The undersigned as applicant for final Site Plan Approval does hereby acknowledge, represent and agree that
all plans, specifications, drawings, engineering, and other data submitted with this application for review by the
City of Boynton Beach shall be reviewed by the various boards, commissions, staff personnel and other parties
designated, appointed or employed by the City of Boynton Beach, and any such party reviewing the same shall
rely upon the accuracy thereof, and any change in any item submitted shall be deemed material and substantial.
The undersigned hereby agrees that all plans, specifications, drawings, engineering and other data which
may be approved by the City of Boynton Beach, or its boards, commissions, staff or designees shall be
constructed in strict compliance with the form in which they are approved, and any change to the same shall be
deemed material and shall place the applicant in violation of this application and all approvals and permits which
may be granted.
The applicant agrees to allow the City of Boynton Beach all rights and remedies as provided for by the

DEVELOPMENT ORDERS OR PERMITS
Please be advised that all applications for the following land development orders and permits which are submitted
on or after June 1, 1990 will be subject to the City's Concurrency Management Ordinance, and cannot be
approved unless public facilities (potable water, sanitary sewer, drainage, solid waste, recreation, park, and road
facilities) would be available to serve the project, consistent with the levels of service which are adopted in the
City's Comprehensive Plan:
Building permit applications for the construction of improvements which, in and by themselves, would
create demand for public facilities.
Applications for site plan approval.
Applications for conditional use approval.
Applications for subdivision master plan approval.
Applications for preliminary plat approval.
Applications for final plat approval.
Applications for rezoning to planned zoning districts.
Applications for revisions to any of the applications listed above, which would increase the demand for any
public facility
Any other application which, in and by itself, would establish the density or intensity of use of land, or a
maximum density or intensity of use of land.

Applications for building permit, if a site plan or conditional use application was submitted prior to June 1,

Section 1 Submission Requirements.
Each applicant shall submit to the Planning and Zoning Division the following plans and exhibits in the number of
copies specified by the Planning and Zoning Division, together with a Site Plan Review application and a fee
adopted by resolution by the City Commission.
12 ASSEMBLED COPIES REQUIRED
A. Existina site characteristics map: A sealed survey, not older than six months, showing all adjacent streets,
alleys and driveways, and also illustrating:
1 Existing natural features, including but not limited to lakes, trees and other vegetation and
soils and topography
2. Existing buildings, building elevations, other structures, including use, height, dimensions
and setbacks.
3. Existing utility lines and all easements.
4 Existing elevations (corner, street and finished floor)
B. Site development plan:
1 A scaled drawing clearly illustrating proposed buildings and other structures, and any
existing buildings and structures which are to be retained, including use, height, dimensions
and setbacks.
2. Proposed off-street parking spaces, driveways and sidewalks, including location,
dimensions and setbacks, traffic control markings and signage.
3. Proposed fences and walls, including location, dimensions, setbacks, height and material.
4. Proposed location of lighting on site.
5. Proposed dumpster location.
C. Landscape plan:
1 A separate scaled drawing (at the same scale as the site development plan) prepared as

The 1966 Legislature approved Bouse Bill 403 which authorized chartersdloots in F="larida. The bm was signed by the
Governor on May 17 1966. Under this new law. prill3te ch:lrtJlr entities may enter into agreements with scl100I boa.rdS
to provide educational services to the district's students. The fiilcilities in which these educational services are provided
must meet minimum re(luirements as established in the Charter School Law.
FACILITIES REQUIREMENTS AS STATED IN LEGISLATIVE LANGUAGE
Section 228.056(16)(a) reads a. follows:

School administrators shall notify students and employees when and if it is safe to return
to, the building. Parents shall be notified as soon as possible.
F In the event of a natural disaster, portable buildings shall be evacuated and students and
employees moved to a permanent building.
G. Parents shall be notified of the location 'and advisecj as to when their child inay be
transported to their residence or when parents could arrange for transportation of the
student.
H. In the event of a health hazard, the county health department shall be notified.
1. In all emergency situations, Charter School officials shall take all precautions necessary
to protect the health and safety of the students and other employees.
J The Charter School shall comply With all applicable'Federal, State and Local laws, rules
and codes pertaining to this section.
23.0 Facilities
A. The Charter School shall either utilize facilities which comply with the Slate Uniform
Building Code for Public Educational Facilities Construction adopted plU'Suant to
~235.26, F.S., or with applicable state minimum buildi~ codes pursuant to Chapter 553,
F.S. and State Minimum Fire PrOTecTion Codes plU'Suant to g633.025, F.S. and
ComprehensiVe: Land Use Plans and Land Development Codes as adopted by the
authority in the jurisdiction where the Charter School is located.
B. The Charter School agrees to use or construct facilities at locations in Palm Beach
County, Florida_ The Sponsor is not obligated to lease District facilities to the Charter
School.
C. Upon promulgation, Charter School facilities shaH utilize facilities which comply with
the Florida Building Code, pursuant to Chapter 553, F .S. and the Florida Fire Prevention
Code, pursuant to Chapter 633, F.S.
D. The Charter School is responsible for the initiation and provision of inspections and
occupational license as required. All facilities, including leased facilities, must be
inspected annually by a certified Fire Marshal or inspection specialist. Other inspection
agencies may include, but are not limited to, the Palm Beach County Health Department.
The Charter School must provide proof of the annual inspections to the Sponsor.
E. The Charter School agrees to provide the Sponsor a description of its educational
facilities and documentation that verifies that building codes are met or when applicable,
that all occupational license have been issued.
F No later than one week before the Charter School begins holding classes, the Charter

