Dear Mr Gerlica
On Friday, November 14, 2001 I faxed you a copy of the attached letter from The Florida Department
of Transportation (FDOT) dated December 7, 2001 As the letter indicates, the FDOT is objecting to
the Development Order for Quantum NOPC Amendment #12 based on a condition which they
communicated to the Department of Community Affairs and the Treasure Coast Regional Planning
Council during the review process for Amendment #12 The City of Boynton Beach was not formally
notified by the FDOT of this condition As you recall, you provided a copy of the letter to staff prior to
the second reading of the adoption ordinance The Development Ordinance No 01-054 did not
include the FDOT condition
Staff discussed with Jim Cherof, the City Attorney how best to accommodate the FDOT condition
Since the Quantum lakes Drive road closure is imminent Mr Cherof recommends that the FDOT
condition be required as a condition of the road closure

As requested m your letter dated May 18, 2001, the Department has revIewed the Quantum Park
Development of RegIOnal Impact (DRI) Amended Development Order (ADO). The Department
objects the approval of the ADO
The Quantum Park DRI is located north of the C-16 Canal, south of Hypoluxo Road, west of
Interstate 95, and east of Congress Avenue m the CIty of Boynton Beach. The Quantum Park DRI
was ongmally approved on December 18, 1984 as a mIxed-use development. Through amendments
the development order now approves the followmg land uses commercIal, mdustnal,
government/institutIOnal, office, recreatIOn and hotel
ThIS ADO mcorporates the proposed changes of the prevIOUS NotIficatIOn of Proposed Change
(NOPC) that mclude the modIficatIOn of uses on vanous parcels (FDOT letter to DCA - dated
September 4, 2001) The changes are as follows
. ModIfymg Lots 7, 8, 9, 10, and 11 from Office/lndustna1 to Mixed Use, whIch mcludes
office, commercIal, and reSIdential uses. ThIS change decreases the Industnal Land Use from
2,275,354 square feet to 1,900,000 square feet.
. ModIfymg Lots 23,24,25,26,27,28,29,30 and 31 from Office/Industnal to MIxed Use,
whIch mcludes office, commercIal, and reSIdential uses. ThIS change decreases the Office
Land Use from 798,772 square feet to 725,850 square feet.

As stated m the NOPC, the Department mamtams the followmg:
· The reconfiguratIOn of Quantum Lakes Dnve results m redIstributed traffic volumes to the
mtersectIOn of Quantum Boulevard and Gateway Boulevard. The mtersectIOn analysIs that
was provIded WIth the NOPC mdIcates that the mcreased volumes will cause the mtersectIOn
to fail unless the northbound and southbound approaches are re-stnped from a smgle left-turn
lane WIth dual through lanes to a smgle left-turn, a smgle through lane, and a smgle nght-turn
lane. After the re-stnpmg, the mtersectIOn operates below the cntIcal volume level. The
applIcant should speCIfy the party responsible for the restnpmg Improvement to current
acceptable standards and mcorporate the Improvement as CondItIOn m the Amended
Development Order pnor to the closure of Quantum Lakes Dnve.
Due to the lack of the reqUired condItIon to mItIgate the Impact of the proposed change for the
Quantum Park DR!, the Department objects the approval oftlus ADO The applIcant should prOVIde

The following is my attempt to address the COA's as they relate to the approval of Mixed Use for Lots
7-11 and 23-31
1 The additional 500 residential units requested in the NOPC Amendment #12 are subject to the
City Commission approval of the Mixed Use (MU) designation for Lots 7-11 and 23-31
2 The Mixed Use designation for Lots 7-11 and 23-31 is contingent upon restricting residential
development to fee simple units not to include rental apartments or congregate care/living
facilities
Please note that I have left out any reference to the Excel team recommendation regarding fee simple
unit with an appropriate price point. I was not present at the discussion regarding this item and
have no idea what that means or how it could be enforced Please review and revise as necessary

I spoke with Jim Cherof this morning He suggested that we prepare a Condition of Approval regarding the restrictions for
Lots 7-11 and 23-31 He informed me that he has contacted David Norris regarding this condition and that it would be
required The following is my attempt to address the issue
1 The additional 500 residential units requested in the NOPC Amendment #12 are subject to the City Commission
approval of the Mixed Use (MU) designation for Lots 7-11 and 23-31
2 The Mixed Use designation for Lots 7-11 and 23-31 is contingent upon restricting residential development to fee simple
units not to include rental apartments or congregate care/living facilities
The only problem I have is the interpretation of what a fee simple unit with an appropriate price point is Any clues? That
statement was included in the Excel recommendation I have left it out of condition #2 because I don't understand it or how
it could be enforced
Jim wants me to email him the recommended comments when ready Please review and comment.

