WHEREAS, on February 3, 2004, the CIty ComrmssIOn approved the redevelopment of the former Chevron SIte at the Northeast corner of Boynton Beach Boulevard and Congress A venue (Boynton Place NWSP 03-025), and WHEREAS, the former Chevron SIte contams a 10 foot (750 square foot) SIdewalk easement under the JurisdIctIOn of Palm Beach County, WhICh parallels a portIOn of the eXIstmg sidewalk along Boynton Beach Boulevard, and. WHEREAS, CIty staff has determined that thIs easement which lIes WIthin the corporate IIrmts of the municIpalIty, serves no purpose to the City; and WHEREAS, the applIcant, ParadIse Development Group, has requested an abandonment of the easement from Palm Beach County to allow suffiCIent space for the unrumum reqUIred landscape buffer; and WHEREAS, a requirement of abandonment from Palm Beach County IS the adoption of a resolution from the municipality abandoning any mterest it may have in the aforestated easement; and WHEREAS, staff has reVIewed thIS request and recommends to the City Commission that the CIty of Boynton Beach abandon any mterest It may have m the 750 square foot easement more fully described m ExhibIt "A" attached hereto and made a part hereof NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: SectIOn 1. In order to maintain vested status, a building permit must be secured or an extension granted within one year of final site plan approval. To continue this project through the development process, please revise relevant pages of your approved site plan to incorporate all conditions of approval as applicable. A copy of the Development Order, including these conditions, must accompany the submission of the fully amended SIte plan set. The person managing your permIt applicatIons should be made aware of any additional documents and third party letters listed in the conditions of approval that need to be submitted with your permit package. The Building Division is committed to speedy and efficient completion of the building penmt process for your project. However, please note that failure to meet all applicable Development Order conditions in the submitted plan set may produce unnecessary delays in permit issuance. A thorough review will be conducted by the Plan Review Analyst and if the necessary documentation is not attached and/or the plans are not amended to reflect all of the approval conditions, the plans will be returned to the applicant for correction and re-submittal before the permit is further processed. DEPARTMENTS INCLUDE REJECT PUBLIC WORKS- General Connnents: NONE X PUBLIC WORKS- Traffic Connnents: 1 Provide a traffic analysis and notice of concurrency (Traffic Performance X Standards Review) from Palm Beach County Traffic Engineering. UTILITIES - Comments: - 2. Palm Beach County Health Department pennits may be required for the X water and sewer systems servin~ this project (CODE, Section 26-12). 3 Fire flow calculations will be required demonstrating the City Code X requirement of 1,500 g.p.m. as stated in the LDR, Chapter 6, Article N, Section 16, or the requirement imposed by insurance underwriters, whichever is greater (CODE, Section 26-16(b )). 4 The CODE, Section 26-34(E) requires that a capacity reservation fee be X paid for this project either upon the request for the Department's signature on the Health Department application forms or within 30 days of site plan approval, whichever occurs first. This fee will be determined based upon final meter size, or expected demand. Water and sewer lines to be owned and operated by the City shall be X included within utility easements.
