DOCKS, DECKS & SEAWALLS - GOLFVIEW BARBOUR
On June 13, 1993, an application to construct a seawall, dock and
roofed over structure for James & Weonta Fitzgerald at 1210 S W. 26th
Avenue was submitted to the Building Department. The referenced
construction was existing; however, our records indicated that it was
never properly permitted
The submitted plans drawn by Gator Engineering lacked sufficient
detail for permit issuance and code comments were generated by the
department The design engineer, Robert Fetrow, was given the
opportunity to certify the plans and the construction, consistent with
Sections 103 3 2 and 103 6 2 of the Standard Building Code, 1991
Edition. The design engineer failed to correct his plans or avail
himself of the aforementioned option and the permit became invalid due
to inaction. A status review was performed on May 19, 1994 which
generated the attached red tag
Subsequently, the property was purchased by the Covingtons who were
notified that the existing structures must be properly permitted. The
covingtons appeared at the June 7th City Commission meeting to advise
the Commission of the situation
On June 17, 1994, a meeting between the Mayor, the City Attorney, the
Planning Director, you and me was held and one of the items of
discussion was the dock situation at Golfview Harbour. We decided to
analyze the matter in order to quantify thema~nitude of the problem.

On June 25, 1994, Code Enforcem~rveyed the subdivision and
ascertained that a total of~properties have some type of
consrrlll"'tinn i.IL the canal right-of-way Of this number, 90 properties
~do not have permi~s for construction Thirty-one lots have:seawall or
lb'UIRhead permlts and 14 docks or docks with seawalls have been
permitted. Of these 14, ten are in the Lake Worth Drainage District
(LWDD) and four have been permitted in City controlled canals
One-half of the lots on waterways in Golfview Harbour back onto canals
owned and operated by the LWDD The rest of the houses on canals back
onto canals dedicated to the "public" Neither the LWDD nor the South
Florida Water Management District has an interest in these lower level
drainage system canals This situation is shown on the attached map
Properties indicated by "X's" have constructed some type of
improvement in water right-of-ways

According to Code Enforcement, there are approximately six to eight
roofed over dock structures in the subdivision I have discussed the
matter of roofed over docks and boat houses with Bill Winters, Manager
of the LWDD. He informed me that since 1991, they will not permit
roofs in their right-of-ways and are currently looking at mitigating
any that have previously been constructed This would include issuing
permits for previously constructed structures. I have attached a copy
of the LWDD Operating policies and Section 11 2 2 states that "permits
will not be issued for boat houses". He has also informed me that if
the City does not want structures within the LWDD right-of-ways, they
will have the structures removed The City of Boynton Beach works
closely with the LWDD and we jointly permit and inspect structures
which the LWDD permit in their right-of-ways On March 30, 1994, J
Scott Miller wrote a memorandum advising me that the City Commission
did not want roofed over docks or boat houses permitted in the City
We have complied with that directive.
Currently, we have a situation where we are aware of significant
construction activity without benefit of permit on waterways in
Golfview Harbour Please provide direction on how you wish this
matter to be handled

LAKE WORTH DRAINAGE DISTRICT
OPERATING POLICIES
Docks/Davits with Seawalls
11 2.1 A permit will be issued upon receipt of all
requirements contained in this section.
11 2 2 Construction of boat docks may be authorized under
permit Each application shall meet the District's
requirements of the specific location, and all local
County and state requirements. Permits will not be
issued for boathouses. Floating and other atypical
dock designs will be reviewed on a case by case basis
Lake Worth Drainage District reserves the right to
refuse any applications that do not meet the following
criteria
11 2 3 Docks shall only be permitted on canals with a water
surface of thirty (30) feet or more. Docks may extend
no more than two and one-half (2 1/2) feet into a
canal with a water s~rface of thirty (30) to thirty-
five (35) feet, and no more than five (5) feet into a
canal with a water surface of thirty-six (36) or more
feet
11 2 4 Docks are prohibited within six hundred (600) feet of
a control structure
11 2 5 Davits must be used on any dock within one thousand
(1000) feet of a control structure
11 2 6 Continuing proof of insurance in the amount of
$300,000 00 minimum, listing the District as an
additional named insured, shall be provided Permit
applicant shall indemnify and hold harmless the Lake
Worth Drainage District for any liabilities arising
out of subject permit
11 2 7 Certification of title shall be furnished, addressed
to the District, signed by an attorney licensed to
practice in the state of Florida or the President or
Vice-President of a title company authorized to do
business in the state of Florida It must contain a
complete legal description of the property and the
owner's name(s) as it appears in the Public Records
See Sheet A-9 of the Addendum

Gates/Fences
11 1 1 A permit will be issued upon receipt of all
requirements contained in this section
11 1 2 Gates and/or fences will only be permitted at each end
of a subdivision or at a road crossing.
11.1 3 Minimum gate width is twelve (12) feet, with lock(s)
to be furnished by the District.
11 1 4 certification of title must be furnished, addressed to
the District, and signed by an attorney licensed to
practice in the State of Florida or the President or
Vice-President of a title company authorized to do
business in the state of Florida. The certification
shall contain a complete legal description of the
property and the owner's name(s) as it appears in the
Public Records See Sheet A-9 of the Addendum
11 1 5 Surveyor drawing must be furnished showing the
location of the fencing and gate(s).
11 1 6 Permit fee of $65 00 must be paid This fee includes
cost of lock(s) furnished by the District

11 3 Seawalls/Bulkheads
11 3.1 A permit will be issued upon receipt of all
requirements contained in this section.
11 3 2 Construction of seawalls, or bulkheads, may be
authorized under permit. Each application shall meet
the District's requirements of the specific location
and all local County and State requirements.
It is suggested that the applicant contact the
District prior to seeking local governmental agency
approval.
11 3 3 A surveyor sketch of the property must be furnished,
showing the proposed location of the seawall in
reference to the property line and the existing
water's edge
11 3 4 A drawing must be furnished, showing type of
construction and materials to be used See Sheet A-7
of the AddendUJD, for minimum standards or approved
equal
11.3 5 A copy of the warranty deed and most recent tax bill
will suffice as title certification It must contain
a complete legal description of the property and the
owner's name(s) as it appears in the Public Records
11 3.6 Continuing pr~of. of insurance in the amount of

Erosion control (rip-rap) shall be required for a
distance of thirty-five (35) feet on either side of

Rip-Rap shall consist of broken stone and meet the
following requirements
The material shall be sound and durable, with a
specific gravity of at least 1 90. Rubble should be
no larger than one (1) cubic foot per piece and no
sillaller than 25 cubic foot per piece It shall be
free of cracks, soft seams and other structural
defects The pieces shall be roughly angular and
shall be reasonably free from thin, flat elongated
pieces Rubble with steel rebar protruding is NOT
permitted
11 2 13 Maximum dock length shall be twenty (20) feet, with
maximum of four (4) pile supports
