfer that right to
another developer. The main issue I see is the construction of a supply of affordable housing at this
location. In concept, it is a great idea that I support, however this proposal has nothing to do with the
current petition.

This has been discussed with Eugene. He is planning to provide the study at Congress and
Quantum Boulevard by the end of this year. The study at Quantum Boulevard and Gateway is
the topic of ongoing discussion as part of NOPC 16 as you will see below. The issue I have is
that Quantum Ltd Partners is willing to study this but makes no commitment to act on the
results of the study. It is their opinion that they are merely acting as the declarent and not the
developer. I found it interesting that Eugene is going to have the Quantum Park Property
Owners Association fund the traffic study at Congress and Quantum that the FOOT is
requesting as part of the ORI modifications. What role does the POA have with ORI
administration?
I have advised Eugene that I am unable to meet with him until Wednesday afternoon.

The QPPOA intends to contract with Pinder Troutman to perform the traffic signal warrant
analysis upon the Congress Avenue and Quantum Boulevard intersection, as requested by
FOOT. The analysis will be performed this fall, as recommended by Pinder Troutman, and the
report completed prior to the end of the year. This should be a none issue.
Please draft a substitute Condition of Approval as you outlined in the "alternate" below. If I
understand the three (3) goals you have listed correctly, they are appropriate and agreeable to
the NOPC 16 applicant.
Finally, I would like to meet with you again to discuss each issue, confirm my understanding

Thank you for your suggested modification to our Condition of Approval relating to traffic. As I
discussed at our meeting this morning, I am certainly open to any modification of this condition
that is acceptable to you and meets our City goals. As I noted, I believe that it is entirely
appropriate to evaluate any changes to access conditions onto Gateway Boulevard, a City
public street, as part of NOPC 16. This NOPC contemplates the removal of Quantum
Lakes Drive from the street network in the master development. Therefore, we must address
modified traffic access conditions onto Gateway Boulevard from the perspective of capacity
and safety. If the request to delete Quantum Lakes Drive, or any other platted roadway, from
the master plan and substitute same with mixed use development is withdrawn, and conditions
remain as currently platted, then our traffic concerns have no correlation to NOPC 16 and the
referenced condition of approval would be deleted.
I am willing to alter our Condition of Approval if you agree to provide a traffic study of the
intersection of Gateway Boulevard and Quantum Boulevard. This study should consider the
existing traffic volumes plus the potential traffic volumes that could be generated from all
vacant parcels that are the subject of your current application plus you should take into
consideration the revised traffic patterns from those parcels that are already improved.
As part of this study, you will provide a signal warrant analysis for the intersection of Gateway
Boulevard and Quantum Boulevard. As you are aware, the City has requested that the County
conduct a warrant analysis at this intersection to determine whether or not a Letter of Credit
(LOC) held by the City on behalf of DR Horton to ensure construction of a traffic signal at this
location should be drawn upon or returned. You have the option of waiting for this analysis to
be completed by the County or contracting for this work on your own, depending upon when
you desire approval of NOPC 16.
Should the County analysis find that a traffic signal is currently warranted at the intersection of
Gateway Boulevard and Quantum Boulevard, then you would not be required by the City to
further consider traffic signalization at this intersection as a condition of approval of NOPC 16.
The City will cause the signal to be constructed using the surety posted by DR Horton.
However, because your proposed deletion of Quantum Lakes Drive would place more demand
on the eastbound to southbound right turn movement on Gateway Boulevard at Quantum
Boulevard, I would ask that you evaluate the need for an eastbound right turn lane on Gateway
Boulevard at Quantum Boulevard, assuming that the existing right turn lane will become a
future third through lane. If this turn lane is warranted, then I would like for you to comment on
how you would intend to comply with this requirement.
Should the County traffic analysis determine that current conditions do not require the
installation of a traffic signal at the intersection of Gateway Boulevard and Quantum Drive,
then the City must return the LOC to DR Horton and the requirement for DR Horton to

