PROPOSAL SUMMARY
Contained herein is a description of the subject project. The proposed project will be situated on 1 002 acres of
previously developed property, zoned R-1-A, Single Family Residential It is located on N E 4th Street, west of
the F E C Rail Road On site is an existing 3,325+ square foot building and parking facility currently used by
the Jehovah's Witnesses for religious gatherings Due to an increase in members, and the desire for an updated
facility, the applicant has determined that a new building would better suite their needs Instead of investing in
reconstruction, the applicant is proposing the removal of the existing facility and the construction of a new
building and parking area. Due to the age of the development, there are no records in the City's Planning
Department files showing that the current use was approved through the conditional use process The applicant
has agreed with staff's recommendation to proceed with the conditional use approval process for constructmg a
new 4,680 square foot church and a 53 space parkmg area.

STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11 2 D of the Land Development Regulations contains the following standards to which conditional uses
are required to conform, Following each of these standards is the Planning and Zoning Division's evaluation of
the apphcatlOn as It pertains to standards
The Planning and Development Board and City Commission shall consider only such conditional uses as are
authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional uses
absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for streets,
alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the surrounding
area and the citizens' general welfare, or deny conditional uses when not in harmony with the intent and purpose
of this section, In evaluating an application for conditional use, the Board and Commission shall consider the
effect of the proposed use on the general health, safety and welfare of the community and make written findings
certifying that satisfactory provisions have been made concerning the following standards where applicable
1 Ingress and egress to the subject property and proposed structures thereon, with particular reference to
automobile and pedestnan safety and convemence, traffic flow and control, and access in case of fire or
catastrophe
The subject property has four points of ingress/egress at N E 4h Street The three southern most entry
drives service the current parking facility The proposed development will reduce the number of
ingress/egress points to two One 32'-9" wide two way main entry at the building front, and one 12'-0"
one-way egress lane at the north end of the property
2 Off-street parking and loading areas where reqUired, with particular attention to the items in subsection 1
above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and
nearby properties, and the city as a whole

The proposed parking facility will provide for one(1) loading space on the west side of the proposed
building, nine (9), 10 foot by 25 foot parallel parking spaces along the east side of the parking area and
forty four (44), 9 foot by 18foot, 45 degree angle parking spaces, including two(2) handicapped spaces
near the building entry The proposed project will not increase the intensity of parking or promote
additional glare, noise or odors that currently exist Parking spaces and related lighting will be
reconfigured. Any current glare, noise or odors will be relocated from the south end of the site along
with the north with the new parking area.

Roll out refuse containers will be provided by the city, and waste will be removed on a standard
schedule
5 Utilities, with reference to locations, availability, and compatibility
With incorporation of Utility Department comments, utilities are available and to be provided consistent
with Comprehensive Plan policies and city regulations
6 Screening, buffering and landscaping WIth reference to type, dimensions, and character
With incorporation of Planning and Zoning Division comments, screening and buffering of adjoining
properties will meet code A perimeter landscape buffer is required and shall be designed, to meet the
intent of the Land Development Regulations, Chapter 7 5
7 Signs, and proposed exterior lighting with reference to glare, traffic safety, economic effect, and
compatibility and harmony with adjacent and nearby properties
At the time of permitting, security lighting levels will be evaluated for excessive glare There will not be
an increase in glare anticipated from the proposed lighting Proposed light poles located in the parking
area will measure 24'-8 It is recommended that the light levels not exceed building code maximums
It is further recommended that the light fixtures required to illuminate the entrance access aisle be
directed away from any buildings located adjacent to the site
A proposed wall sign has been submitted for review No freestanding signs are proposed. The proposed
sign program meets the allowable requirements including sign face area and height dimensions as set
forth in the Land Development Regulations Chapter 21 Section 2
8 ReqUIred setbacks and other open spaces
The setbacks for a church in a R-1-A zoning district are 25 feet front, 10 feet side, and 25 feet rear The
proposed building location meets or exceeds these minimum requirements Open space code
requirements will be met when staff comments are incorporated into the plans
9 General compatibility with adjacent property and other property in the zoning district.
The proposed facility is compatible, both visually and by use with the adjacent neighborhood. The scale
and architecture of the proposed facility is compatible with the surrounding one-story structures The
church is minimally used during the week and the intensity of the use will remain.
10 HeIght of building and structures, with reference to compatibility and harmony to adjacent and nearby
properties and the city as a whole
The proposed structure is less than the maximum height allowed for a single family home -30 feet The
peak of the roof structure is 24'-11 high.
11 Economic effects on adjacent and nearby properties, and the city as a whole
The proposed church is to be located in one of the city s residential cores The inherent nature of this
type of use will generally create no more economical impacts than a typical residence

12 Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19
Article II of the City of Boynton Beach Code of Ordinances (Part III Chapter 4 Site Plan Review)
With incorporation of staff comments, the proposed project will comply with all requirements of
applicable sections of city code
13 Compliance with, and abatement of nuisances and hazards in accordance with the performance standards
within Section 4 of the zoning regulations, also, conformance to the City of Boynton Beach Noise
Control Ordinance
With incorporation of all conditions contained herein, the use would operate in a manner that is in
compliance with the above-referenced codes and ordinances of the City of Boynton Beach.
RECOMMENDATION
Based, in part, on the need for this new facility as represented by the efforts of the current petitioners,
compliance with development regulations, and the consistency with the Comprehensive Plan which allows such
uses within this land use classification contingent upon compatibility with neighborhood character, staff
recommends that this request be recommended for approval conditioned upon satisfying all conditions of
approval as contained in Exhibit "C"
As a general requirement of Conditional Approvals, written confirmation from Palm Beach County's Traffic
Division, stating that the project meets the Traffic Performance Standards must be received Staff has submitted
the required documentation for review, but has not received written confirmation of conformIty Written
confirmation must be received prior to application for a building permit
Furthermore, pursuant to Chapter 2 - Zonmg, Section 11 2 Conditional Uses, a time limit is to be set within
which the proposed project is to be developed Staff recommends that a period of one (1) year be allowed to
mitiate this project. As long as 25 % or more of the total cost of the improvements are completed within one (1)
year this condition is met.

Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments or e-mail to JoAnn Alea and I no later
than 5.00 P.M. on January 5. 2000. When preparing your comments, please separate them into
two categories, code deficiencies with code sections referenced and recommendations that you
believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval
1 Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments
2 The documents submitted for the project were determined to be substantially complete with the
exception of traffic data however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by
the reviewer by contacting Scott Barber, or myself
3 Each comment shall reference the section of the code that is incorrectly depicted on the
documents

4 Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with
other departmental improvements
5 When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the
comment and the specific code section may be included in their review comments with the name
of the appropriate TRC Member that is responsible for the review specified
6 If a TRC member finds the plans acceptable, he/she shall forward a memorandum within the time
frame stated above, to me The memorandum shall state that the plans are approved and that
they do not have any comments on the plans submitted for review and that they recommend the
project be forwarded through the approval process
All comments shall be typed addressed and transmitted or e-mailed to JoAnn Alea and I for distribution to
the applicant. Please include the name and phone number of the reviewer on this memorandum or e-
mail Scott Barber will be the Planning and Zoning staff member coordinating the review of the project.
First review comments will be transmitted to the applicant along with a list of Technical Review Committee
(TRC) members

The project name IS the Boynton Beach Kmgdom Hall of Jehovah's Witnesses, located at 1512
N.E 4th Street m Boynton Beach.
EXISTING WATER MANAGEMENT SYSTEM
The eXIstmg property consIsts of approxImately 3,640 sfbmldmg and 39,920 sf of ImpervIOUS
asphalt parkmg. There IS currently no legal posItive outfall for the sIte Three catchbasms
provIdes water qualIty through an ex filtratIOn trench, The sIte IS graded to dram toward N.E. 4th
street.
PROPOSED WATER MANAGEMENT SYSTEM
The proposed proJ ect consIsts of a new Kmgdom Hall (4,665 sf) wIth new parkmg area (26,310
sf) and enlarged landscape area (12,632 sf) The eXIstmg water management system wIll be
replaced wIth a system that wIll provIde water qualIty through approxImately 40 LF of
exfiltratlon trench. Companng the pre-development vs. post-development hydrology shows a
decrease m runoff as the sIte IS graded to be self-contamed and swales are used throughout the
sIte
CONCLUSION
The new water management system IS mtended to not only provIde the reqUIred water treatment
but also Improve the overall qualIty of the eXIstmg sIte As shown thIS IS done by utIlIzmg
exfiltratlon treatment for the ImpervIous area dIscharge and mcorporatmg water qualIty measures
such as PollutIOn Retardent Baffles and sumps m the catch basms to treat the water pnor to
dIscharge mto the swale areas. There IS an overall Improvement to the storm system as the Pre
development dIscharge IS decreased by 7%.

We offer the following comments on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities In general, palm trees will be the only tree
species allowed within utihty easements Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future
LD R Sec 7 5-18 1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way
2) Dept. of Health permits may be required for the water and sewer systems serving this project. (Sec
26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g p.m. as
stated in LDR chap 6, Art. IV, Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater (see Sec 26-16(a)) Please submit these calculations with your Health
Department permit submittal.
4) Sec 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept. application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon fmal meter size, or
expected demand.
5) Comp Plan policy 3C 3 4 requires the conservation of potable water City water may not,
therefore, be used for irrigation where other sources are readily available
6) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap 4, sec 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utility
easements Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
Sec 26-33(a) of the Code
2) This office will not require surety for installation of the water and sewer utilities, on condition that
the systems be fully completed, and given to the City before the first permanent meter is set. Note
that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy
3) LDR chap 6, Article IV, Sec 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants
4) Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with Sec 26-207
5) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec 26-15)
6) Provide drainage calculations showmg the amount of rainfall to be retained on-site

The project name IS the Boynton Beach Kmgdom Hall of Jehovah's Witnesses, located at 1512
N E. 4th Street m Boynton Beach.
EXISTING WATER MANAGEMENT SYSTEM
The eXIstmg property consIsts of approxImately 3,640 sfbUlldmg and 39,920 sf of ImpervIOus
asphalt parkmg. There IS currently no legal posItIve outfall for the SIte. Three catchbasms
provIdes water qualIty through an ex filtratIon trench. The SIte IS graded to dram toward N.E 4th
street.
PROPOSED WATER MANAGEMENT SYSTEM
The proposed project consIsts of a new Kmgdom Hall (4,665 sf) wIth new parkmg area (26,310
sf) and enlarged landscape area (12,632 sf) The eXIstmg water management system WIll be
replaced wIth a system that WIll prOVIde water qualIty through approxImately 40 LF of
exfiltratIon trench. Companng the pre-development VS. post-development hydrology shows a
decrease m runoff as the SIte IS graded to be self-contamed and swales are used throughout the
SIte
CONCLUSION
The new water management system IS mtended to not only prOVIde the reqUIred water treatment
but also Improve the overall qualIty of the eXIstmg SIte. As shown thIS IS done by utIlIzmg
ex filtratIOn treatment for the ImpervIOUS area dIscharge and mcorporatmg water qualIty measures
such as PollutIOn Retardent Baffles and sumps m the catch basms to treat the water pnor to
dIscharge mto the swale areas. There IS an overall Improvement to the storm system as the Pre
development dIscharge IS decreased by 7%