needs to be better coordination between the budget and the bid Was the Galaxy project a 2000-01 project that did
not go? I could not sign off on this one at this time

Impact (DR!) Notification of Proposed Change (NOPC)
The Quantum Park DR! was onginally approved on December 18, 1984 as a :mu(:ed-use
development. Through amendments the development order now approves the following land uses.
commercIal, industrial, government/instltutlOnal, office, recreation and hotel. I

In this NOPC (#12), the applicant proposes reviSIOns to the DRI Master Plan to create a:mlxed-use
development that mcludes office, commerCial, and residentIal uses. The appl1cant has p~oposed the
followmg changes to the Master Plan.
. Modlfymg Lots 7, 8, 9, 10, and 11 from Office/Industnal to Mixed Use, which includes
office, commercIal, and resIdentlal uses. This change decreases the Industrial Larid Use from
2,275,354 square feet to 1,900,000 square feet. I
. ModIfyIng Lots 23, 24, 25, 26, 27, 28, 29, 30 and 31 from Office/Industnal to MIXed Use,
which mcIudes office, commercial, and residential uses. This change decrease~ the Office
Land Use from 798,772 square feet to 725,850 square feet.

The reconfiguratlOn of Quantum Lakes Dnve by closing the segment from: Quantum
Boulevard to Gateway Boulevard resultmg In addItIOnal developable land to be !?ubdlV1ded

The Department offers the following comments

The change in resIdenttal development from 500 to 1,000 homes that was included in the
substantIal deVlabon detem:unahon chart was not described in the request for thb NOPC.
The reconfiguration of Quantum Lakes Dnve results in redistributed traffic volJmes to the
mtersection of Quantmn Boulevard and Gateway Boulevard. The intersectIon arlalysis that
was provided with the Nope mdicates that the Increased volumes will cause the futersectIon
to fail unless the northbound and southbound approaches are re-striped from a sin~e left.tum
lane with dual through lanes to a single left-turn, a smgle through lane, and a smgly righHum
lane. After the re-striping, the intersect10n operates below the critical volume level. The
applicant should speclfy the party responsible for the restnpmg improvementito current
acceptable standards and mcorporate the improvement as Condition in the! Amended
Development Order pnor to the closure of Quantum Lakes Dave. I

In accordance WIth ComprehensIve Plan PolIcy 8.22 1, the CIty IS to notIfy the Palm Beach
County School DIstnct of all mcommg applIcatIOns for housmg developments that exceed 20 dwellmg
umts. The CIty IS currently processmg an applIcatIon for an amendment to the Quantum Park DR!
Development Order, wluch meets tlus cntenon.
Quantum Park of Commerce IS located on the west SIde of 1-95, between Miner Road extended
and the Boynton Canal (C-16) ThIS amendment proposes to change the approved uses on 14 lots
totalmg 23.26 acres of the Quantum Park Master Plan, to allow for a "Mixed Use" deSIgnatIOn.
Under the proposed change, the Mixed Use category mcludes an addItIon of 500 multI-famIly
reSIdentIal dwellmg umts, WIth an estImate of 910 reSIdents. The current Master Plan allows for 500
dwellmg umts WhICh were approved WIth Amendment #10 last year

Comments.
1 Lots 7 thru 11, and Lots 23 thru 31, located on Quantum Boulevard (a total of 14
lots) were the subject of Quantum Park Amendment #11 (MPMD 00-0007) to
whIch we responded to in Utihtles Department Memorandum #01-012, dated
January 11, 2001 To recapItulate those comments, we stated that With the
onginal DR! for the total park deSIgnated for Commercial, Industnal, Office, or a
combmatIOn of Office and Industnal, and/or Office, Industnal and Commercial,
both the water and wastewater systems to support these type of uses was deSIgned
and constructed for those antlcIpated uses. Four (4) lift stations were configured
to handle the wastewater generatIOn antlcIpated m the SSO-acre park.
RESPONSE. Comment noted. This comment does not contain a specific question or

2. As preVIOusly stated, the propose reVISIon to the land use to "Mixed Use (MU)" to
include Office, Commercial and ReSIdential uses could tax the utlhty support

get transferred. The partlalletter from SFWMD (unSIgned) does not mdIcate that
the dry retentlon of Lot 34-C IS no longer reqUIred, nor has the "As-Built Master
Dramage Plan" from the engineer-of-record ROSSI and MalavasI Engmeers, Inc.,

documentatlon to substantlate that the apphcant's request for land use conversion.
RESPONSE. The following is the demonstration that Lot 34-C is not needed as a dry
retention area and as being unnecessary was not transferred to any other lot or
location.

