PROPOSAL SUMMARY
Contained herein is a description of the subject project. The proposed project will be situated on 1 002 acres of
previously developed property, zoned R-I-A, Single Family Residential It is located on N.E 4th Street, west of
the F E C Rail Road. On site is an existing 3,325+ square foot building and parking facility currently used by
the Jehovah's Witnesses for religious gatherings Due to an increase m members, and the desire for an updated
facility, the applicant has determined that a new building would better suite their needs Instead of investing in
reconstruction, the applicant is proposing the removal of the existing facility and the construction of a new
building and parking area Due to the age of the development, there are no records in the City's Planning
Department files showing that the current use was approved through the conditional use process The applicant
has agreed with staff's recommendation to proceed with the conditional use approval process for constructing a
new 4,680 square foot church and a 53 space parking area.

STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11 2 D of the Land Development Regulations contains the following standards to which conditional uses
are required to conform. Following each of these standards is the Planning and Zoning DIvision's evaluation of
the application as it pertains to standards
The Plannmg and Development Board and City Conunission shall consider only such conditional uses as are
authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses
absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets,
alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding
area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose
of this sectiOn. In evaluatmg an application for conditional use, the Board and Conunission shall consider the
effect of the proposed use on the general health, safety and welfare of the conununity and make written fmdings
certifying that satisfactory provisions have been made concerning the following standards, where applicable
1 Ingress and egress to the subject property and proposed structures thereon, with particular reference to
automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire or
catastrophe
The subject property has four points of ingress/egress at N.E 4h Street The three southern most entry
drives service the current parking facility The proposed development will reduce the number of
ingress/egress points to two One 32 -9" wide two way main entry at the building front, and one 12 -0"
one-way egress lane at the north end of the property
2 Off-street parking and loading areas where required, with particular attention to the items in subsection 1
above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and
nearby properties, and the city as a whole

The proposed parking facility will provide for one(l) loading space on the west side of the proposed
building, nine (9) 10 foot by 25 foot parallel parking spaces along the east side of the parking area and
forty four (44) 9 foot by 18foot, 45 degree angle parking spaces including two(2) handicapped spaces
near the building entry The proposed project will not increase the intensity of parking or promote
additional glare, noise or odors that currently exist Parking spaces and related lighting will be
reconfigured. Any current glare, noise or odors will be relocated from the south end of the site along
with the north with the new parking area.

Roll out refuse containers will be provided by the city, and waste will be removed on a standard
schedule
5 Utilities, with reference to locations, availability and compatibilIty
With incorporation of Utility Department comments utilities are available and to be provided consistent
with Comprehensive Plan policies and city regulations
6 Screening buffering and landscaping WIth reference to type, dimensions, and character
With incorporation of Planning and Zoning Division comments, screening and buffering of adjoining
properties will meet code A perimeter landscape buffer is required and shall be designed, to meet the
intent of the Land Development Regulations Chapter 7 5
7 Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and
compatibility and harmony with adjacent and nearby properties
At the time of pennitting security lighting levels will be evaluated for excessive glare There will not be
an increase in glare anticipated from the proposed lighting Proposed light poles located in the parking
area will measure 24 -8 It is recommended that the light levels not exceed building code maximums
It is further recommended that the light fixtures required to illuminate the entrance access aisle be
directed away from any buildings located adjacent to the site
A proposed wall sign has been submitted for review No freestanding signs are proposed. The proposed
sign program meets the allowable requirements including sign face area and height dimensions as set
forth in the Land Development Regulations Chapter 21, Section 2
8 Required setbacks and other open spaces
The setbacks for a church in a R-1-A zoning district are 25 feet front, 10feet side, and 25 feet rear The
proposed building location meets or exceeds these minimum requirements Open space code
requirements will be met when staff comments are incorporated into the plans
9 General compatibility with adjacent property and other property in the zoning district.
The proposed facility is compatible, both visually and by use with the adjacent neighborhood. The scale
and architecture of the proposed facility is compatible with the surrounding one-story structures The
church is minimally used during the week and the intensity of the use will remain.
10 Height of buildmg and structures, with reference to compatibility and harmony to adjacent and nearby
properties, and the city as a whole
The proposed structure is less than the maximum height allowed for a single family home -30 feet The
peak of the roof structure is 24 -11 high.
11 Economic effects on adjacent and nearby properties, and the city as a whole
The proposed church is to be located in one of the city s residential cores The inherent nature of this
type of use will generally create no more economical impacts than a typical residence

12 Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19,
Article II of the City of Boynton Beach Code of Ordinances (Part III Chapter 4 Site Plan Review)
With incorporation of staff comments, the proposed project will comply with all requirements of
applicable sections of city code
13 Compliance wIth, and abatement of nuisances and hazards in accordance with the performance standards
within Section 4 of the zomng regulations, also, conformance to the City of Boynton Beach Noise
Control Ordinance
With incorporation of all conditions contained herein, the use would operate in a manner that is in
complzance with the above-referenced codes and ordinances of the City of Boynton Beach.
RECOMMENDATION
Based, in part, on the need for this new facility as represented by the efforts of the current petItioners
compliance with development regulations, and the conSIstency with the ComprehensIve Plan which allows such
uses within this land use classification contingent upon compatibility with neighborhood character, staff
recommends that this request be recommended for approval conditioned upon satisfying all conditions of
approval as contained in Exhibit "C"
As a general requirement of Conditional Approvals, written confirmation from Palm Beach County's Traffic
Division, stating that the project meets the Traffic Performance Standards must be received. Staff has submitted
the required documentation for reVIew, but has not received written confirmation of conformity Written
confirmatIOn must be received prior to application for a building permit
Furthermore, pursuant to Chapter 2 - Zoning, Section 11 2 Conditional Uses, a time limit is to be set within
which the proposed project is to be developed. Staff recommends that a period of one (1) year be allowed to
initiate this project As long as 25 % or more of the total cost of the improvements are completed within one (1)
year, this condition is met.