School shall provide the Sponsor the copy of a deed, lease or other legal instrument
documenting that the Charter School has the right to occupy and use the facilities for the
Charter School.
G. The Charter School agrees to provide the Sponsor with documentation regarding the
Charter School's property interest (owner or lessor) in the property and facility where the
Charter School will operate. If the Charter School does not Own the property and facility,
the Charter School must provide the signed lease befoie the initial opening day of classes.
H. The Charter School will present proof of the appropriate facility certification (including
all certificates that are required by applicable building codes) to the Sponsor before the
initial opening day of classes. If the Charter School does not have the appropriate
certifications by the initial opening day of classes, this Charter School Charter shall
terminate.
1. In the event the Charter School is dissolved or is otherwise terminated, all of the
Sponsors property and improvements, furnishings and equipment purchased with public
funds shall be peacefully and promptly delivered to the Sponsor and shall automatically
revert to full ownership by the. Sponsor. Any property and improvements, furnishings
and equipment purchased from other funding sources which have not been reimbursed
by public funds shall be the property of the Charter School should the Charter School
Charter terminate or not be renewed. However, ownership of an asset will revert to
Sponsor in the event of termination or non-renewal of the Charter School Charter if the
Charter Sch(J(l!'s accounting records fail to clearly establish whether a particular asset
was purchased with public funds from another source. Any assets existing at the time of
termination or non-renewal of this Charter School Charter which have been funded by
both funds described in this Charler, shall be equitably divided between the parties. Any
disputes concerning such equitable division of assets shall be addressed through the
dispute resolution provisions available through ~228.056, F.S., or Sections 31 & 32 of
this Charter School Charter. The financial and auditing personnel and staff of the
Sponsor and the Charter School shall cooperate in and coordinate the proper
identification and sources of funding for the property and improvements, furnishings, and
equipment purchased for the Charter School and the appropriate record keeping of same,
during the term hereof or any extensions of this Charter School Charter.
J. The Charler School must provide notice to the Sponsor of any proposed material
additions, changes and renovations to be made to the Charter School facility, as described
in the Charter. Such additional changes or renovated facilities may not be utilized for
student activities until the Sponsor is provided copies of certificates of occupancy issued
for such facilities and if applicable (written approval obtained from the Palm Beach
County Traffic Engineering Department as to traffic control and pedestrian travel
associated with said facilities.) A "material addition, change or renovation" is defined as
any improvement to real property that alters the square footage of the educational facility.
K. If a facility Or property of the Sponsor is available because it is surplus, marked for

disposal, or is other\Vise unused, the Sponsor may choose to provide it for the Charter
School's use. If the Charter School received a surplus facility or surplus property from
the Sponsor, the Charter School may not sell or dispose of same without written
permission of the Sponsor. The Charter School's organizers agree to take reasonable
measures to maintain any surplus fucility or property in a manner similar to standards
employed by the Sponsor.
L. The Charter School shall advise the Sponsor of its''plan or intention to relocate the
Charter SchooL The Charter School must keep the Sponsor apprised at all times of the
location of the students attending the Charter School. The Charter School must notify the
Sponsor and advise of the proposed new location and present official verification of the
issuance of an occupational license and any other documentation required to operate the
Charter School in the new location prior to the first day of classes.
24.0 Transportation
A. Transportation is the responsibility of the Charter School and must be provided according
to the district, state, and federal rules and regulations.
B. The Charter School agrees to provide for transportation of the Charter School's students
consistent with the requirements of Chapter 234, F.S.
1. The Charter School agrees that transportation shall not be a barrier to equal
access for any student residing within a reasonable distance of the Charter School
as deteanined by the Charter School's transportation plan.
2. The term ''reasonable distance" shall be defined in accordance with Chapters 228
through 246, F.S.
3. The Charter School shall transport children with disabilities who enroll in the
school.
4. The Charter School may contract with the Sponsor for student transportation
services or,with a Sponsor-approved private transportation finn. lfusing an
approved private firm, the Charter School must submit to the Sponsor the finn's
name and a copy of the final transportation plan. .
5. Any information to be shared with the public regarding transportation, provided
by the Sponsor, must be approved by the Sponsor prior to distribution.
