Dakota Lofts MSPM 02-006 Condition #46 - Re-review of floor plans and elevations 3010 South Federal Highway Location: Dear Mr. Trigger- Enclosed is a copy of the City of Boynton Beach Development Order for site plan approval granted on January 21, 2003, by the City Commission for major site plan modification to elevations and floor plans of nineteen (19) townhouse units in a Planned Unit Development (PUD). The approved site plan (including elevations and floor plans) is valid for one year from the original date of final approval (January 21, 2003). The Community Redevelopment Agency (CRA) approved the revised elevations and floor plans on March II, 2003. The CRA determined that the proposed plans comply with Condition of Approval No. 46, which stated: "Final far;:ade changes pursuant to the above condition shall return to the Board to confirm compliance prior to pulling a building permit" Please recall that this approval is conditioned upon reducing the proposed building colors, namely the #841 Nuevo Terra and #GH77 Capri, by two (2) color shades. In order to maintain vested status, a building permit must be secured or an extension granted within one year of final site plan approval. To continue this project through the development process, please revise relevant pages of your approved site plan to incorporate all conditions of approval as applicable. The full rectified site plan set is to be submitted as part of your permit plan package to the Building Division. The person managing your permit applications should be made aware of any additional documents and third party letters listed in the conditions of approval that need to be submitted with your permit package. The Building Division is committed to speedy and efficient completion of the building permit process for your project. However, please note that failure to meet all applicable development order conditions in the submitted rectified plan set may produce unnecessary delays in permit issuance. JfPT Re: Dedication of Paved Road Our File No.: TRED002 Dear Michael: Enclosed are aerial photographs which we obtained from Palm Beach County for the area surrounding Bamboo Lane. The first photograph is labeled Exhibit "A" and is dated April 4, 1965 The second photograph is labeled Exhibit "8" and is dated February 17, 1984 I have higplighted Bamboo Lane in each of the photographs with a pink highlighter Accordingly, it is evident that Bamboo Lane existed before 1965. We also point out to you that at some point between 1965 and 1984, a new property was developed on the north side of Bamboo Lane. I have highlighted this property in yellow on Exhibit "8" Certainly, the issue of ingress and egress to Federal Highway using Bamboo Lane was examined and successfully resolved before granting permits to build this house. This road could only be open forthis continuous period if constructed, paved and maintained by a governmental agency as most roads are. Therefore, it is clear that Bamboo Lane has been dedicated for the public to use to provide public ingress and egress. Even if you assume for a moment that Bamboo Lane has not been dedicated, it would be a public street as an easement by prescription. It meets the requirements of an easement by prescription. First, the public has had a continuing and an un-interpreted use of Bamboo Lane for at least twenty (20) years. Secondly, as evidenced by the aerial photograph, Bamboo Lane can be identified in its length, location and width. Finally, the use has been adverse under claim of right. Mr Michael W Rumpf November 11, 2002 Page 2 Additionally, since there is no proof that any taxes or special assessments have been levied or collected on the land, this also leads to the conclusion that there has been a dedication of Bamboo Lane. For all of these reasons, Bamboo Lane is a public street. See, for example, Waterman v.