Prior to 1987 tile area known as Lot 34-C was sllown on tile Master Development Plan
as a Detention Area and was part of tile suiface water management system included in
tile SFWMD Conceptual Approval.
In 1987 tile SFWMD suiface water management permit was modified. Tile
modification eliminated tile Lot 34-C area as a detention or retention area, added a
water management tract, combined tllree drainage basins into two and revised tile
stage/storage assumptions among otller modifications.
Tile master development plan continued to erroneously sllow the area of Lot 34-C as a
detention area until Master Plan Amendment No.9, wilen tile erroneous label was
removed.
On June 30, 1988 Quantum Park Plat No.3 was recorded in tile official records of
Palm Beacll County following review and approval by tile SFWMD, tile LWDD and
tile City of Boynton Beach. The plat created Lot 34-C unencumbered by any
dedication or reservation as a detention or retention area.
Tile modified Master Drainage Plan as approved by tile LWDD is submitted in support
of tile above demonstration. TIlis drawing was recovered from tile L WDD, as tile City
of Boynton Beach Utility or Engineering Departments could not produce a single
drainage record drawing wilen requested.
Tile primary suiface water management system was subsequently constructed along
witll tile roadways and lot areas.
An engineer's completion statement was submitted to tile SFWMD along witll tile
requisite control structure record data after tile completion of tile construction of tile
primary suiface water management system. Tile engineer states tile system was
constructed in substantial conformance with the approved construction drawings and
ti,e SFWMD permit. Tile project was field reviewed by the SFWMD field engineers
and the letter submitted with the NOPC application was issued by the SFWMD
ack!lowledging the engineers' statement and tile completion of tile construction.
A copy of the signed two-page letter acknowledging the construction completion is
attaclled for your record. Also attaclled is a letter dated September 6, 2001 from tile
SFWMD stating no objection to tile approval of the proposed cllanges.
Lot 34-C was not par.t of tile construction drawings or the permit as a detention area
and tllUs was not constructed as a detention area. Lot 34-C is not needed as a
detention area now or in tile future.

4 ThIS lot IS also at the low pomt along Miner Road, whIch has roadway drainage
structures and the dIscharge mto Lot 34-C The applIcant does not mdIcate how
he plans to treat tills roadway dramage, both for the current two-lane roadway
sectIOn and the ultImate four-lane dIVIded roadway sectIOn.
RESPONSE. The Development Order for Quantum Park only requires the dedication
of Right-of-Way for Miner Road along an alignment through the Quantum Park
property as determined by Palm Beaclt County. This condition has been satisfied.
Miner Road was designed and constructed by Palm Beach County.
The Miner Road drainage system does not discharge to Lot 34-C, nor is it required or
designed to discharge to Lot 34-C. Drainage easements in favor of Palm Beach County
or the City of Boynton Beach do not exist through Lot 34-C or any portion of the
primary surface water management system north of Gateway Boulevard wit/tin
Quantum Park.
The drainage system for Miner Road is clearly shown on the construction drawing on
record at the Palm Beach County Engineering Department titled "Drainage Map,
Sheet 2 of 37, Miner Road", dated Dec'88. The drainage structure adjacent Lot 34-C
is a manhole at a high point in the roadway. The Miner Road right-of-way is the only
area included in the drainage area for the roadway. The drainage system discharges to
The L WDD E-4 Canal, not Lot 34-C.
Please delete this comment.
5 Quantum Lakes Drive, from Quantum Boulevard to Gateway Boulevard, contains
both water and wastewater system segments, to which at least one-half of the
dedicated right-of-way will be reqUIred to be utIlity easement(s). No anticipated
permanent "park ameruties" will be permItted on the utIlity easement(s), other that
soddmg and/or SIdewalk. ThIS department WIll reqUIre demonstratIOn that
"neglIgible impacts on the traffic dIstribution resultmg from the roadway
reconfiguratIOn" SubmItted traffic analysIs by the consultant does not meet DR!
traffic performance standards.
RESPONSE. The proposed preliminary plat will include utility easements for the
existing utilities wit/tin the proposed lots 100, 101 and 102. The Master Development
Plan is not required to show easements of any kind and none or shown, either existing
qr proposed. Any proposed construction within the cre(lted lots will be reviewed during
the site plan review process and subsequent construction permit process. Easements,
both existing and proposed, will be addressed at that time.
Given the scrutiny of the plat review process, the site planning review process and the
construction permit process, this comment is inappropriate at this time.

