The survey you provided staff enabled us to determine that the church building occupies an area of 1,452 square feet on a lot area of 4,050 square feet. The regulations require maximum lot coverage of 40%, which equals a maximum of 1620 Square feet. The proposed improvements to the existing building would increase the lot coverage from 1,452 square feet to 1,574 square feet. Therefore, a variance application is not necessary contrary to our original analysis. Please note that our calculations are based solely on the survey, and our determination that lot coverage does not necessitate the need for a variance is contingent upon building plans reflecting perimeter dimensions similar to that shown on the survey Please note that all building codes must also be met prior to issuance of a permit. The minimum required interior side setback is 10 feet whereas the existing side setback is in compliance at 11.50 feet. The building is used as a one-story Church in a residential district. Due to lack of compliance with the minimum required setbacks, lot size and frontage requirement for a church, this property and improvements are considered to be legal non-conforming, or " grandfathered .. There are limitations to the physical improvements allowed to non-conforming properties. Although existing structures can be expanded out to existing non-conforming setbacks, a variance for lot coverage in excess of 40%, would be required. Please note that variances are processed over a 6 to 8 week period and require review and approval by the City Commission. Prior to the submittal plans to this office, a pre-application is required with Staff, which is conducted without a fee. Agreement with Daise Temple for ROW use I got the Temporary License Agreement and the letter from the insurance agent. There has to be an insurable interest on the part of the Licensee. If they own the property of the easement then there is an insurable interest. If the easement requires the owner to maintain the property then there is liability on the part of the owner and it can be insured. I have put together wording for contracts involving insurance requirements. The alley no longer exists, is it supposed to be there? 2 There is a house with an address number of 403 on NE 3rd St., is this north or south of abandonment requested area? The map is not very clear and no survey stakes were present. The Fire Rescue Department would access the house at 403 but if they block off the roadway at NE 12th Ave and NE 3rd St., we need to know how it would be blocked. I think we need to develop a position and possibly a policy on the closing of access streets within and between developments. Streets should be maintained as required by their original site plan, unless a new site plan change is submitted through the Technical Review Committee. Allowing changes per the permitting process. through P and Z, as opposed to a TRC/site plan process disallows public safety issues to be addressed in a timely manner The end result ;s that PD and FD look like the bad guys as problematic issues are brought up after P & Z approval.
