October 21, 1996 SUBJECT Staff Review of Canopy Plans Submittal Shell Oil Station Previously, I provided you with an outline of the problems associated with the process of completing a review for the expansion of a non-conforming use. As you know, we don't like to encourage an applicanfs major expansion of an existing non-conforming use, however, as a staff, we understand the need to be as flexible as possible on a case by case basis, and if we can help an applicant work around the expansion of a non-conforming use, we try to do so This is particularly important when you have an older business which is trying to improve the quality of that business, but because it was a non-conforming use in the pa&t, one doesn't want that non-conforming use to continue or expand to the detriment of the overall community Last week, we met with the representatives of Shell Oil to review the expansion of their station which is located at Congress and Boynton Beach Blvd. I just wanted to let you know that with a lot of give and take between this applicant and the staff, we were able to reach an acceptable compromise so that they can improve their property At times, their request for an expansion of the non-conforming use was as great as 18" (and I don't believe we have ever approved a non-conforming use expansion over 4") However, in the end, we were all able to find a design which only increased the non-conforming use by just 1/8" It appears that we will be able to accommodate this applicant's needs and still live within the spirit of our Code of Ordinances. Congress Avenue, Boynton Beach - 1520 S Federal Highway, Boynton Beach Dear Ms Hayden This is to inform you of Shell oil Company's proposal to repair and remodel the two facilities mentioned above The scope of work is essentially the same in both It entails the application of cladding materials onto the building facades and canopy surfaces, the complete refurbishment of all structures at each site accomplished by painting, cleaning and replacement of elements showing signs of ageing and/or deterioration, the removal and replacement of all existing fuel dispensers and the application of a new finish to the vehicular use area Pictures have been enclosed both of the sites in their present condition and of some sites in the area and one in Boynton Beach on which a similar remodeling process has been completed Also enclosed, you will find copies of the plans which depict the proposed scope of work Color samples and renderings submitted may be of help in your evaluation of the aesthetic merit of these projects I would like to pOl.nt out that no modificatlon in square footage is being proposed to any structure The footprint of all existing buildings will remain unaltered as will that of the existing canopies The fuel dispensers will be replaced like-for-like with new upgraded dispensers As mentioned above, a similar project has already been carried out in the City of Boynton Beach It involved the conversion of an existing fuel station on the intersection of Woolbright and Seacrest into a Shell facility with elements and materials identical to those proposed herein This station is indicative of the sort of clean and modern appearance we seek for our other stations in the area. In my conversation this morning with Dan DeCarlo he trans1llitted your concern about the scope of work entailed by the canopy (overhead) remodeling. TO document exactly the work invol ved I have enclosed cop ies of section drawings showinq in detail the method of attachment of the proposed claddinq (fascia) to the existing canopy. I might emphasize that the canopies will not be demolished, altered or detracted from in any way. The work to be done includes only the addi tien of those elements necessary to install the cladding tiles or fascia proposed. I am also enclosing for reference purposes those docu~ents in our files pertaining to the approval of a similar proposal in 1993.