Witlt regard to ti,e traffic analysis, tlte DRI performance standard is a 15% increase in
external traffic. Tlte analysis determined tltat tltere is not a 15% increase in daily or
peak Itour traffic. In fact, tltere is a projected decrease in botlt tlte daily and peak Itour
traffic.
Tlte specific impact of tlte road closure is tlte redistribution of eastbound Quantum
Lakes Drive traffic generated by tlte office buildings on Lots 52 and 58 to Quantum
Boulevard. Tltese two developments generate an average daily total of 1062 trips.
Combine tlte office traffic witlt tlte 1904 average daily trips generated by tlte 272
apartments witllin tlte Villas at Quantum Lake project and tlte resultant total average
daily traffic projected to use tlte Quantum Boulevard link between Quantum lakes
Drive and Gateway Boulevard is 2986 trips.
Wllat demonstrates tlte negligible impact of tlte proposed roadway abandonment is tlte
comparison of tlte 2986 average daily trips projected on tlte roadway link at build out
and tlte 32,500 daily trip capacity of Quantum Boulevard. Tlte impact is furtlter
diminislted by tlte fact tltat nearly all of tlte 2986 trips would be using tlte Quantum
Boulevard link to Gateway Boulevard anyway.

RESPONSE. A proposed preliminary plat is being prepared and will be submitted by
separate application to the City of Boynton Beach for review and approval pursuant to
the plat review process.
8. Lot 34C (NotIficatIon of a Proposed Change, SectIon 54) is proposed to be
changed from undesIgnated use to Industnal use. How will this change Impact
proposed open spaces and park areas wIthm the development?
RESPONSE. It is important to note, the land area for Lot 34-C was previously
accounted for as a detention area and not as an open space or recreational park area.
Therefore, there is no impact to the open space or the recreational park areas relative
to the development of Lot 34-C. A similar example of no impact is tlte Sand Pine
Preserve areas adjacent tlte Industrial Development and Mixed Use Development in
the soutltern portion of tlte park.

9 Provide venficatlOn that Palm Beach County Engineenng will permIt a dnveway
opemng onto Miner Road for Lot 34C Show how a second mgress and egress
point will be proVIded at the south end of the property for emergency servIces.
RESPONSE. It is inappropriate to request verification from Palm Beaclt County
Engineering for a driveway opening onto Miner Road for Lot 34-C as a Master Plan
amendment requirement or even as a verification for site plan approval. Verification
Itas not been provided witltin tlte development at tlte Master Plan stage for any
driveway connection to any adjacent roadway. Furtltermore, tlte permitting of a
driveway opening is a site plan related issue and should be considered at tltat time.
A second ingress and egress will not be provided for Lot 34-C. This is consistent witlt
otlter lots witltin tlte development tit at do not have secondary access whiclt are larger
developments or larger lot areas than could be proposed or constructed on Lot 34-C.
These issues are site-planning issues and are inappropriate for tlte Master Plan
consideration.

10 If approved, an environmental assessment of Tract 34C will be required as part of
any site submIttal.
RESPONSE. We request that comment #10 be deleted on tlte basis that this again is a
site plan related condition. Furthermore, the Development Order (DO) already
requires an Environmental Assessment of each lot prior to development. Certainly, not
prior to Master Plan approval, a land use designation or a change thereto.

entrance point at the mtersection of Quantum Lakes Dnve and Quantum
Boulevard. ElImmatIon of that portIOn of Quantum lakes Drive and the second
access pomt will create an undesirably long trip for the most northerly residents of
the proposed multi-family resIdential development and would create a hazardous
SItuation for emergency servIces needmg to access northerly portions of that same
development.
RESPONSE. Prior to responding to ti,e comment it is important to correct two factual
errors within the comment. Firstly, the identified "dedicated roadway easement along
ti,e north property line of Lot 61" does not exist. Secondly, the application for the
NOpe in Section 5.5 was improperly restated. The application states that the main
access or entrance point at the intersection of Quantum Lakes Drive and Quantum
Boulevard will be used by Lots 59, 60, and 61 In fact, a second access point is
provided consistent with the approved site plan through the property to the north
currently owned by Quantum Park and Village.
Please refer to ti,e letter dated September 7, 2001 from Mr Mark Hansen, Olen
Developments. The letter clearly indicates the intent to provide a secondary access.