construct the signal is removed. However, in this scenario, you must still conduct a separate
traffic analysis and consider the added traffic on Quantum Boulevard that will be
generated/relocated as a result of the elimination of Quantum Lakes Drive and development of
remaining parcels. This data should then be used to determine if a signal is warranted. If so
warranted, then I would appreciate your comments on how you intend to guarantee to the City
that the signal will be constructed. Furthermore, you must also consider the impact of the
eastbound to southbound turning movement as referenced in the paragraph above.
As an alternative....
I am willing to NOT require the above referenced items as a Condition of Approval of NOPC 16
if you would consider the following:
1. All traffic studies and comments referenced above will be incorporated, in some fashion, as
text into the Conditions of Approval of NOPC 16.
2. City approval of NOPC 16 will not be conditioned upon completion of these text items at this
time.
3. You, as applicant for NOPC 16, acknowledge as a Condition of Approval that these text
items shall constitute the minimum actions and responsibility on your part, or the part of a
future applicant, necessary to proceed with of any roadway abandonment(s) for Quantum
Lakes Drive and/or Quantum Boulevard that may occur in the future as a result of City
approval of NOPC 16.
Should you desire to proceed with this alternative, or some other variation of this concept,
then I will draft a Condition of Approval that incorporates these suggestions for your review.
On a separate note, the City Manager has requested that I ensure that you address the issues
raised to you in a letter dated June 26, 2006 from the Florida Department of Transportation.
This letter noted that you must submit to the State the traffic signal warrant studies for the
above referenced intersection and for the intersection of Quantum Boulevard and Congress
Avenue. This is a State requirement as part of the annual report for the Quantum Park ORI
that you must file. It appears that you have not complied with this requirement in the previous
two annual reports. Separate from this NOPC request, I would like to know how you intend to
address the State's requests in the referenced letter, particularly for the intersection of
Congress Avenue and Quantum Boulevard.
In summary, I am more than willing to modify our condition of approval to something that may
be less onerous to you. However, to do so, I need your thoughts on the suggestions I have
raised. I would be pleased to meet again if you so desire.

by the City of Boynton Beach to be provided by Palm Beach County. A traffic signal

Please review the attached letter from Treasure Coast and FOOT regarding the latest NOPC. The comments will need to
be incorporated into the staff report to Commission. Of particular note is the FOOT call for possible traffic signalization
needs. I believe that the developer needs to be tasked for a schedule and cost program
Finally, the Treasure Coast letter references a TOO at the Tri-Rail station. I had meetings with Eugene G. and County
Commissioner Koons and County Commissioner Newell on this topic.
The Commission is also supportive of this project.
Please give me a status report in two weeks as to how staff will be responding to the NOPC issues. When does this come
back to the Commission? Quintus needs to take the lead on this response. I know that Jeff has already had some
discussions with Quantum on the traffic signal issue.

In accordance with the requirements of Section 380.06(19), Florida Statutes. Council_
reviewed the "Notification of a Proposed Change to a ~ously Approved Developmem
of Regional Impact (DRI)" for the Quantum Park DRl dated May 17, 2006.
The proposed changes include: 1) revising the master site development plan; 2)
increasing residential units from 1,105 to 1,905, 3) designation ofland uses in loti 17. 52-
58, and 103 to Mixed Use; 4) revisions of notes 3 and 4 in the Master Site Development
Plan; and 5) elimination of parts of Quantum Lakes Drive and Quantum Boulevard.
Council has reviewed the information provided by the applicant and has detmmiDed the
proposed changes will not create additional regional impacts on regional resources 81'J.d
facilities in the area. At the same time, the City should be mindful of the trend of
conversion of its industrial/workplace land use base to residential use. Over the last
several years workplace land uses in the Southwest Congress Avenue corridor aad
Quantum. Park have been converted to residential, c-.bangblg the character of this area aod
reducing potential sites for workplace in the City At some point in the near future,
perhaps during the review of the City's comprehensive plan as part of the required EAR
process I the City should evaluate and come to some conclusion about its overall
workplace land use needs for the future.
As indicated above~ the proposed change would increase the number of residential units
allowed by 800 or 72 percent. By itself this change would constitute a substantial
deviation under Section 380.06(19)(b)9. F10rida Statutes. This finding would cause the

After: discussing the matter with the Department of Community Affairs, another option
for the City and the developer would be to consider the change as falling under Section
38006(19Xe)S.c. Florida Statutes. The Council and the Florida Depert:meDt of
Tmnsportation ba:ve not identified any Dew or additional regional impacts resulting from
the change and have no objections. If the City concludes the same, it could cert.Cnly
make a :finding under this section of the statute tba1 would allow the proposed change to
proceed without further DRI review
On another matter, Council has been working with the City, the County, the developer
end the SFRT A on creating a Transit Oriented Development (TOD) opportunity by
establishing the appropriate mix and quantity of land uses on the Tri-Rail station site.
Approximately 500 residential units and a mix of Donresidential uses would be required
fOT a successful TOO on this site. As part of this proposed change. the City is
encouraged to provide for the uses that are needed for the TOO, 01' receive some
assurances from the developer that he will support and authorize the City and SFRTA to
make the necessary changes to the development order at some point in the near future.
The Florida Dcparlment of Transportation has also made comments that should be
addressed as a condition of the City authorizing tbe proposed change (see attached letter
dated June 26, 2006).

