A recent "Notification of a Proposed Change" (NOpc) was submitted on December 1. 2004 for
the above refeI~ced project. As part ofthis'review by the Treasure Coast Regional Pluming
Council, several comments regarding the sand pine scrub preserves were ofti=rcd. This response
will hopefully address some of the items that were previously addressed in 2001 that relate to the
maintenance of the 40 acres of SCIUb preserve associated with Quantum. Parle.
1 Fencing - Due to the recent stoIm events of2004, severa11arge 1rees had fallen OVtZ many
sections offence in both the southern (14 acre) md the northem (u acre) preserves. Effortsto
remove fallen trees have been completed and new sections of fen" inst3lled:in the southem
presuve. Over the past 2.S years and more fCQeIrtly (past L8 months), a new ret<<Ltion pond is
cumntly being CODStrueted in 34C and Trad 1 east of the northern preserve. Daring an onsite
visit in 200 1. the TCRPC suggested that additional fencing, security and increased eJtOtic control
should occur We di$cu$sed that new fencing would not be constnlr;teU \1Dtil the w;vI retention
pond is complc:te. Over the past 18 months of (lOnstruQtion, mnnerous sections ofnew .fence
have been installed due to off-road vehicular traffic. The new retention pond is about 6()0"
complete and the contractor will be submitting a new schedule to the engineer tor its oompletion.
We had decided that no buming C1t mechanical altetation of the site would be eonduded untn the
pond Wl!S complete and new fencing could be installed. We anticipate that this wotk should be
completed over the next 3 months.
2. The TCRPC has indicated that the entrance to the northern preserve should be cleaned 'Up of
debris and parldng spaces installed. This has been discussed on numerous oc:casroDS and it was
not required of the Development Order for this projoc:t. Quantum. Pade is not in a position to
allow local residents to utilize the preserve for passive recreation due to security measures,

fUture, but it was D.Ot a ~ent of the DO for this project. Future talks with the city as tbe
city park issue matures tnay lead to some cooperative ammganeDt depeDding on the use
p;monetcrs for this park site.
S. The DIU aM.Ual report will be mOIC inclusive of the management activities that have ~
over the past 12 months for this project.
We hope tbat this will help clarifY some of the outstandil'lg issues that have plagued this project
0V\'ll" the years. We hope to provide some management of the northem preserve this year in

In accordance with the requirements of Section 380.06(19), Florida Statutes, Council has
reviewed the "Notification of a Proposed Change to a Previously Approved Development
of Regional Impact (DRI)" for the Quantum Park DR! dated December 1, 2004
The proposed changes include: 1) increasing the maximum number of residential units
within the Mixed Use areas by 105 units, revising the allowable density from 1000 to
1105, and 2) increasing the maximum building height within the Mixed Use area to 60
feet. Council has reviewed the information provided by the applicant and has determined
the proposed changes will not create additional regional impacts on regional resources
and facilities in the area. At the same time, Council would like to offer the following
comments related to the management of the preservation areas on the project site:
· Management of the upland preserve areas on this project site has been an ongoing
issue. Recent repotts to OUt agency indicate the fence around the north preserve area
is broken do-wn and the boundaries of the preserve area are not well defined.. A
permanent sturdy fence should be placed around this preserve area, and signs should
be posted to prevent unauthorized use of the preserve.
. The entrance to the pre~erve areas should be cleaned-up and made attractive. There
are a large number of poles. on the ground by the road on the south side of the north
presetve. These poles have been there fOT years. The poles should be removed and a
well-defined entrance to the preserve area should be established. It is recommended
that several unpaved parking spaces be created, and that the preserve areas have
pedestrian-only entrances that allow the public to enter for passive recreation.