12. Abandonment of a portIOn of Quantum Lakes Dnve and reconfiguring a portion
of it into Lot 101 will create an undeSIrably long trIp for the most northerly
tenants of the proposed new lot and WIll create a hazardous SItuatIOn for
emergency servIces needmg to access northerly portIOns of that same
development.
RESPONSE. Stated in comment #11 and #12 is a concern contending long and
undesirable trips to the remote section of the existing and newly created lots. We
strongly disagree with this contention and request both comments be deleted, as many
developments of over 500 acres I,ave much longer distances to travel to exit ti,e
development. Furthermore, the access and travel routes of emergency vehicles are site-
planning issues, not master planning issues.
Please refer to the letter dated September 7, 2001 from Mr Mark Hansen, Olen
Developments. The letter clearly indicates tlte intent to provide a secondary access to
northern portions of Lot 61 and Lot 101

RESPONSE. Our responses for comments #11 and #12 also relate to comment #13
and we request tltis comment be removed. In tltis particular case, tlte newly created
Lot 102 is part of tlte larger 23 acre mixed use area. Tltese lands are under single
ownersltip and are anticipated to be included into a single master plan for commercial,
office and residential uses witlt proper emergency access and velticular movements
tltrougllOut the 23 acres with access from the Villas at Quantum Lake property (Lots
59, 60 and 61).

14 The NotificatIOn of a Proposed Change, Section 5.5, paragraph 3, represents the
intersection of Quantum Lakes Dnve and Gateway Boulevard as substandard and
dangerous. This IntersectIOn has preVIOusly been reViewed and approved. Please
provide additional Information (accident data and standard drawings) supporting
this statement.
RESPONSE. WitllOut regardfor the previous review and approval, it appearsfrom the
memo written by Mr Livergood P.E. (Public Works - Traffic Comments) the City staff
supports our requestfor the elimination of the intersection and the abandonment of the
roadway.
Regarding tlte previous review and approval, the improvements within Gateway
Boulevard and Quantum Lakes Drive were designed in 1986 and 1987 and constructed
in 1988 and 1989. Many changes to tlte FDOT design standards and design criteria
have occurred since that time. Palm Beaclt County has adopted an access
management plan and has also adopted street landscaping criteria, "streetscape
criteria" In previous incidents tltese criteria all have been applied to development
plans (e.g. site plans and associated roadway improvements, etc.) presented to tlte City
for review The Palm Beach County streetscape standards and access management
standards were adopted after tI,e design and construction of Gateway Boulevard and
Quantum Lakes Drive. Of particular interest and concern is tlte "ltot right" from
Quantum Lakes Drive to eastbound Gateway Boulevard. A yield sign controls tltis
turning movement. In effect traffic is allowed to flow from Quantum Lakes Drive and
merge into the riglzt hand through lane of Gateway Boulevard with very little
acceleration lane distance or adequate merging taper It is this hot right that we feel is
hazardous and believe is desirous to eliminate, particularly in light of the increased
pedestrian traffic crossing tltis yielded intersection enroute to the new high school that
did not exist when ti,e roadway was designed.

of this intersection, if any additional information or response is desired from the
applicant. No additional information or response in our judgment is necessary.

15 If the areas MU101 and Lot 34C are new, developable parcels then an addItional
recreatIOnal fee (or land m heu of fee) may be assessed based on the original
calculatIOns for the CIty Park.
RESPONSE. The Park and Recreational Department address recreational fees and
this comment in the Engineering section is inappropriate.

16. The creatIOn of Lots 100 and 101 and the re-designatIOn of Lot 34C from
undesIgnated to Industrial wIll obviously mcrease traffic volumes. The Traffic
AnalysIs (Quantum Park NOPC #12) states that" will not result in an increase
in daily or peak hour volumes" Although the analYSIS concludes that there are no
increases and decreases m allowable development mtensItIes, the analYSIS needs
to further address local changes in traffic volumes that would result from the
proposed changes.
RESPONSE. The proposed change does not increase the vested traffic generation of
the Park. An increase of developable area does not necessarily increase development
intensities particularly if intensity is measured by traffic generation. Land area does
not generate traffic, the office, industrial and residential buildings do generate traffic.
The proposed change increases the residential units allowable within the Park and
decreases the threshold of allowable office and industrial building area, on a traffic
generation equivalency basis.
The traffic generation equivalency is demonstrated by the submitted traffic analysis
and supplemented by the attached letter from Pinder Troutman Consulting, Inc.

