INTEREST THE CITY HAS IN A CERTAIN 10

EASEMENT DEDICATED TO PALM BEACH
COUNTY, FLORIDA IN OFFICIAL RECORD

PARTICULARLY DESCRIBED IN EXHIBIT "A"
ATTACHED HERETO; AUTHORIZING THE
CITY CLERK TO FORWARD A CERTIFIED
COPY OF TillS RESOLUTION TO PALM
BEACH COUNTY UPON ADOPTION, AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on February 3, 2004, the CIty ComrmssIOn approved the
redevelopment of the former Chevron SIte at the Northeast corner of Boynton Beach
Boulevard and Congress A venue (Boynton Place NWSP 03-025), and
WHEREAS, the former Chevron SIte contams a 10 foot (750 square foot)
SIdewalk easement under the JurisdIctIOn of Palm Beach County, WhICh parallels a
portIOn of the eXIstmg sidewalk along Boynton Beach Boulevard, and.
WHEREAS, CIty staff has determined that thIs easement which lIes WIthin
the corporate IIrmts of the municIpalIty, serves no purpose to the City; and
WHEREAS, the applIcant, ParadIse Development Group, has requested an
abandonment of the easement from Palm Beach County to allow suffiCIent space for
the unrumum reqUIred landscape buffer; and
WHEREAS, a requirement of abandonment from Palm Beach County IS the
adoption of a resolution from the municipality abandoning any mterest it may have in
the aforestated easement; and
WHEREAS, staff has reVIewed thIS request and recommends to the City
Commission that the CIty of Boynton Beach abandon any mterest It may have m the
750 square foot easement more fully described m ExhibIt "A" attached hereto and
made a part hereof
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
SectIOn 1.
The foregomg "WHEREAS" clauses are true and correct and
ereby ratified and confirmed by the City Commission

Enclosed is the Development Order granted by the City Commission on February 3, 2004 The site plan approval is for a
7,800-square foot retail building on a 0 75-acre parcel in a C-3 zoning district, and is valid for one year from the date of final
approval. In order to maintain vested status, a building permit must be secured or an extension granted within one year of final
site plan approval.
To continue this project through the development process, please revise relevant pages of your approved site plan to
incorporate all conditions of approval as applicable. A copy of the Development Order, including these conditions, must
accompany the submission of the fully amended SIte plan set. The person managing your permIt applicatIons should be made
aware of any additional documents and third party letters listed in the conditions of approval that need to be submitted with
your permit package.
The Building Division is committed to speedy and efficient completion of the building penmt process for your project.
However, please note that failure to meet all applicable Development Order conditions in the submitted plan set may produce
unnecessary delays in permit issuance. A thorough review will be conducted by the Plan Review Analyst and if the necessary
documentation is not attached and/or the plans are not amended to reflect all of the approval conditions, the plans will be
returned to the applicant for correction and re-submittal before the permit is further processed. Feel free to contact any TRC
member for additional clanfication of comments.
Important: If you plan to introduce any changes to your approved site plan beyond those required by conditions of approval,
please contact our staff for a review before submitting a permit package to the Building Division.
A copy of the complete Development Order and Amended Site Plans reflecting the "Conditions of Approval" must be
submitted to the Building Department along with the first permit request to avoid any delays in the processing of your
permit.

1 Provide a traffic analysis and notice of concurrency (Traffic Performance X
Standards Review) from Palm Beach County Traffic Engineering.
UTILITIES

2. Palm Beach County Health Department pennits may be required for the X
water and sewer systems servin~ this project (CODE, Section 26-12).
3 Fire flow calculations will be required demonstrating the City Code X
requirement of 1,500 g.p.m. as stated in the LDR, Chapter 6, Article N,
Section 16, or the requirement imposed by insurance underwriters,
whichever is greater (CODE, Section 26-16(b )).
4 The CODE, Section 26-34(E) requires that a capacity reservation fee be X
paid for this project either upon the request for the Department's signature
on the Health Department application forms or within 30 days of site plan
approval, whichever occurs first. This fee will be determined based upon
final meter size, or expected demand.
S Comprehensive Plan Policy 3 C.3 4 requires the conservation of potable X
water As other sources are readily available City water shall not be allowed
for irrigation.
6. Water and sewer lines to be owned and operated by the City shall be X
included within utility easements. Please show all proposed easements on
the engineering drawings, using a minimum width of 12 feet. The
easements shall be dedicated via separate instrument to the City as stated in
CODE Sec. 26-33(a).
7 This office will not require surety for installation of the water and sewer X
utilities, on condition that the systems be fully completed, and given to the
City Utilities Department before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
Certificate of Occupancy

8. A building permit for this project shall not be issued until this Department X
has approved the plans for the water and/or sewer improvements required to
service this project, in accordance with the CODE, Section 26-15
9 Utility construction details will not be reviewed for construction X
acceptability at this time. All utility construction details shall be in
accordance with the Utilities Department's "Utilities Engineering Design
Handbook and Construction Standards" manual (including any updates)
and will be reviewed at the time of construction permit application.

