Dixie Highway, Suite 10 Lake Worth, FL 33460 Re: Dos Lagos PUD - File No. 808 Site Plan Modification (Buffer) Dear Ms. Persin: On January 14, 1994, I received your letter which sets forth your Association's proposal for modifying the Dos Lagos PUD buffer along Congress Avenue. Your proposal is as follows: planting a Ficus beniamina hedge in a continuous, straight row, seventeen feet back from the bike path along Congress Avenue, starting at the entrance wall and extending to the project's north and south boundaries--the hedge row to be a minimum two feet high at time of planting. During my last meeting with you on November 29, 1993, when a Ficus hedge, planted at the bottom of the existing berm, was discussed, Planning and Zoning Department staff stated that Ficus would not be acceptable due to the City's native species requirement (Ficus is not a native plant). Staff also stated, at that meeting, that a hedge planting at the base of the berm, rather than at the top, would not achieve the same buffer results as did the fence and understory plantings that have been removed from the top of the berm. To aid staff in determining whether your proposed modification, as presented, shall be processed as a minor modification (administratively) or as a maJor modification (requires review by the Technical Review Committee, Planning and Development Board and City Commission), since receipt of your letter, staff has researched the latest landscape plan on file. I have also requested the City's Forester to inspect the remaining plant material within the buffer for comparison to the latest plan on file. Th1s plan is on file on "Rack 80-007" within the Building Department and is an "as built", landscape plan, dated October 1, 1990. The plan's title block contains no reference number, but does indicate that it was prepared by sinclair Landscape Nursery, Inc., 11011 Hagen Ranch Road in Boynton Beach. The Forester reports that approximately 20% of the landscaping indicated on this plan no longer exists. Jtmema's (jateway to tlU (julfstream Dos Lagos PUD - File No. 808 Page 2 The landscape plan on file does not show a fence and since there is no record of a fence removal permit, it can be concluded that the fence was demolished prior to October 1, 1990. The City's Building Official has informed me that it is not uncommon to document, for record purposes, revisions to plans during the construction phase by filing "as-built" drawings. This is further supported by the fact that although the buffer is a requirement, buffers can be accomplished using fencing, walls, and/or landscaping. If, despite staff's comments regarding the type and location of the hedge proposed, it is the Association's desire to pursue their proposal by submitting plans indicating same, such modification shall be processed as a major site plan modification, requiring a landscape appeal. This determination has been made based on Sections 9.3.3, 9.3.4 and 9.3.7 of Chapter 4--site plan Review of the City's code of ordinances. The referenced sections require a modification that does not meet the development standards (lack of native species), that adversely affects adjacent or nearby property, (view from pUblic right-of- way) or reduces required buffers, such as fences, trees or hedges, or that does not resemble the approved site plan, to be processed as a major site plan modification. The submittal to the Planning and zoning Department for a major site plan modification must be accompanied by 12 sets of plans, a complete application (available in the Planning and Zoning Department) and a $1,500 fee. The landscape appeal previously discussed, must be accompanied by a letter stating the nature and reason for the appeal and a $200 fee. The current condition of the buffer, primarily comprised of trees with few understory plants remaining, provides little privacy for the Dos Lagos homes which back up to Congress Avenue; a four lane (future six lane) arterial. It is my recommendation that you view the 1990 "as-built" landscape plans referenced, noting the number of trees and understory plants that are missing. It is further recommended that your proposal include the following: 1. replacement (in terms of quantity) of the missing trees and understory--Iocation as noted below; 2. replacement of the understory with shade-tolerant shrubs to be grouped and planted at the top of the berm (possible species could include myrsine, way myrtle, fire bush and any of the stoppers--keeping in mind the native species requirement); 3. replacement of the trees to be grouped and planted in full sun near the base of the berm, separate from the existing, dense, tree canopy; and Dos Lagos PUD - File #808 Page 3 4. if for long term maintenance reasons, the Association does not want to replace the fence, a continuous, meanderinG hedge row of shade-tolerant species is recommended in the vicinity of the top of the berm. Proper maintenance of the buffer plants will greatly increase their survival rate and help them to flourish. The City Forester noted in his report to me that the irrigation system appeared not to be working and that the planting beds were devoid of mulch and organic material. His analysis is that the condition of the irrigation system and soil caused stress on the understory plants that were recently removed. On September 24, 1993, the City of Boynton Beach cited Dos Lagos Ilomeowners Association, Inc., for non-compliance with approved site plan #80-007. lbis violation involves the removal of 2,100 linear feet of wood fence from Dos Lagos' buffer area. The failure of the Association to replace the fence or obtain a revised site plan by October 24, 1993, resulted in a hearing on November 17, lY93, before the City of Boynton Beach Code Enforcement Board. }\t this hearing, the Association's attorney opted to plead "no contest". lbe attorney requested 180 days to comply, however, the Board determined that 90 days was adequate. Additionally, the Board assessed a $150.00 per day fine for non-compliance, effective as of February 14, 1994. . Due to the fact that we, as well as many other Dos Lagos hOMeowners, live uncomfortably close to a main thoroughfare, it is vital to the safety of our children that the minimum tuffer requirements be met immediately. Therefore, I respectfully request that leniency will not be granted neither for reduction of fines nor extension of time. Your attention to this urgent matter is very much appreciated. Thank you.
