Dear Mr. Larkin: This is a summary of the issues discussed at a meeting, at which you were in attendance, held January 5, 1995 in the City Manager, Carrie parker's conference room, regarding the action required by you to obtain an occupational license to operate your proposed auto body repair business at 610 Industrial Avenue. The summary is a follow-up to the attached memorandum I wrote to Carrie Parker, dated August 10, 1994. All items of the August 10, 1994 memorandum are valid and will require action by you. The possible exception to this would be that a permit may not be required to install site lighting to comply with comment number 2, if the light level readings, made by City Staff, of the existing fixtures on site, comply with the code. If they do, the current plans filed with permit *93-1650 shall be revised, by you, to show the location of the existing poles/fixtures. If the light levels do not meet City Codes, comply with comment number 2. During the meeting it was stated that the Public Works Department would allow the dumpster at your other site located on Industrial Avenue to serve the 610 Industrial Avenue Site. Please provide written verification from the Public Works Department that the dumpster on the adjacent site is approved for the 610 Industrial Avenue site or comply with comment number 3. 5fmericas Gateway to tlU (ju!fstream page 2 Mr. Kerry Larkin 610 Industrial Avenue The requirements regarding modifying the parking data, identified in comment number 5, will be omitted following a site inspection by City Staff to evaluate the site for compliance with automotive paint and body shop parking ratios, revised pursuant to ordinance No. 94-20. If the number of required parking spaces identified on the parking data specified on permit plans 1193-1650 may be reduced as a result of applying the parking ratios identified in Ordinance 94-20, City Staff will modify the ratios and you will countersign the change prior to the final approval of the paving permit (1193-1650). As previously stated, all other items of the August 10, 1994 memorandum are valid and are your responsibility to obtain compliance to receive an occupational license. There was also discussion of your requesting a landscape appeal. If the appeal is approved by the City Commission, you will be responsible for compliance with comment number 4 for all landscaping at the site for which you did not receive relief from the approval of the appeal. If the appeal is denied, you must comply with comment number 4. A landscape appeal is processed through the Planning and Zoning Department, reviewd by staff and presented to the Planning and Development Board with the final determination rendered by the City commission. A completed request must be submitted to the Planning and Zoning Department at least ten (10) working days before the second (2nd) Tuesday of the month. The ten (10) day lead time allows staff time to process the request and place the request on the Planning and Development Board agenda. The Planning and Development Board meets the second (2nd) Tuesday of each month. As previously stated the City Commission makes the final determination and the commission meets on the third (3rd) Tuesday of the month following the Planning and Development Board meeting. A completed request shall include a letter to the City Commission through Tambri J. Heyden, Director of the Planning and Zoning Department. The letter shall detail the request, including a description of the on-site location of the landscaping and the section(s) of the Landscape Code from which you are seeking relief. The letter shall be signed by the property owner or an authorized agent. In reviewing the letter it refreshed my memory that Chris had agreed to memorialize the meeting in writing, and that it took several weeks before he was able to forward the letter. As you can see from the letter, it was that putting up the accessory structure site plan review, and could be used as a clearly understood would not require a paint booth. The only question remaining was the requirement to submit the parking lot to a site plan review. It still was our understanding that the review was as to the resurfacing of the parking lot only, and the landscaping and unpaved areas were not to be subject to the review. The remaining problems seem to stem from the fact that architect, Mr. Blanchette failed to provide drawings properly reflect the final state of the property. We have been unable to determine if the modified drawings in fact submitted. the that still were What is clear is that an agreement was reached, and city was satisfied with the agreement. The last licensed occupant was a irrigation/sprinkler contractor. The occupational lincense expired SeptenUber 30, 1991. The parking area improvements were constructed with permit #87- 1443. On 6/18/1987 a final inspection was granted for the paving in the parking area. The improvements shown on the plans with permit #87-1443 depicted a complete site with (8) parking spaces, paving (concrete) & drainage, curbing, wheel stops, site lighting (FPL), loading zone, dumpster enclosure, landscaping and the 4,000 square foot building. The plans indicated the size of the lot as 68 feet wide (north to south) by 279 feet long (east to west). See attached plan. The following is a time line of the events and development of the above-referenced site starting 7/14/1992: 7/14/1992 An environmental review application was submitted to the Planning and Zoning Department. 