To date, we have not hear from you. This delay in your response has caused a contract purchaser for a new home to be built by our client in Lawrence Lakes to express a desire to cancel, due to the uncertainty of this situation. BOYNTON BEACH BOULEVARD PO BOX 310 BOYNTON BEACH, FL 33425 ATIN: WILLIAM HUKILL, CITY ENGINEER RE: LAWRENCE LAKE P.U.D, ENGINEER'S EVALUATION OF DRAINAGE ROADWAY SWALES Gentlemen: I, as engineer of record have reviewed the construction plans and specifications for the Paving and Drainage and have in recent weeks made a field inspection of the existing Drainage System, and base the following on my observations and analysis, The roadways and drainage system were constructed several years ago under the inspection of Rossi & Malavasi Engineers and the city's Engineering Department. At the completion of the site improvement the project was finaled, and the bond was released, Subsequent to that completion, the developer (Lawrence Lake Development Corp.) proceeded to complete the landscaping, which included the construction ofa sodded and landscaped earth mound along the south property line. The mound covers a portion of the southerly roadway swale, and I understand that the mound was not previously approved by the city. It is the purpose of this evaluation to determine whether or not the roadway drainage has been impaired by the construction of the subject mound. (The developer obviously thought he was creating a desirable screen from future development to the south). Storm water runoff from the paved roadways is transmitted to the drainage inlets by the swales, The swale along the south property line has been encroached by a few feet. There is more than sufficient swale left to drain the paved roadway. Runoff is pre-treated by flowing over grass before discharging into the inlets. The drainage design elements provide for a lake that is disportionately large as a percentage of the total tract, thereby creating additional runoff pre-treatment. Periodic observations during periods of heavy rainfall reveal no flooding or ponding of the roadway, indicating the drainage system has functioned as designed. More recent rainfall of high intensity caused no flooding or ponding. I trust that this analysis has addressed the focus of the question of the effect of the mounding on drainage. IAuldaeape and Community Improvements Dear Ms. Heyden: On December 14. 1996. members of the Lawrence Lake I-Iomeowner~ Association Transition Board came to an agreement with the developer regarding the completion ofthc community landscaping, which included the ~ubject borm. Other improvements were also incl~ded in the agreement, such as repairing and painting cOlDmunity fences, constructing an cntry sign &nd sealing the community roadways. This agreement was presented to the homeowners for their consideration lit II meeting on December 14,1997. Of the 30 homeO\.\lICTS who were presented the: proposed agreement, 2 could nol be contacted; 22 signed a petition indicating their approval Oflhcproposed agreement. The berm along the south and east perimeter of the community provi~es a desirable buffer betwoon : OLlr development and'the adjacent property. This berm has not ca~d any adverse impacts to the , community, The developer has stated that the removal of this berm is cost prohibitive and, if . required, would facilitate the pullout ofthe developer leaving the community incomplete. Thc completion of our community has been a long time coming, and Ihis additional delay has caused much dourest. The bomeowner who has caused this delay ddes not represent the community as a whole. The concerns that this homeowner has brought forward are unfounded, as the resolution of many of these items is contained within the signed al.rt'eement the community has reoeived from the developer, Also, tho latest revision to the landscape plan was for the inclusion of item, contained within the proposed agrcement. The first is to make you aware of what items the City and several residents have asked us to address concerning the cornmon areas. The second is billing for the fourth quarter of 1996. The electric and the phone for the gate are now added to your monthly maintenance. The gate will be operational before the fourth quarter commences. Therefore, your new maintenance bill will be $165 per quarter. Before I inform you of the additional community work GRB will be providing, I would like to thank those of you who have been making their maintenance payments on schedule. Penalties will be assessed for those of you who have not been paying on a timely basis!