· The current level of preserve management activities appears to be inadequate. A
si&nificant effort should be made now to remove aU of the exotic pest plants that
occur within and along the edges of the preserve areas. Second, there should be an
increase in frequency of the regular mowing that occurs in the open portions of the
preserve areas. More frequent mowing would be beneficial for gopher tortoises and
other listed species. Finally, plans to bum portions of the preserve areas should
continue to be implemented. TIlls will increase species diversity and improve the
ecological condition of the scrub communities.
· Development of the City Park on the west side of the north scrub preserve should
incorporate plans that complement the adjacent preserve area. Native species should
be protected and exotic species should be removed from the park site in order to help
protect the scrub preserve. Also, a boardwalk and trail should originate in the city
park and loop through the adjacent scrub preserve. Plans for such a boardwalk were
included in the January 1988 version of the scrub preserve management plan.
· The DRl annual report should include a description of recent management activitic:s
in the upland preserve areas. Currently, details of the management activities are not
required to be presented in the annual report. However, it would be helpful to all
parties if more details were provided. This will help the city monitor consistency with
the management plan and Development Order As part of this NOpe. it is
recommended that the City include a requirement in the Development Order that a
description of the preserve area management activities be included in the armual
report.
Council also reviewed the NOpe to determine if any unreviewed traffic impacts would
occur on the regional roadway system as a result of the change. The application includes
a traffic analysis prepared. by Pinder Troutman Consulting, Inc. which provides trip
generation for both the ADA approved uses and the proposed uses. Based on the
information included in the analysis, the proposed uses have the potential to reduce gross
trip generation. However, the following information is necessary in order to justify the
traffic analysis included in the application:
1 Copy of tbe original approved development order and master plan presenting
approved uses.
2. Copy of the original approved traffic study
3 Copy of the current proposed development order and master plan presenting
proposed land uses.
The Florida Department of Transportation has also made comments (see attached letter
dated December 29,2004).

Finally, the South Florida RegIonal Transportation Authority (SFRTA) has inquired
about building "transit onented development" (TOD) around its current rail station on
Parcel 90 Council's Strategic Regional Policy Plan advocates a similar strategy for the
site. In fact, a theoretical TOD plan for Parcel 90 is adopted in the Regional Plan (see
attached). Council and the SFRTA would like the opportunity to meet with the City and
the master developer of Quantum Park to come up with a sttategy and plan for
accommodating a TOD on Parcel 90. Council staff will contact you shortly on this
matter

Dear Mr Rumpf:
In accordance with the requirements of Section 380.06(19), Florida Statutes, Council has
reviewed the "Notification of a Proposed Change to a Previously Approved Development
of Regional Impact (DRI)" for the Quantum Park DR! dated December 1, 2004
The proposed changes include. 1) increasing the maximum number of residential units
within the Mixed Use areas by 105 units, revising the allowable density from 1000 to
1105, and 2) increasing the maximum building height within the Mixed Use area to 60
feet. Council bas reviewed the information provided by the applicant and has determined
the proposed changes will not create additional regional impacts on regional resources
and facilities in the area. At the same time, Council would like to offer the following
comments related to the management of the preservation areas on the project site:

Management of the upland preserve areas on this pro] ect site has been an ongoing
issue. Recent reports to our agency indicate the fence around the north preserve area
is broken down and the boundaries of the preserve area are not well defined. A
permanent sturdy fence should be placed around this preserve area, and signs should
be posted to prevent unauthorized use of the preserve.
.
The entrance to the pre~erve areas should be cleaned-up and made attractive. There
are a large number of poles. on the ground by the road on the south side of the north
preserve. These poles have been there for years. The poles should be removed and a
well-defined entrance to the preserve area should be established. It is recommended
that several unpaved parking spaces be created, and that the preserve areas have
pedestrian~only entrances that allow the public to enter for passive recreation,

