Dear Mr. Pineas:
In response to your request for the administrative review and approval of the modification proposed to the
above-referenced, approved site plan, depicting the following:
. Outdoor seats (22 Total Seats).
Please be informed that the proposed change as shown on the revised plan date stamped 09/15/03 is "minor",
as defined within the Land Development Regulations, Chapter 4- Site Plan Review This project may
continue to be processed by the Building Division as a permit application, subject to the following conditions:
1 No more than two (2) chairs may be placed at the outdoor tables and their placement shall be exactly
as shown on the attached drawing, so as not to impede pedestrian traffic;
2. The outdoor table locations shall be exactly as shown on the attached drawing, and a minimum 48-
inch aisle shall be maintained to facilitate pedestrian traffic;
3 The outdoor tables and chairs shall be stored inside the store at the close of business each day;
4 The outdoor tables and chairs must be maintained in good repair;
5 The sidewalk area utilized for the outdoor seating must be monitored several times during the hours of
operation to ensure cleanliness and thoroughly cleaned daily;
6. Since this business was approved for 28 seats, update the business occupational license to reflect the
proposed change for the extra seats in excess of28.

Dear Mr Ducoste.
As requested, please note that the Landlord approved the outside seating area
for the referenced tenant at Cross Creek Centre under the following conditions:
"Sidewalk Tabtes. The restaurant sidewalk frontage directly adjacent to
Tenant's storefront (currently outlined with a gated awning) may be used
for dining tables which is subject to' 1) the Landlord's approval, in its
sole discretion as to the style, color, quality, etc. of the awning, tables
and furnishings; 2) upon Tenant's receipt of the necessary authorization
and permits from the applicable government agencies. No additional
rent shall be due for the use of this space. However, the Tenant shall
be responsible for all impact fees, permits and/or miscellaneous fees
associated with this use."
The Landlord has given its approval as to the style and type of tables currently
in use at this location. Please feel free to call me if you need anything further