17 The Traffic Analysis (Quantum Park NOPC #12) acknowledges that the closure
of a portIOn of Quantum Lakes Dove has the potential to Impact the regional
roadway network. The,analysis further states that diverted traffic will cause the
intersection of Gateway Boulevard and Quantum Boulevard to operate over
capacity during the PM peak hour The analYSIS proposes changes m stopmg and

RESPONSE. This comment has inaccurately stated the conclusions of tile traffic
generation equivalence data, the intersection analyses and the concluding statements.
A roadway widening is not proposed or required as a result of the abandonment of
Quantum Lakes Drive. The analysis and standard practice is very clear, the roadway
restriping associated with the traffic signal will occur when warranted, not before the
signal is warranted and preferably not after it is warranted. The accurate conclusions
are provided below after the following discussion about tile BGI approval cOllditions.
Regarding the traffic signal warrants and tile surety thereof, the BGI site plan
approval conditions are of importance. The BGI site plan approval was conditioned
requiring them to construct the traffic signal at the Gateway Boulevard and Quantum
Boulevard intersection. BGI subsequently abandoned their development plans and
sold tile land. The subsequent development, a 336,500 sq. ft. warehouse project known
as Gateway Business Center, was not conditioned by the City to construct or even
provide surety for the subject traffic signal. We believe this oversigllt should not be at
tile expense of tllis applicant especially now since it has been shown that it is tile
Gateway Business Center and the Villas at Quantum Lake developments that at build
out will warrant the signal.
Tile accurate conclusion is as follows, the Gateway Boulevard and Quantum
Boulevard intersection was previously determined to warrant a traffic signal with the
existing developments within the Park and the build out of tile Villas at Quantum Lake
and tile 336,500 sq. ft. warehouse project (located at the northeast corner of the
intersection). Tile analysis shows the traffic signal would be warranted prior to this
proposed change. The analysis also concluded the existing roadway improvements are
adequate at the time the traffic signal is warranted. The analysis also determined the
intersection after tile traffic signal is warrallted will be over capacity during the PM
peak hour only due to the projected increase in through traffic on Gateway Boulevard
and NOT the traffic generated by Quantum Park or the diverted traffic caused by the
roadway abandonment.
This comment is further addressed in the attached letter dated, September 7, 2001 from
Pinder Troutman Consulting, Inc.

pine preserve area to the west, the water management tract to the south, the adjacent

be considered. The key here is these are site development related concerns and not
Master Planning concerns.
Lot 34-C is not encumbered by any existing or required drainage easement, plat
dedication or plat reservation for use as a detention or retention area.
The land use designation change is not a change from detention to industrial but a
change described as follows Lot 34-C is currently unrestricted by a Hland use

the above comment resulting from the fencing of the three identified areas are
astoundingly inaccurate. To the best of our knowledge the acreage of Water
Management Tract J is also stated inaccurately.
The 6-foot high chain link fence as well as numerous "NO TRESPASSING" signs
were installed by the QPPOA with the cooperation of the applicant to attempt to restrict
the trespass of off tlte road vehicles and poachers illegally entering the properties and
causing damage to the habitat and wildlife. Prior to this applicant's purchase of lands
with in the Park, the illegal access and damage was occurring unrestricted.
It was simply less expensive, less time consuming, provided better security and a better
opportunity for monitoring the fence and access with the fence installed along the
north and east boundary line of Lot 34-C. Furthermore, including Lot 34-C "behind
the fence" also protected the Lot 34-C area habitat and wildlife from damage prior to
the proper environmental assessment typically performed as part of the lot development
process at the time a specific development is proposed.

RESPONSE. The traffic generated from an industrial use upon Lot 34-C is minor and
insignificant when analyzing the traffic issues relevant to the proposed change. On a
regional basis, it is the peak hour movements that are of interest. The impacted
intersections have been analyzed. The traffic generated by the entire development,
which is not being increased, does not have a significant impact on either the Congress
or High Ridge Road illtersections with Miner Road.
The traffic generation calculations for the overall development do not allocate trips to
a specific lot. Each lot as it is developed is required to prepare a traffic statement
identifying the traffic generated by the specific plan. A distribution of the generated
traffic is also provided as part of the statement.
Miner Road is a Plan Collector as designated by Palm Beach County. Its right-of-way
is protected for a five-lane roadway section. It is constructed as a two-lane roadway
expandable to the five-lane ultimate section. We anticipate the maximum traffic
generatedfrom Lot 34-C to be 700 average trips per day (6.58 acres x 0.35 FAR x 6.97
trips/] 000 sq. ft.). The connection of 700 trips per day to Miner Road with an ultimate
c.apacity of 32,500 trips per day is less than significapt. The significance is further
diminished by the fact the traffic generated by Quantum Park, including the 700
anticipated trips from Lot 34-C, are already vested and properly included in
background traffic of the regional roadway network.