· The current level of preserve management activities appears to be inadequate. A
significant effort should be made now to remove all of the exotic pest plants that
occur within and along the edges of the preserve areas. Second, there should be an
increase in frequency of the regular mowing that occurs in the open portions of the
preserve areas. More frequent mowing would be beneficial for gopher tortoises and
other hsted species. Finally, plans to bum. portions of the preserve areas should
continue to be implemented. Tl:us will increase species diversity and improve the
ecological condition of the scrub communities.
· Development of the City Park on the west side of the north scrub preserve should
incorporate plans that complement the adjacent preserve area. Native species should
be protected and exotic species should be removed from the park site in order to help
protect the scrub preserve, Also, a boardwalk and trail should originate in the city
park and loop through the adjacent scrub pre8en-e. Plans for such a boardwalk were
included in the January 1988 version of the scrub preserve management plan.
· The DRI annual report should include a description of recent management activities
in the upland preserve areas. Currently, details of the management activities are not
required to be presented in the annual report. However, it would be helpful to all
parties if more details were provided. This will help the city monitor consistency with
the management plan and Development Order M part of this NOpe. it is
recommended that the City include a requirement in the Development Order that a
description of the preserve area management activities be included in the annual
report,
Council also reviewed the NOpe to determine if any unreviewed traffic impacts would
occur on the regional roadway system as a result of the change. The application includes
a traffic analysis prepared by Pinder Troutman Consulting, Inc. which provides trip
generation for both the ADA approved uses and the proposed uses. Based on the
information included in the analysist the proposed uses have the potential to reduce gross
trip generation. However, the following information is necessary in order to justify the
traffic analysis included in the application:
I Copy of the original approved development order and master plan presenting
approved uses.
2. Copy of the original approved traffic study
3 Copy of the current proposed development order and master plan presenting
proposed land uses.
The Florida Department of Transportation has also made comments (see attached letter
dated December 29,2004).

Finally, the South Florida RegIonal Transportation Authority (SFRTA) has inquired
about building "transit onented development" (rOD) around its current rail station on
Parcel90 Council's Strategic Regional Policy Plan advocates a similar strategy for the
site. In fact. a theoretical TOD plan for Parcel 90 is adopted in the Regional Plan (see
attached). COWlcil and tbe SFRT A would like the opportunity to meet with the City and
the master developer of Quantum Park to come up with a strategy and plan for
accommodating a TOO on Parcel 90 Council staff will contact you shortly on this
matter

The Department has reviewed the NOPC and has the following comments:

Condition 44. since the 2000/200) annual report. The annual report enables the reviewing agencies to
detcrtniDe if the DO conditions have been satisfied. In particular, the Department is conCCl'l)(')d if Condition
26, in which. the applicant is required to contribute funds if the extema1 ptOject trips exceed 15,000 per day,
has been satisfied. Additionally, Condition 28 requires the applicant to monitor traffic generation ammally
after development of 132 acres. The ammal report should also consist of information as to what bas been
built and the associated tnps generated, and what is remaining to date as pet the epproveddevelopmerrt plan.
2. The Department is unable to dc:t:ermine the buildout date for this DRl. The applicant should provide
information of the DRI's build out date. If no buUdout date can be determined. we recommend one be

indicates proposed retail of 728,768 square feet. while the Substantial Deviation Chart shows 675,168
square feet of retail, and the Traffic Analysis shows 457)40 square feet of retail. The applicant should

In accordance wIth the reqUIrements of SectIon 380 06(19), Flonda Statutes, CouncIl has
revIewed the "NotIficatIon of a Proposed Change to a PrevIOusly Approved Development
of RegIOnal Impact (DRI)" for the Quantum Park DRI dated December 1,2004
The proposed changes mclude 1) mcreasmg the maxImum number of resIdentIal umts
wlthm the Mixed Use areas by 105 umts, revlSlng the allowable densIty from 1000 to
1105, and 2) mcreasmg the maXImum bUIldmg heIght WIthin the Mixed Use area to 60
feet. CouncIl has revIewed the mformatIOn provided by the applIcant and has determmed
the proposed changes WIll not create addItIonal regIOnal Impacts on regIOnal resources
and facIlItIes m the area. At the same tIme, CouncIl would lIke to offer the followmg
comments related to the management of the preservatIon areas on the project SIte
· Management of the upland preserve areas on thIS project SIte has been an ongomg
Issue. Recent reports to our agency mdlcate the fence around the north preserve area
IS broken down and the boundarIes of the preserve area are not well defined. A
permanent sturdy fence should be placed around thIS preserve area, and SIgns should
be posted to prevent unauthonzed use of the preserve
· The entrance to the preserve areas should be cleaned-up and made attractIve. There
are a large number of poles on the ground by the road on the south SIde of the north
preserve. These poles have been there for years. The poles should be removed and a
well-defined entrance to the preserve area should be establIshed. It IS recommended
that several unpaved parkmg spaces be created, and that the preserve areas have
pedestnan-only entrances that allow the publIc to enter for passIve recreatIOn.

