With respect to your January 22, 1997 memorandum, be advised as follows:
. Fencing - We cannot locate either a fence permit or an inspection ticket issued by the
Building Division for a fence at subject location. It may have been lumped in with
improvements associated with the platting process, but Engineering Division files do not
support that conclusion. Setting that aside, the change in material, if one occurred, from
cedar to cypress is a substantial upgrade. Rejecting cypress would be akin to rejecting a
Lexus because you asked for a Hundai. In any event, the issue should be resolved
between the Homeowners Association and the Developer, not an individual and the City.
. Drainage - A meeting was held on Wednesday, January 22nd, with the Developer; the
Homeowners Association President (and past President, I believe); Ms Heyden; the
Developer's Design Professional; the Developers Project Manager; Mr. Hall; and this
writer.
Nothing was said in that meeting about your earlier meeting with Mr. Carson, therefore, I
do not know what standing he has with regard to the project. The two issues outstanding
involved landscaping and drainage. They will be resolved as follows:
. Landscaping - A revised proposal for landscaping has been submitted by the Developer
for review. The Homeowners Association President presented a petition signed by 22 of
the approximately 34 residents of the development supporting the revisions. He also
represented that several of the 12 non-signers could not be contacted because they were
out of town. Ms. Heyden reported that staff has reviewed and approved (i.e., signed off)
the landscaping plan. Since the Developer, P.G.A. and the City were all in agreement, we
decided that upon submission of a landscape surety, based on a certified cost estimate, the
work could proceed.

. Drainage - The major drainage issue presented was the presence of a berm in a location identified
on construction drawings as a swale. The berm reportedly was constructed as an additional
security measure when a decision was made to gate the community. The Design Professional
employed by the Developer (Enrico Rossi) will certify that the drainage system, including the
berm, would function as required by all laws, rules, regulations, codes, etc., in a manner
equivalent to the originally proposed system. Since the Developer, the P.O.A. and the City were
all in agreement that upon completion and certification of the drainage system by the Design
Professional, it would be acceptable to the City.
No issue regarding an outfall to the Lake Worth Drainage District Canal was raised, nor was it
raised earlier. However, I will review Mr. Rossi's certification when it comes in to make certain
it covers such a structure.
By way of information for you, we do not inspect for compliance with construction documents, as that is
the clear responsibility of a design professional. Our inspections are to determine compliance with all
laws, rules, regulations, ordinances, etc. In the end, the Design Professional certifies conformance with
construction documents and laws, et al. (LDR Chapter 6, Article V, Section 5).

SUBJECT: Request for Information- Lawrence Lakes Estates
Last week, Mayor Taylor, Tambri Heyden and I met with a Mr. Carson who is a
homeowner living in Lawrence Lakes Estates. Mr. Carson had a number of complaints
about the developer of this project, but in the end, he only asked two things of us, both of
which I said I would try to accommodate. He asked if we can pull a copy of either the
original inspection ticket or the fence permit, for a perimeter fence which was erected in
this development around 9/30/87. He was concerned because he believes the original
fence installation should have been cedar and it ultimately was cypress.
Secondly, Mr. Carson claims that there were a series of drainage improvements which
should have been built as part of the original construction, but that this original drainage
structure (outfall to a Lake Worth Drainage District canal) was never completed according
to the original, approved construction documents. He has a copy of those documents
which he would be more than happy to share with you.
On this second issue, could you please call Mr. Carson at 735-9217, asking him to forward
those drainage plans on to you for review? I would like to know your opinion regarding his
claim. On the first issue, can you please research our records to determine if we have the
information on file about the original fence material approval, and if you can determine that,
would you please forward the same to me?
