That may be true, but once the r/w is abandoned, the new 'owner' Daise will have to grant the
easement back to the city; it should have been done all at once. We will have to get this done before
any building permits are issued for the church building expansion. Please make Tim Large aware of

We can do the legal and setup for City Commission action to "accept" a utility
easement. The question is, should this not have gone simultaneously with the
abandonment of the roadway issue? That would have allowed the simplicity of the legal
descriptions to superimpose on top of each other.

Dear Pastor Gibbons:
This letter is written to confirm the discussion we had on May 23"', 200 I and to serve as an
update to the first correspondence we sent to you and dated May 18th, 2001
The City's regulations allow non-conforming properties to expand out to existing non-
conforming setbacks, but would necessitate a variance for lot coverage in excess of 40% per R-2
regulations.
The survey you provided staff enabled us to determine that the church building occupies an area
of 1,452 square feet on a lot area of 4,050 square feet. The regulations require maximum lot
coverage of 40%, which equals a maximum of 1620 Square feet. The proposed improvements to
the existing building would increase the lot coverage from 1,452 square feet to 1,574 square feet.
Therefore, a variance application is not necessary contrary to our original analysis.
Please note that our calculations are based solely on the survey, and our determination that lot
coverage does not necessitate the need for a variance is contingent upon building plans reflecting
perimeter dimensions similar to that shown on the survey Please note that all building codes must
also be met prior to issuance of a permit.
Lastly, as also discussed with you, please provide in writing any comments, objections and
proposed changes to the draft right-of-way agreement. Both the City Attorney and I will review
your feedback and respond as needed.

Dear Pastor Gibbons:
Please be advised that the property located at 340 NE 12th Avenue, Boynton Beach, Florida, is
currently zoned R-2, Single and Two Family Residential District, according to the Official
Zoning Map for the City of Boynton Beach, Florida.
According to the survey that you provided staff (see attached); the property is a comer lot with a
double frontage. The City's regulations require that churches be constructed on parcels with a
minimum of one (I) acre, minimum lot frontage of 150 feet, and at a maximum lot coverage of
40%. The regulations also require a minimum 25.foot front yard setback and a minimum of 12.5
feet for the second front setback; the existing front setback is 16.65 feet along NE 12th Avenue,
and the second front setback along NW 3'" Street is 8.3 feet, which does not comply with the
minimum requirements. The minimum required interior side setback is 10 feet whereas the
existing side setback is in compliance at 11.50 feet. The building is used as a one-story Church in
a residential district. Due to lack of compliance with the minimum required setbacks, lot size and
frontage requirement for a church, this property and improvements are considered to be legal
non-conforming, or " grandfathered ..
There are limitations to the physical improvements allowed to non-conforming properties.
Although existing structures can be expanded out to existing non-conforming setbacks, a variance
for lot coverage in excess of 40%, would be required. Please note that variances are processed
over a 6 to 8 week period and require review and approval by the City Commission. Prior to the
submittal plans to this office, a pre-application is required with Staff, which is conducted without
a fee. Please note that all building codes must also be met prior to issuance of a permit.

INSURANCE
I It shall be the responsibility of the successful bidder to maintain workers'
compensation insurance, property damage, liability insurance and vehicular
liability insurance during the duration of this contract.
2. The successful bidder shall secure and maintain in force, throughout the duration
of this contract, comprehensive general and automobile liability insurance with a
minimum coverage of $1,000,000 per occurrence; $1,000,000 aggregate for
personal injury; $1,000,000 per occurrence/aggregate for property damage; and,
professional liability insurance in the amount of $1,000,000 (all professional
contract services).
3 Said general liability policy shall name the City of Boynton Beach as an
additional insured and shall include a provision prohibiting cancellation of said
policy except upon thirty (30) days prior written notice to the City
4 The successful bidder shall secure and maintain in force throughout the duration
of this contract workers' compensation insurance to statutory limits.
5 The successful bidder shall furnish the City with a certificate of insurance after
award has been made prior to the start of any work for the City Said insurance
companies must be authorized to do business in the State of Florida and the City
will not accept any company that has a rating less than B+ in accordance with
A.M. Best's Key Rating Guide, latest edition.
6. Reference Insurance Advisory Form (Attachment A) for additional types of

I got the Temporary License Agreement and the letter from the insurance agent. There has to be an insurable interest on
the part of the Licensee. If they own the property of the easement then there is an insurable interest. If the easement
requires the owner to maintain the property then there is liability on the part of the owner and it can be insured.
I have put together wording for contracts involving insurance requirements. I recommend you utiiize this wording and
replace with "Licensee" for "successful bidder" See attachment.

Gentleman, I believe we are reaching an impasse with the attempt to negotiate an agreement with them to use the
unimproved alley adjacent to the church. They still appear unable to meet the insurance options that I have clearly
communicated to them. I have attempted to be their liaison but at this stage I need additional assistance and the
presence of others who need to understand the status to assist with either brainstorming a solution or communicating
situation to Commission. They have requested another meeting with me and prefer early morning meetings. What is your

It should be noted that any abandonment consideration would require a unity oftitle declaration of the
adjacent lots thereto.
However, please be advised that the City, through the Utilities Department, has an existing 6-inch water
main within the NE 3rd Street right-of-way, and is currently installing a fiber-optic communications cable
in the same corridor. Therefore, this department recommends disapproval of the application for right-of-
way abandonment.

We have two questions.
1. The alley no longer exists, is it supposed to be there?
2 There is a house with an address number of 403 on NE 3rd St., is
this north or south of abandonment requested area?
The map is not very clear and no survey stakes were present.
The Fire Rescue Department would access the house at 403 but if they
block off the roadway at NE 12th Ave and NE 3rd St., we need to know
how it would be blocked.
We have no further comments and do not recommend forwarding until
questions are answered

Closing of Streets
Kurt.
Just a few thoughts regarding the ciosing of streets. I think we need to develop a position and possibly a policy on the
closing of access streets within and between developments. Streets should be maintained as required by their original site
plan, unless a new site plan change is submitted through the Technical Review Committee. Allowing changes per the
permitting process. through P and Z, as opposed to a TRC/site plan process disallows public safety issues to be
addressed in a timely manner The end result ;s that PD and FD look like the bad guys as problematic issues are brought
up after P & Z approval. Please refer to the City Code of Ordinances, Chapter 9, See 9-21 (f) for existing language that
addresses this issue.