· The current level of preserve management actIvIties appears to be Inadequate. A
sIgmficant effort should be made now to remove all of the exotIc pest plants that
occur WIthIn and along the edges of the preserve areas. Second, there should be an
Increase In frequency of the regular mowIng that occurs In the open portIOns of the
preserve areas. More frequent mowing would be beneficIal for gopher tortoIses and
other lIsted speCIes. Fmally, plans to burn portIOns of the preserve areas should
continue to be Implemented. ThIS WIll mcrease speCIes dIversity and improve the
ecologIcal condItion of the scrub commumtIes.
. Development of the CIty Park on the west SIde of the north scrub preserve should
Incorporate plans that complement the adjacent preserve area. NatIve specIes should
be protected and exotIc speCIes should be removed from the park SIte m order to help
protect the scrub preserve Also, a boardwalk and trail should ongInate m the CIty
park and loop through the adjacent scrub preserve. Plans for such a boardwalk were
Included m the January 1988 verSIOn of the scrub preserve management plan.
. The DR! annual report should include a description of recent management activItIes
m the upland preserve areas, Currently, details of the management actIvities are not
required to be presented m the annual report. However, It would be helpful to all
partIes If more details were provIded. ThIS wIll help the CIty momtor consIstency WIth
the management plan and Development Order As part of this NOPC, It IS
recommended that the CIty mclude a reqUIrement m the Development Order that a
descnption of the preserve area management actIvIties be mcluded m the annual
report.
CouncIl also revIewed the NOPC to determme If any unrevlewed traffic Impacts would
occur on the regIOnal roadway system as a result of the change. The applicatIOn includes
a traffic analysIs prepared by PInder Troutman Consultmg, Inc. whIch prOVIdes tnp
generation for both the ADA approved uses and the proposed uses. Based on the
mformatIOn mcluded In the analYSIS, the proposed uses have the potential to reduce gross
tnp generation. However, the followmg mformatIOn IS necessary m order to justify the
traffic analYSIS mcluded In the applIcatIOn.

FInally, the South FlorIda RegIOnal TransportatIOn AuthorIty (SFRTA) has InqUIred
about bUIldmg "transIt orIented development" (TOD) around ItS current raIl statIon on
Parcel 90 COunCIl'S StrategIc RegIonal PolIcy Plan advocates a SImIlar strategy for the
sIte. In fact, a theoretIcal TOD plan for Parcel 90 IS adopted m the RegIOnal Plan (see
attached) CouncIl and the SFRTA would like the OppOrtunIty to meet WIth the CIty and
the master developer of Quantum Park to come up WIth a strategy and plan for
accommodatmg a TOD on Parcel 90 CouncIl staff wIll contact you shortly on thIS

Consulting Inc., and other documents presented for review. We acknowledge upon
completion of the staff review by the City, the TCRPC, the DCA and the Palm Beach
County Traffic Division and upon completion of the Public Hearing additional
information or documents may be requested to further provide the clear and
convincing evidence necessary for a determination of no substantial deviation. We
acknowledge this comment shall remain a condition of Approval throughout the Public

6 HeIght IS not a charactenstIc of the DRI of Master Plan. HeIght limItatIons are
located wIthm the Planned Industnal DIstnct (PID). Therefore, the heIght request
will not be addressed m the NOPC If a change IS proposed to the height
hmItatIon, a Code ReVIew (CDRV) request, justIfication and reVIew fee must be
submItted to amend the PID regulatIons.
RESPONSE. A change is proposed to the height limitations within the Quantum PID.
A Code Review (CDRV) request, justification and review fee shall be submitted for
consideration to amend the PID regulations. We acknowledge the height request will
not be addressed as part of the NOPC, the DRI approval or the Master Plan
Amendment. We respectfully request this comment be deleted.