7/23/1992 The Environmental Review Committee (ERC) granted approval for the paint and body shop, subject to ERC comments. CURRENT STATUS - Prior to receiving the required environmental review permit compliance with the applicable ERC comments is required. See Exhibit A. 10/20/1992 - A building permit #92-3721 was issued for construction of a 800 sq. ft. (approx.) unpermitted loft. The loft was in the 4,000 sq. ft. building and found during the ERC inspection of the premise. CURRENT STATUS - On 9/8/1993 a Certificate of Completion was issued for the loft. NOTE: Site improvements were required as a result of the construction of the loft area, however, the P&Z Dept. was not identified to review the plans for the loft. 3/1993 A formal submittal was made for a major site plan modification for the project (file #714) to add 1,000 sq. ft. to the existing 4,000 sq. ft. building. The plans identified the size of the lot as 98.64 feet wide by 279.28 feet long. CURRENT STATUS - The application is null & void. page 2 Ideal Paint and Body 5/14/1993 A building permit #93-1692 was issued to allow the construction of a 1,000 sq. ft. accessory building. Per the director of the P&Z dept. the plans were signed-off on 4/30/1993 for the building only. The Fire, Building and P&Z departments' were the only departments that review approved the plans and no site improvements were required. CURRENT STATUS - A Certificate of Occupancy (C.O.) will not be issued until compliance with the issues identified on the attached computer printout are completed. See Exhibit B. 7/23/1993 A revision to permit #93-1692 was approved to add 600 sq. ft. to the 1,000 sq. ft. accessory building. The Fire, Building, Eng. and P&Z departments' were the only depts. that review approved the plans. On 8/1/1993 the director of the P&Z dept. stated on the plans "site work was not applicable for this permit" . The plans identified the size of the lot as 98.64 feet by 279.28 feet. The addittional 30 feet width was added to the south side of the existing property. The improvements shown in the area of the new property would require the omission of the initially approved curbing and landscaping along the south property line. Considering the new property, a unity of title is required to combine both lots. CURRENT STATUS - c.o. pending compliance with the issues identified on computer print-out (Exhibit B) 9/28/1993 A building permit #93-1650 was issued to allow construction of the paving for the project. The plans depicted the following on the 98 feet by 279 feet lot: landscaping, paving & drainage, parking spaces, irrigation notes, curbing notes, site lighting information, 4,000 sq. ft. building, 1,600 sq. ft. building, ETC. The Eng. and P&Z departments' were the only departments that review approved the plans. To date, the only permit that has been issued from the plans is the paving permit. CURRENT STATUS - Final inspections are required for the site work depicted on the plans. To date the only improvements constructed at the site are associated with an uncompleted paving permit see Exhibit C. 2/3/1994 An occupational license application was submitted to the occupantional license division of the Building Department for the paint and body shop. CURRENT STATUS - The application indicated permits were in progress and that an environmental review permit was required prior to the issuance of the Occupational License. ) page 3 Ideal Plant and Body 2/18/1994 A building permit #94-487 was issued to allow construction of a paint spray booth to be located within the 1,600 sq. ft. accessory building. CURRENT STATUS - The final inspections are approved 4/6/1994 6/20/1994 - The Code Enforcement division of the Police Department sent a certified letter to the property owner to appear at the July 20, 1994 Code Hearing, regarding operating a business without an active OCcupational license. CURRENT STATUS - The applicant has received notice to appear at the July 20, 1994 hearing. See Exhibit D. 6/30/1994 - The Engineering Department placed the final inspection for the paving permit on hold. CURRENT STATUS - The Engineering Department is waiting for the outcome of the current events. Murphy's. towing - which leases a portion of the property located directly south of the Ideal Paint & Body property has recently replaced a portion of the fence that encloses their car compound. The required screening and the screening was not installed at this time the code enforcement division of the Police Dept. is working with the towing company to replace the required screening. The follOwing is a list of the improvements required to be permitted, installed and receive final inspection approval at the 610 Industrial Ave. site prior to a Certificate of Occupancy being issued for the new paint spray building: 1. The paving contractor shall install the required curbing with the existing paving permit. Prior to approval of the final inspection for the paving permit the City Engineer Bhall ensure the paving permit plans show the code required site drainage. If the paving permit plans are not acceptable to the City Engineer the paving contractor shall submit a permit application for drainage to the Building Department and recieve a permit to install the code required drainage. It is recommended that the paving permit not be finaled until all site permits are review approved by staff. 2. The appropriate person shall submit a permit application for site lighting to the Building Department and receive a permit to install the code required site lighting. 3. The appropriate person shall submit a permit application for landscaping to the Building Department and receive a permit to install the code required landscaping. 4. The appropriate person shall submit a permit application for a dumpster enclosure to the Building Department and receive a permit to construct a dumpster enclosure. File No. ER 92-022 Dear Mr. Larkin: Please be advised that on Thursday, July 23, 1992, the Environmental Review Committee approved a paint and body shop to be located at 610 Industrial Avenue, Boynton Beach, subject to the conditions within the attached Building Department Memorandum #92-172, Fire Department Memorandum #92-248 WDC, Engineering Department letter of July 23, 1992 and planning and Zoning Department letter of August 3, 1992 and the attached "status of Application" sheet from page 7 of the permit application which states the following: 1. Soiled rags shall not be disposed of in the dumpster, and must be picked up by a service. State law prohibits landfills-~rom taking them. 2. Section 412.8.4 of the Standard Building Code requires repair garages to be continuously ventilated by a mechanical system with positive means for both inlet and exhaust of at least 0.75 cfm per square foot of floor area, controlled from a location close to the entrance door. Before an Occupational License can be issued, a permit must be obtained and inspections made for future paint spray booths and a positive means of mechanical ventilation must be installed. In order for this ERB permit to be approved by the Building Department, a licensed contractor must apply for and secure a permit and obtain applicable inspections for the unpermitted offices and lofts, per Section 103.1.1 of the Countywide Amendments to the Standard Building Code, 1991 Edition.