10 Prior to Fire Department approval of a building permit, new construction X
projects must provide the results of a hydrant flow test indicating a fire flow
not less than 1500 gpm @ 20 psi above domestic use. This applies to new
or existing hydrants within the required 200 feet of the facility

ENGINEERING DMSION
Comments:
11 Show proposed site lighting on the Landscape plans (LDR, Chapter 4, X
Section 7.B.4) Lighting levels are high for this location. Glare, which is
readily perceptible at any point at or beyond the property on which the use is
located, is prohibited (LDR, Chapter 2, Section 4.N 7). Lighting shall not
be used as a form of advertising in a manner that draws more attention to
the building or grounds at night than in the day (LDR, Chapter 9, Section
1O.F.5).
12. Full drainage plans, including drainage calculations, in accordance with the X
LDR, Chapter 6, Article IV, Section 5 will be required at the time of
permittin2.
13 Paving, Drainage and Site details will not be reviewed for construction X
acceptability at this time. All engineering construction details shall be in
accordance with the applicable City of Boynton Beach Standard Drawings
and the "Engineering Design Handbook and Construction Standards"
and will be reviewed at the time of construction permit application.
BUILDING DMSION

14 Every exterior wall within 15 feet of a property line shall be equipped with X

15 Buildings, structures and parts thereof shall be designed to withstand the X
minimum wmd loads of 140 mph. Wind forces on every building or
structure shall be determined by the provisions of ASCE 7, Chapter 6, and
the provisions of 2001 FBC, Section 1606 (Wind Loads). Calculations that
are signed and sealed by a design professional registered in the state of
Florida shall be submitted for review at the time of permit application.
16 At time of permit review, submit signed and sealed working drawings of the X
proposed construction.
17 CBBCPP 3 C.3 4 requires the conservation of potable water City water may X
not, therefore, be used for landscape irrigation where other sources are
readily available.
18. A water-use permit from SFWMD is required for an irrigation system that X
utilizes water from a well or body of water as its source. A copy of the
permit shall be submitted at the time of permit application, F.S. 373.216.
19 If capital facility fees (water and sewer) are paid in advance to the City of X
Boynton Beach Utilities Department, the following mformation shall be
provided at the tune of building permit application.
a) The full name of the project as it appears on the Development Order and
the Commission-approved site plan.
b) The total amount paid and itemized into how much is for water and how
much is for sewer

21 All shade and palm trees on the Plant List must be listed in the
specifications as a minimum of 12-14 feet in height, 3 or 4 inches caliper at
DBH (4.5 feet off the ground), and Florida #1 (Florida Grades and
Standards manual) The height of the trees may be larger than 12-14 feet to
meet the 3 or 4 inch caliper requirement. (Environmental Regulations,
Chapter 7.5, Article IT Sec. 5 C. 2.] Indicate the number of Sabal Palms to
be planted at each height.
22. The shrubs listed must be planted 24 inches o.c. with a height of 24 inches X
and spread of 24 inches.

24 The site plan indicates a sidewalk easement along Boynton Beach X
Boulevard, which is being utilized as part of the required landscape buffer
Initiate abandonment through Palm Beach County If it cannot be
abandoned, or if landscape buffer cannot be installed within the easement, a
variance must be approved for a deficient buffer
25 It appears as though the parking lot is intended to access the parking lot of X
the neighboring property to the east. If so, provide a cross-access agreement
and also greater detail on the plans of the connection of the two (depicting
the existing off-site improvements) to ensure compatibility Staff encourages
the connectivity between sites.
26. One (1) canopy tree IS required for every 30 linear feet of perimeter buffer X
When utilizing palms to meet this requirement, three (3) palms are the
equivalent of one (1) canopy tree, and such palms must be planted in
clusters of three (3). Trees are required in the hedgerow on the north side of
the loadmg space.
27 The back side of the false facades should be finished with like material as X
the front side to present a finished product from all elevations.
28. A uniform sign program for the center should be developed in the' event any .. --- X
bays are not leased to nationally recognized tenants, now or in the future.
This uniform signage program should consist of individual channel letters,
only one of the four colors proposed by the developer and not exceeding