DEVELOPMENT OF REGIONAL IMPACT (DRI)
SUBSECTION 380.06(19), FLORIDA STATUES
Subsection 380.06(19), Florida Statues, requires that submittal of a proposed
change to a previously approved DRI be made to the local government, the regional
planning agency, and the state land planning agency according to this form.

Development of RegIOnal Impact in accordance With SubsectIon 38006(19),
Flonda Statues. In support thereof, I submIt the followmg mformatlOn
concerning the Quantum Park Development, wluch information is true and
correct to the best of my knowledge. I have submitted today, under separate

areas of the Park IS proposed to be Increased by 105 umts, reVISIng
the maXImum allowable from 1000 to 1105 umts.

The maximum heIght wIthIn the Mixed Use area of the Park is
proposed to be Increased to a total maxImum heIght of 60 feet.

mOVIe theater complex.

1 Pursuant to Chapter 380 06(19)(e) 5,c, the applIcation for a proposed change is
presumed to be a substantial deviation. TIns presumption may be rebutted by
clear and convmcmg eVldence.
RESPONSE. Clear and convincing evidence is provided within the application, the
responses to these staff comments, the statements provided by Pinder Troutman
Consulting Inc., and other documents presented for review. We acknowledge upon
completion of the staff review by the City, the TCRPC, the DCA and the Palm Beach
County Traffic Division and upon completion of the Public Hearing additional
information or documents may be requested to further provide the clear and
convincing evidence necessary for a determination of no substantial deviation. We
acknowledge this comment shall remain a condition of Approval throughout the Public
Hearing process. This condition shall be satisfied upon determination by the City
Commission that the NOPC is not a substantial deviation.

2. Provide notice of concurrency (Traffic Performance Standards Review) from
Palm Beach County Traffic Engtneering.
RESPONSE. The NOPC application has been submitted to the Palm Beach County
Traffic Engineering Division for review. A letter from the traffic division-stating
conformance with the Palm Beach County Traffic Performance Standards shall be
provided upon receipt We acknowledge this comment shall remain a Condition of
Approval until such time as the aforementioned letter is provided. At that time, the
Condition shall be satisfied.

Comment:
3 Provide notice of school concurrency from Palm Beach County School Board for
an additIonal 105 residentIal dwelling umts bemg requested.
RESPONSE. A letter from the Palm Beach School District stating conformance with
the Palm Beach County school concurrency standards shall be provided upon receipt.
We acknowledge this comment shall remain a Condition of Approval until such time as
the aforementioned notice is provided. At that time, the Condition shall be satisfied.

4 The Substantial DeviatIon Determination Chart (page 3) does not reflect the
addition of Lots 81 & 82 to the G & I land use in NOPC #14 in October of 2004
RESPONSE. Page 3 of the chart has been revised to include a note about the NOpe
14 approval regarding Lots 81 and 82. Please note the acreage reportedfor G & I and
the proposed change from Amendment No. 14 has not been revised and is reported
correctly. A revised Substantial Deviation Chart is attached reflecting the responses
contained herein.

5 Within the NOPC there are the following discrepancies.
. Section 5.2. Proposes an increase m dwellIng units Within the MU
category from 1000 to 1105
. Section 13.a.2, Proposes a total of 1080 dwelling units,
. Section 5,3, Proposes a maximum height in MU of 60 feet.
. Section 13.a,2. Proposes a maximum height in MU of 65 feet.
These conflicts need to be corrected.
RESPONSE. The NOPC Application, Section I3.a.2 has been revised to be consistent
with the quantities shown in Section 5.2 and 5.3, thus resolving the conflict.

