The above referenced project is nearing completion. Prior to the Building Division issuing the
Certificate of Occupancy, I would like to ensure that you do not have any outstanding or pending
conditions concerning this site that must be rectified (excluding issues that are covered entirely
with a City approved surety).
If any outstanding conditions are related to permits issued by the Building Division, please
provide this division a memorandum containing a description of the unresolved conditions. If
the unresolved conditions are not permit related, please notify the owner or the owner's agent to
ensure that the matters are rectified.
Please respond to me, within ten (10) days, in order that we may proceed in a timely manner to
issue the Certificate of Occupancy No response is necessary if your department is satisfied with
the current state of the above referenced site. Thank you for your cooperation.

g~tes that were originally approved. I have attachl!d a detail for the new trash and nocycling
endosurw.
. Wendy's has condensers located on top of the exterior cooler In an effort to comply with the
CRA and the City CommiSSion, Wendy's will provide a metal screen the roof top oondensers,
which will be painted to match the cooler, which is 'cocoa whi~' I have attached a detail and
e~vation of the condenser screen for yPl.lr review.
. Wencrys will try to match the existing rool tile of the shopping center I will provide you a sample
for your review and approval before tt1e contractor instans the roof tile.

The present operators of the shoppinQ; comer have been lax in keeping our property free
from their debre' It bas been expensive for us to clean up their trash and in spite of the
promises from the City of Boynton to have them take responsibility fur their trash, it still

Dear Ms.Coa\e,
Per yow request, the following information has been compiled as the
redevelopment of RiveIWalk Plaza continues.
The existing shoppmg center consisted ofl2'5,997 square feet. The current
approved site plan reduced the shopping center down to 122,077 square feet
with a 3,92<l square foot red~tion.
With this application we are further redw:ing the sIZe of the shopping ~nter
by 1,650 square feet for a total ofa 5,570 square foot reduction.
The shopping center has now been reduced tl> a total of 120.427 square feet.
Since a reduction in the size and impact of the shopping center is being
further reduced with Wendys, a traffic study should not be required.

Mike,
I spoke to Jennifer Lysak at Land Design South and told her the anticipated site plan review process for the above
referenced proposed project As per our discussion (Mike, Lusia, and Eric), the proposed Wendy's will be considered part
of the Riverwalk Plaza site plan. Since it is a component of the Riverwalk Plaza site plan and not a separate out-parcel,
the project is considered as a major site plan modification and as a conditional use (because of the drive-through facility).
The public notification area shall be based on 400 feet from the perimeter of the entire Riverwalk Plaza, not just the
Wendy's leased area.

Mike,
On Monday, I met with Jeff Stoven from Land Design South regarding a proposed Wendy's restaurant to be located
east of the existing bank. I pulled the master plan for the shopping center and it looks to me like the area in question
is an outparcel of the shopping center As you know, Riverwalk Plaza is zoned C-3, not PCD The unique thing about
the plan is that this outparcel's building area (which is considered "retail") was included within the building area and
associated parking requirements for the entire shopping center Strangely enough, Mr Stoven's proposed plan
changes the boundary of the apparent outparceL
Questions:
1 Is the Riverwalk Plaza considered a site plan or master plan?Since it is not a PCD and there is not a formal
approval called a master plan, I would call it a "site plan" You call it a "master plan" above. Is that because the
document or the file is called a "master plan"?
2. Since restaurant use has different parking requirement than "retail", would the Riverwalk Plaza plan have to go
through a modification of its own? Or do all uses in a "shopping plaza fall under 1/200 parking requirement? The code
applies a 1/200 ratio to "shopping centers" to allow for an average (offices would have lower rates and restaurants
could have higher rates).
3. Is the subject property considered an outparcel of the Riverwalk Plaza plan? This is an older shopping center I
don't know that question off the top of my head. From what you have said above, the site was included in with the total
tabular figures of the site, right? Which if it is that clear it must be part of the overall site plan.
4 If not considered an outparcel, then the Wendy's at Riverwalk Plaza would have to be processed as a masterplan
modification...correct? Let's hope it is already in the plan as you seem to describe above. But we should focus on
square footage figures and if it is included or not. If not, and if it is a master plan which I doubt since master plans are
typically approved under an ordinance for the rezoning, the site plan could be modified to include it, cross-access
easements would be needed, and sufficient parking would be need to support the additional square footage if not
constructed originally
5. If the subj/lct property is considered an outparcel of the Riverwalk Plan, then the Wendys' would have to go through
new site plan review and the Riverwalk Plaza would have to through master plan modification b/c the boundaries are
changing...correct? The question remains regarding if it is a master plan. I think I have asked the two main questions-
Is it called a master plan on the file and plan? and Does the tabular actually show the square footage included?