RESPONSE. As a result of prior disputes and litigation, it has been previously agreed
and determined that the trips generated by the high school would not count against
future development within Quantum Park so as to resolve such disputes and litigation.
A Settlement Agreement (as a result of the litigation) was entered into by the School
Board of Palm Beach County and collectively with the QCDD, tile QPPOA and the
applicant. Confidentiality provisions of the agreement bind the applicant and the
School District. However, a key element of the resolution of this litigation was that the
City not count the traffic generated by the high school against future development
within Quantum Park.
The requested revisions to the Attachments listed above are not required for an
analysis provided in support of a determination of no substantial deviation. The
purpose of the NOPC traffic analysis is to determine if the proposed change results in a
substantial deviation. Florida Statues Chapter 380.06 Section (19)(b)15 states that ''A
15% increase in the number of external vehicle trips generated by the development
above that which was projected during the original development-of-regional review"
constitutes a substantial deviation. The data and analysis, as submitted with the
application, demonstrates that the proposed plan represents a decrease in Daily, AM
peak hour and PM peak hour trip generation from the original development-of-

Quantum Lakes Drive Closure
A full median opening exists at this location today There has not been any accident history at this location
that would warrant closure. However, it is recommended that the left turn exit from Parcell 00 not be allowed
Traffic Signalization - Quantum Drive and Gateway Boulevard
The Critical Movement Analysis (CMA) was not provided as a substitute for the signal warrant analysis. The
signal warrant analysis provided in the report dated February 16, 2001 is still valid.
The applicant cannot install a signal until it is warranted and has been approved by Palm Beach County
Therefore, it is recommended that monitoring of this intersection begin in peak season 2002 to determine if
signalization is in fact warranted. This is a condition of the current Development Order (DO). Monitoring
should continue every peak season until the signal is warranted.
Traffic Signalization - Quantum Drive and Congress Avenue
The applicant would agree that monitoring of this intersection should begin at the build out of Parcels 32
through 38. Monitoring should be conducted during the peak season and continue until the signal is
warranted.
General
The February 16, 2001 Intersection Analysis included proposed NOPe # 11 land uses. The original
NOPC # 11 was for the Mixed Use (MU) designation. Therefore, the traffic from both the residential and non-
residential uses on lots 7 through 11 and 23 through 31 have been included.

record drawings and an As-Built Master Drainage Plan from Santiago Malavasi, P E. of Rossi and
Malavasi Engineers, Inc. pertaining to the subject project's surface water management system. District
staff have reviewed the submItted information and it has been incorporated into the permit file
Per the referenced certification, our staff consider the Master Surface Water Management System
(including 8-onsite interconnected lakes totalling 67.81 acres, 6.92 acre dry detection area and 3-
discharge control structures serving the entire 578.3 acre industrial development) and the Surface
Water Management System for the Backbone Roadways at the Quantum Park project constructed
in conformance WIth the permit. This satisfies the requirement of the referenced surface water
management permit with regard to construction of the surface water management system and statement
of completIon and certification by a Florida registered professional engineer for the phases included
ill the above referenced application numbers
Furthermore, according to the Rules of the South Florida Water Management District, Rule 40E-1 and
40E-4, Florida Administrative Code (40E-1 6107, Transfer of Environmental Resource, Surface
Water Management or Water Use Permit; 40E-4 351, Transfer of Permits, 40E-4 61, Conversion from
Construction Phase to Operation Phase, and 40E-4 81, General ConditIOns), upon construction
completion and certification of the surface water management system, the permittee shall request
transfer of the permit to the responsible operating entity Therefore, the subject phase of the Quantum
Park project and the phase prevIously certified by engineer for construction completion (Quantum Park
of Boynton Beach, Lots 12,13,14) shall be transferred to the entity responsible for operation and
maintenance of the water management system.
The required transfer should be made via the enclosed transfer form. This form should be fIlled out
and submitted, along with a copy of the recorded deed restrictions (including amendments, if any), as
well as a copy of all recorded plats (if not previously furnished) It will then be processed and
included in the District's permit finalization process Please be aware that the permit file must contain
documentation that applicable conditions to the permit have been satisfied.

In response to your request, South Florida Water Management (SFWMD) staff has
reviewed the August 8, 2001 Notification of A Proposed Change (NOPC) to a Previously
Approved Development of Regional Impact (DRI) submitted by Eugene Gerlica, P E., for
the above-referenced project. The primary purpose of the NOPC is to amend the Master
Development Plan to Jeflect changes in land use affecting various lots throughout the
development and reconfiguration Quantum Lakes Drive to create two additional
developable lots.
After review of the documentation submitted, SFWMD staff did not identify any potential
adverse regional water resource-related impacts that could result from approval of the
proposed changes. Consequently, the SFWMD has no objections to approval of the
proposed changes However, a modification to the project's Conceptual Approval (Permit
No 50-01503-S) may be required to address the proposed land use changes as they may
impact the previously permitted acreage and land use assumptions.