Comment:
6. Height IS not a charactenstic of the DR! of Master Plan. HeIght limitations are
located wItmn the Planned Industrial Dlstnct (Pill). Therefore, the height request
will not be addressed m the NOPC. If a change is proposed to the height
limitation, a Code Review (CDRV) request, justIfication and review fee must be
submItted to amend the Pill regulatIons.
RESPONSE. A change is proposed to the height limitations within the Quantum PID.
A Code Review (CDRV) request, justification and review fee shall be submitted for
consideration to amend the PID regulations. We acknowledge the height request will
not be addressed as part of the NOPC, the DR! approval or the Master Plan
Amendment. We respectfully request this comment be deleted.

Comment:
7 The applicant is asked to acknowledge that the City is currently in htIgation
regarding heights exceedmg 45 feet.
RESPONSE. In our response to Comment No. 6 above, we acknowledged the height
request would not be addressed as part of the NOPe, the DR! approval or the Master
Plan Amendment. An acknowledgement regarding the City and the height limitation
litigation shall be appropriately addressed as part of the CDRV request and
consideration. We respectfully request this comment be deleted.

mcreases the number of residential umts and building maximum
allowable height and ehnunates the once proposed 4,OOO-seat
mOVie theater complex.

traffic generation, or building areas established by the current
development order The revised master site development plan and
supportmg traffic statement demonstrate the proposed additional
residential units will not generate any additional traffic and thus
will not create any additional regIOnal impact. The additional

ehmination of the previously mcluded 4000-seat movie theater
complex.

As requested m your letter of April 3, 1998, we have revIewed our files related to the referenced
DR! and find that certam Development Order (DO) commItments remam outstandmg.
The latest correspondence WhICh we have on record related to thIS DR! IS dated March 8, 1994
(copy attached). It IS a letter from the Boynton Beach CIty Manger to Melvm Simon &
ASSOCiates Inc, as a representatIve of the developer The letter requests that the partIes be
brought back together for closure on Issues WhICh relate to DO condItIons 26 and 27 These
conditIons mvolve contributIOns of $900,000 each (total of$I.8 MillIon) related to NW 22nd
Avenue mterchange WIth 1-95 ThiS final meetmg has not been held and, SInce we beheve that
the Issues described below remaIn unresolved, we suggest that you arrange such a meetmg.
In a letter dated June 28, 1993, (copy attached), we stated that FDOT would accept the
documented cost of the engIneenng deSIgn of the interchange (approxImately $971,000) which
was made by the developer on behalf of the proJect. We further stated that we would consIder
the value ofnght-of-way WIthIn the hmlted access lIne ofI-95 m excess of the three acres
reqUIred by the DO In summary, we expected the developer to pay the difference between the
total $ 1.8 million contribution required by both DO condItIOns 26 and 27 and the calcqJ,ated
credIt for the deSIgn and nght-of-way It appears that, SInce then, the developer has assumed that
the contribution described above relates to ConditIon 27 of the DO Condition 27 requites the
developer to contribute $900,000, In excess of any contributIon made pursuant to CondItion 26,
for rIght-of-way acqUISItIon and constructIon of the NW 22nd Ave Interchange. ConditIon 26
reqUIred a payment of $900,000 once the tnp threshold of 15,000 external tnps has been
exceeded by the proJect.

SUBSECTION 380.06(19), FLORIDA STATUES
Subsection 380.06(19), Florida Statues, requires that submittal of a proposed
change to a previously approved DRI be made to the local government, the regional
planning agency, and the state land planning agency according to this form.

5.2 Mixed Use eMU) Land DesIgnation - MaxImum Residential Units.
The maximum number of residential umts within the Mixed Use
areas of the Park IS proposed to be increased by 105 units, revismg
the maximum allowable from 1000 to 1105 units,
5.3 Mixed Use (MU) Land Designation - Maximum Buildmg Height:
The maximum heIght within the Mixed Use area of the Park is
proposed to be mcreased to a total maximum height of 60 feet.
The maxunum heIght WIthtn other land use designations WIth in
the Quantum Park DR! shall remain unchanged.
5 4 The attached Quantum Park Master Site Development Plan,
Amendment No. 15, dated November 2004, Quantum Limited
Partners, LID Drawing No. 45-43-17-03, Sheet 1 of 1, indicates