In conclusion, we have no objection to this NOPC. However, a review of the 200512006 Annual Report ~ that
the applicant bas not submitted 1raffi.c signal warrmt :studies for the intersections of Qumtum. Boulevard with
Gateway Boulevard and Congress A value. as required by Ordinance No. 01-54. We recommend that 1he eppHcGt
comply with this Devclopm.cnt Order condition.

Notification of Proposed Change (NOPC) No. 16
As requested in your letter dated May 25,2006, the Department has reviewed the Quantum Park DRI NOPC No. 16.
The Quantum Park DRI is located north of the C-16 Canal, south ofHypoluxo Road, west of Interstate 95, and east of
Congress Avenue in the CIty of Boynton Beach. The DRI was ongmally approved on December 18, 1984 as a
mixed-use development. The current buildout date for the DRI IS December 18, 2014 The followmg table
summarizes the DRI's approved land uses and intensities to date:

In fins NOPC, the applicant proposes the followmg changes:
1 Increase the maXlIDum number ofresIdentlal umts wIthm the Mixed Use area from the currently approved
1,105 umts to 1,905 units, an mcrease of 800 dwellmg umts.
2. Re-desIgnate lots 17,52,58, and 103 from theIr currently approved land uses to Mixed Use. Lots 17 and 52
are currently approved for Office/Industrial w/Retail Sales. Lot 58 is currently designated as
Office/IndustrIal. No descriptIOn was prOVIded for Lot 103
3 ReVIse Notes on the Master Site Development Plan by removmg Notes 3 and 4, as shown m the prevIous
Development Order (DO) Number 15 Note 3 addressed the Total Vested Tnps for the DR!. Note 4 stated
that the buildmg heIght for Mixed Use areas was not to exceed 60 feet.
Note 3 was reported to have incorrectly stated the Total Vested trips as 63,752 ADT The tnp threshold
calculated in support of Amendment No 15, on December 1,2005, was stated to be 65,069 ADT
4 Abandon the remaining portions of Quantum Lakes Drive and Quantum Boulevard roadways located south
of Gateway Boulevard, and convert them to Lots 102 and 103 Change the land use designatIon of Lots 102
and 103 to Mixed Use.
The applIcant has mcluded a tnp generatIOn comparIson analYSIS between the origmal (ADA) and proposed land uses
for the Quantum Park DR!. The results of a trIp generatIon comparIson mmcated that the proposed development plan
would generate 1,138 fewer AM peak-hour trIpS and 856 fewer PM peak-hour trips than the ongmal development
plan.
In conclUSIOn, we have no objection to thIS NOPC However, a reVIew of the 2005/2006 Annual Report reveals that
the applIcant has not subnntted traffic sIgnal warrant studIes for the intersectIons of Quantum Boulevard WIth
Gateway Boulevard and Congress A venue, as required by Ordmance No 01-54 We recommend that the applicant
comply WIth this Development Order conditIOn.

Upon review of the Annual Report, the Department has the following comment:
1 Ordinance No. 01-54, Exhibit "e" (Revised Conditions of Approval 11/06/01), requires the
developer and existing occupants of Quantum Park to be responsible for the cost of construction
of traffic-actuated signals, when warranted, at the intersections of Quantum Boulevard with
Gateway Boulevard and Congress Avenue. Presently, neither intersection is signalized. To date~
no traffic signal warrant studies for the intersections of Quantum Boulevard with Gateway
Boulevard and Congress Avenue have been submitted for review We recommend that the
applicant submit traffic signal warrant studies for these intersections.
It should be noted that the Department made the same comment for the 2004-2005 Annual Report,
requesting the developer to submit traffic warrant studies for the two subject intersections. However, we
have not received response to our previous comments.
