~ John, In response to your summary of the meeting held with staff, I wanted to convey an
interpretation of the new code which may reduce the total number of variances The
language in the code reads "at least one whole platted lotn or something similar I
believe staff was communicating this to mean that the whole platted lot had to be alone
or combined with another whole platted lot Instead, it will be interpreted to mean not
less than one whole platted lot so you could develop in accordance with the non~
conforming regulations a lot combined with a partial lot if it met the minimum standards
of the non-conforming regulations Perhaps you interpreted it this way, but if not
please consider this in your planning Also let me know if you have any questions

participants were Tony, Paul, Charley Fix, Diana Hileman and I; BB
staff Eric Johnson, Jose Alfaro (P&Z, 742-6260), Keiv Hall, Mike Rumpf
(P&Z) , and Tim Large (Permit Admin) Some other staff left before the
sign in sheet was passed

2 Diana asked if Unity of Title PCNs needed to be assigned before
permitting NO - they only need a legal description of new lots that can
be created by doing new Warranty Deeds to ourselves, a 2 day process
Diana says The critical path is getting sealed surveys for May 1st
variance submission
CD Site plans Jose pointed out side setback requirements different than
the 7 5' we had assumed With the new setback requirements we would have
to get variances to put any of our current house plans on the merged lots
(11th Ave is OK for a 3/1 like we are currently building in Delray) The
build area for 2 SFR without variance is 421 wide x 401 deep for the 621
frontage lot and 44 5' x 401 for the corner lot
Our options are
a) Submit 2 variances for setback relief
b) Build a common wall duplex
c) Design customized houses
We are exploring option c)

4 They have no problem with us pulling our own permits according to the
FL Statute Title XXXII 489 103 exemption for Habitat
5 Shed The 101 X 81 Lowers shed can go 31 from property line and 121

2 Octavia does not have fee coverage for Habitat in this years budget
She needs to know how much money we are talking about before committing

which is based on the size of the house
3 Charley will negotiate getting a budget item for 2 houses into

Variance Request by Habitat for Humanity for 312 12h Ave

We are requesting variance from 6,000 sq ft to 5,580 in order to accommodate the construction
of affordable housing in Boynton Beach.
A, We purchased 3 adjoining lots with 48' frontage and combined them into 2 lots in order to
meet the 60' min. frontage requirement for R2 => Rl zoning, but since the lots are only 90'
deep, one lot fails to meet the required 6,000 sq ft area.
B. The lot would be unbuildable without a variance due to surrounding property restrictions not
caused by the applicant.
c. Recent ordinance 0148 gives permission to affordable housing developers to build on 50'
frontage and 5,000 sq ft lots without a variance but that applies only of originally platted lots.
D See B above. Affordable housing builders need to have this type of variance to obtain infill
lots and keep the prices affordable.
E. This variance will allow Habitat for Humanity to build 2 houses on the former lots one of
which would be unbuildable (lot 12 with a 45 ' frontage)
F It is a recognized fact that Habitat homes and home owners upgrade the neighborhoods in
which we build, reduce crime, and add to the tax base of the community
For these reasons we feel it is in the communities best interest to grant the variance to facilitate
affordable housing.
