Leased space 22,672 sf / reqUIred spaces 227 / spaces aV31lable and approved 227
Requested new use conforms to eXIstmg traffic concurrency reqUIrement and IS
a lower Impact use.
Club Ovation as an Entertamment Complex seeks to change our current condItional use
as a "Nightclub" to mclude indoor ( amateur & professIOnal) sportmg events /
competitIOns of all kmds. Additionally Club OvatIOn seeks to get the Zomng in C3
modIfied to accommodate the requested modIficatIOn m conditional use.
Currently the Club IS operatIOnal and enJoys a useful occupancy load m excess of what
the requested type of events would generally require. Essentially we are estImating that
our occupancy load will be reduced for most sportmg events / competItIOns by at least
10% For example after a "Boxmg Rmg", temporary seatmg, and appropriate Isles are
set up m the existing standing room area ofthe main room, a SIgnificant percentage of
the available room has been expended and m turn reduces the occupancy of that room
and m turn the entire facIlity We respectfully contend that the requested new use has a
reduced Impact on all areas of the already approved use of the facilIty (occupancy,
parking, traffic etc. ) and therefore does not reqUIre any additIOnal study regardmg traffic
and parkmg. The facIlity currently meets a higher standard during normal execution of ItS
approved use.

is used for smaller shows and as a "showcase" for up and comIng national entertainers
( 4,000 sf, adjacent to)
In-Ovation Game room, Includes various arcade style games and multIple bIg screen
TV's eqUIpped WIt XBOX and Play StatIon 2 game umts ( approx 3,500 sf).
Main Room, eqUIpped WIth a concert SIze stage, IntellIgent lIghtIng system, projectIon
TV screen, 2 full-sIze bars, complete backstage area with full dressing rooms, VIP area
( approx 12,000 sf).
The current venue occupancy is set at 2,160., WhICh makes Club OvatIon the largest
facIlity oftt's kInd (Nightclub) In both Broward and Palm Beach CountIes and the only
"Nightclub" In Boynton Beach. ASIde from beIng perfectly sUIted for thIS type of event
( sportIng events) Club OvatIon IS also one of the only facilItIes of thIS audIence SIze In
all of South Flonda, whIch to date has helped attract some of the bIggest names In the
contemporary / classic mUSIC Industry and the bIggest promoters.
We feel that the facilIty IS generally underutIlIzed and could easIly help support a
broader demographIc of medIUm SIze events ( sports, commumty and or charity events)
that generally speakIng would actually reduce the operatIOnal Impact on all aspects of
the overall use.
To date many of the "major" broad format mUSIC events already tounng through
OvatIon approach the Clubs allowable occupancy level. Just the very nature and
operational layout of an event like bOXIng reduces the avaIlable audIence SIze
sigmficantly in the faCIlIty (which IS generally "standIng room only'" common to most
non-restaurant nightclubs). After a "bOXIng nng" and related temporary seating with
appropnate Isles IS mstalled ( as per the Fire Marshall ) , the occupancy of the room IS
automatIcally reduced, WhICh In turn reduces overall attendance and parkIng demand on
the facIlIty For example we estImate that the "sportIng event "occupancy would tYPIcally
be reduced from 2,160 to under 1,900 Of course the same theory applies to any event
that requIres we bnng In temporary seatmg, and or eqUIpment} stagIng elements whIch
applIes to almost all sporting type events.

SUMMARY -
GIven that the CIty of Boynton Beach and StatThas already spent consIderable time,
effort and money both studymg and subsequently approvmg the "condltlonal use" of the
eXIstmg venue and that our requested change m the .. condItIOnal use" of the eXIstmg
facIhty subsequently lowers the overall Impact on all aspects of the operatIOn of the
facIhty ( attendance burden, traffic ,utIlItles, refuse, hfe safety resources etc ) and
Immediate area. Plus the additional commerce benefits of another, mainstream event
type, that WIll undemably have a posItlve revenue effect on all related area busmesses.
Then it seems reasonable to request that the exceptIon m zoning and apphed for change
m conditional use be approved m congress wIth any appropnate, reasonable condItions
apphed to protect the cItlzens of Boynton Beach and general safety of all who VISIt the
venue.

Viper Room, smaller lounge located near the front west SIde of the venue otTthe lobby,
is equIpped with a separate bar, stage, hghtmg and P A , prOjectIOn TV screen ThIS room
is used for smaller shows and as a "showcase" for up and commg natIOnal entertamers
( 4,000 sf, adjacent to)
In-Ovation Game room, includes varIOUS arcade style games and multIple bIg screen
TV's eqUipped WIt XBOX and Play StatIOn 2 game umts ( approx 3,500 sf).
Main Room, eqUipped With a concert SIze stage, mtellIgent lIghtmg system, prOjectIOn
TV screen, 2 full-SIze bars, complete backstage area WIth full dressmg rooms, VIP area
(approx 12,000 sf)
The current venue occupancy IS set at 2,160., WhICh makes Club OvatIOn the largest
facIhty of It's kmd (Nightclub) m both Broward and Palm Beach CountIes and the only
"Nightclub" m Boynton Beach. ASIde from bemg perfectly SUIted for tlns type of event
( sportmg events) Club OvatIOn IS also one of the only facIlIties of this audience SIze m
all of South Florida, whIch to date has helped attract some of the bIggest names m the
contemporary / classic mUSIC mdustry and the bIggest promoters.
We feel that the faCIlity IS generally underutilIzed and could easIly help support a
broader demographIc of medIUm SIze events ( sports, communIty and or chanty events)
that generally speakmg would actually reduce the operatIOnal impact on all aspects of
the overall use.
To date many of the "major" broad format mUSIC events already tounng through
OvatIon approach the Clubs allowable occupancy level. Just the very nature and
operatIOnal layout of an event like boxmg reduces the avaIlable audIence SIze
sIgruficantly m the faCIlIty (wlnch IS generally "standmg room only", common to most
non-restaurant mghtclubs). After a "boxmg nng" and related temporary seating WIth
appropnate Isles IS mstalled ( as per the Fire Marshall) , the occupancy of the room IS
automatIcally reduced, wlnch m turn reduces overall attendance and parkmg demand on
the facilIty For example we estimate that the "sportmg event "occupancy would typIcally
be reduced from 2,160 to under 1,900 Of course the same theory applies to any event
that requires we bnng m temporary seating, and or equipmentJ staging elements which
apphes to almost all sporting type events.

SUMMARY -
Given that the CIty of Boynton Beach and Staff has already spent considerable tIme,
effort and money both studymg and subsequently approvmg the "condItional use" of the
eXIstmg venue and that our requested change m the" condItIOnal use" of the eXistmg
facIlIty subsequently lowers the overall impact on all aspects of the operatIon of the
facilIty ( attendance burden, traffic ,utilIties, refuse, lIfe safety resources etc ) and
immediate area. Plus the additional commerce benefits of another, mainstream event
type, that wIll undemably have a positIve revenue effect on all related area busmesses.
Then it seems reasonable to request that the exceptIOn m zoning and applIed for change
m conditional use be approved m congress WIth any appropnate, reasonable conditIOns
applIed to protect the Citizens of Boynton Beach and general safety of all who ViSit the
venue.
** Note -
All ofthe events at Club OvatIOn, m one form or the other, always mc1ude the approved
use of the venue (music, consumptIOn of beverages , etc)
