Dear Mr Perry'
In response to your request for the administrative review and approval of the modifications proposed to the
above-referenced, approved site plan, please be informed that the new canopy as shown on the revised plans
date stamped by Planning and Zoning 11/15/0 I is not approved.
The dimensions of the new canopy (31'-6"x 53'-5") are larger than the existing canopy dimensions (25' x 53'-
5"). The existing canopy is non-conforming because it does not meet the C-3 district setback requirements. As
such it may only be replaced exactly as it is. It cannot further increase the non-conformity Attached is a copy of
Chapter 2, Section II IE for your information.

As per comments by plan reviewer Jose Alfaro, this letter is a request for a minor site plan
modification for replacement ofthe existing canopy over the fueling area with a new canopy of
equal size. Some minor damage has been caused to the canopy and due to its age, the cost to
repair and the remodel of the convenience store the owners have decided that they would like to
replace the canopy