Dear Ms Galav.
As a follow up to Erik Brueningsen's letter of July 10, 2001. please find enclosed a
conceptual drawing reflecting additional bldgs. (42 units) site planned for that portion of Quantum
Lakes Drive to be vacated. We have developed a plan that would utilize the easternmost lanes of
Quantum Lakes Drive for access to the additional units, thereby preserving the existing utilities (i e.
water, force main. FP&L, Bell South, Cable TV) as well as the existing trees on the easternmost side
of Quantum Lakes Drive. An existing 8" gravity sewer line would have to be relocated to allow the
additional development. The existing project (2':12 units) would proceed as designed scheduled, save
for minor shifting of building no 4 (minor modification of existing site plan) We have located the
top of bank an the significant trees along the lake bank in an attempt to preserve the environmental
plantings and to avoid impact to those plantings
Olen would acquire that portion of Quantum Lakes Drive adjacent to the existing project and
would coordinate the site plan submittal for the additional 42 units with the vacation process. I
anticipate having the information for a site plan submittal to DRC by the end of this month.
Our secondary access to Quantum Lakes Drive, will be modified by providing access to
Quantum Lane along the sand pine preserve. The access will be provided through the easternmost
portion of lot 62 and lot 66 connecting to Quantum Lane and High Ridge Road. This should resolve
any issues relating to a secondary means of egress.
The portion of Quantum Lakes Drive to be added to the Villas of Quantum Lakes would be
platted by Quantum along with the balance of Quantum Lakes Drive and would reflect specific
easements on the plat for the existing municipal utilities; addressing the location of the existing
facilities

is m9re complex. As part of the Ni )PC #11 submittal, the traffic consultant, Pindar Troutman,
opintd that a traffic signal IS wa:rra: lted at thiS intersectIon based on peak hour warrants, or
Wantant 11 from the Manual on U, ifonn Traffic Control Devices. With respect to NOPC #12,
the cpnsultant has changed the mte' 'sectIon lane-markmg configuration by eltmmatIng one of two
tlrrOl~gh lanes, both northbound an~ southbound, and substituting dedicated right turn lanes. This
actio~ was logical because the aSS1.i mption was made that there would be very minimal north or
sout~bound through movements at the intersection. Ultimately, the critical volwne sum that was
uti1i~ed for level of service analysi. could be reduced. Thus the intersection theoretically will
have:a higher traffic capacity

Howbver, whereas the cntIcallane,analysis prOVides mfonnation related to overall intersectlon
capatIty, it does not lend itself to v: arrant analYSIS for signahzation. This analysis IS based on
comJ?letely dIfferent critena establ:l ;hed in the Manual In Uniform Traffic Control DeVlces, the
sam~ Manual utilized by the consu: tant in NOPC #11 submittal. The consultant has shown no
c:fani es In the traffic dIstribution. 'Oms, the warrant analysis conducted by Pmdar Troutman and
s arized in a report dated Febn ary 16,2001 is still vahd. In fact, as lots 7 through 11 and
lots ,3 through 31 develop as Mix! d Use, they will most certamiy generale addilIonal traffic that

intet-section based on the peak hot r warrant and noted that "there are other Warrants, No.2 -
Interruption of Continuous Traffic' and No 10 - Peak Hour Delay that may be satIsfied. The
rec~mmendat10n 1S that thIS mters! ~ction be monitored in the future. Appropriate time frames for
mo itoring would be at the buildo~lt of Lots 32 through 38 and at the buildout of the NOPC 11
resi ential or non-residential land lSes, wluchever occurs first." Staff would note that a large
portion oflots 32 through 38 are U)W complete in the fonn of the Premier building.

assumed a build out of Lots 23 to 1 as office space (0) and Lots 7 to 11 as Office/Industnal

devdloper continues to be bound b I a maximum number of daily tnps from the entire DRI, yet
subtle changes in land use can si81: ificantly Impact peak hour traffic flows without impacting the
dail* trip generation rate. The cor; ;ultant has not expressed an opmion on the changed traffic
charjictenstics as related to traffic :ignal warrant analysis based on the changes to mixed use.

will e virtually Impossible to assc: ;5 the reqUIrement for traffic signal constructIon to each
indi~dual that may purchase the n: ixed use lots from Quantum and then subsequently develop
therr1. The burden of traffic SIgnaI' :lonstructjon should fall upon the developer of the whole rather
tha~the mdIVIduals that choose to lcquire and develop lots in the future. Quantum could easily
dis ,bUle the cost equally to 1\\lurt, buyers whereas the City could not
