Please be advised that site plan approval for the above referenced project expired on January 21,
2004.
The City Commission granted site plan approval on January 21, 2003. To date, no building permit
has been issued for this project. A building permit must be secured within one year of site plan
approval in order to maintain the vested status.
Consequently, a new site plan application must be submitted for this project.
Please call the Planning and Zoning Division at (561) 742-6260 for more information regarding site
plan application procedures.

Dear Mr. Trigger-
Enclosed is a copy of the City of Boynton Beach Development Order for site plan
approval granted on January 21, 2003, by the City Commission for major site plan
modification to elevations and floor plans of nineteen (19) townhouse units in a Planned
Unit Development (PUD). The approved site plan (including elevations and floor plans)
is valid for one year from the original date of final approval (January 21, 2003). The
Community Redevelopment Agency (CRA) approved the revised elevations and floor
plans on March II, 2003. The CRA determined that the proposed plans comply with
Condition of Approval No. 46, which stated:
"Final far;:ade changes pursuant to the above condition shall return to the Board to
confirm compliance prior to pulling a building permit"
Please recall that this approval is conditioned upon reducing the proposed building
colors, namely the #841 Nuevo Terra and #GH77 Capri, by two (2) color shades.
In order to maintain vested status, a building permit must be secured or an extension
granted within one year of final site plan approval. To continue this project through the
development process, please revise relevant pages of your approved site plan to
incorporate all conditions of approval as applicable. The full rectified site plan set is to
be submitted as part of your permit plan package to the Building Division. The person
managing your permit applications should be made aware of any additional documents
and third party letters listed in the conditions of approval that need to be submitted with
your permit package.
The Building Division is committed to speedy and efficient completion of the building
permit process for your project. However, please note that failure to meet all applicable
development order conditions in the submitted rectified plan set may produce
unnecessary delays in permit issuance. Feel free to contact any TRC member for
additional clarification of comments(s).

Dear Michael:
Enclosed are aerial photographs which we obtained from Palm Beach County for
the area surrounding Bamboo Lane. The first photograph is labeled Exhibit "A" and is
dated April 4, 1965 The second photograph is labeled Exhibit "8" and is dated February
17, 1984
I have higplighted Bamboo Lane in each of the photographs with a pink highlighter
Accordingly, it is evident that Bamboo Lane existed before 1965. We also point out to you
that at some point between 1965 and 1984, a new property was developed on the north
side of Bamboo Lane. I have highlighted this property in yellow on Exhibit "8" Certainly,
the issue of ingress and egress to Federal Highway using Bamboo Lane was examined
and successfully resolved before granting permits to build this house. This road could only
be open forthis continuous period if constructed, paved and maintained by a governmental
agency as most roads are.
Therefore, it is clear that Bamboo Lane has been dedicated for the public to use to
provide public ingress and egress. Even if you assume for a moment that Bamboo Lane
has not been dedicated, it would be a public street as an easement by prescription. It
meets the requirements of an easement by prescription. First, the public has had a
continuing and an un-interpreted use of Bamboo Lane for at least twenty (20) years.
Secondly, as evidenced by the aerial photograph, Bamboo Lane can be identified in its
length, location and width. Finally, the use has been adverse under claim of right.

Additionally, since there is no proof that any taxes or special assessments have
been levied or collected on the land, this also leads to the conclusion that there has been
a dedication of Bamboo Lane.
For all of these reasons, Bamboo Lane is a public street. See, for example,
Waterman v. Smith, 94 SO.2d 186 (1957), a case decided by the Florida Supreme Court
on similar facts.

December 3, 2002.
Attached are the revised "1st Review Comments" and the ongmal project's
ConditIOns of Approval. The reason for the miscommunication was because you
provided the Planning & Zoning Division WIth a new SIte plan application and
completed set of plans. This misled staff to believe that the proposed changes were
more than just modifications to the elevations and floor plans. However, after
careful examinatIOn, no plans, other than the elevatlOns or floor plans were
significantly modified since the City Commission approved the project. Staff
apologizes for the anxiety this may have caused you.
To stay on the current review schedule, please do the following steps listed below,
and bring all documents to the TRC scheduled for Tuesday, December 17, 2002.

Tuesday TRC mceting that you desire to attend. The remainder of the review schedule will be
adjusted accordingly If you have questions on the attached comments, please contact the

If the plans are reasonably complete and all significant comments are addressed following TRC
(2nd review), the project is forwarded to the Planning and Development Board Meeting that falls

comment that must be addressed prior to moving forward to the Planning and Development
board.
Note: Items recognized by staff as typically outstanding at this point include a traffic report
and/or confirm.ation of the traffic concurrency approval from the Palm Beach County

form and colored elevations of the proposed project. This information is necessary for

hls word and his attorney talks out oflWO sides of his mouth. Sometimes sizing up your opponent Is as

living as we have been.
Additionally, we would like Dakota Lofts or GA Homes to post a surety bond on our homes Itlr damage: that
may result rrom compacting and O!hcr construellon in the months ahead. They need to provtde silk
screening within thc fence walls as dirt is clllTClltly flying all over our pool area and bealll. Don Johnson
had Instructed Ihem to do this earlier as well as to keep the din mois!. They did it for a couple of weeks and
Ihen let It go again.
As for our canal righta. we wi11live with the curnmteuemenl which p1UI1s us everything but the righllo
repair or teplace our dock. I'm sure our new nelpbors will be more than willing 10 sign the permit
application wl1cn the dock becomes dilapltared and falls Inlo their canal. It may work in our filvor as we
now have no obligation to panicipate in the maintenance oflhe canal based on Mr Trigger's decision to
relinquish his earlier commitment.

Per our discussion, below ple_fiud the main difIerent points of the Elevation cbanse at
the Dakota Loft Project:
1. We have made all the building faces (Front, Rear, and Sides) uniibon.
2. We iDsttted that all windows have the mullion lines.
3. Roo.fline was made to be a repeated look between the different buildings.
4. Although we stayed at the same setback, we provided an extra 4 feet in front of
the garage to insure easy maneuvering by residents to go in and out of garages.
5. Balcony in front and back is built outside of the building :6I.ce instead of into the
buildiDg, to add extra sllape to building and to 1m:ak.lhe 11at look of the buildmg.
6. Floor plans have minor cbangeB, we stayed with only 2 iloor plan options to
insure the buildings will have 11 Ullifurm look from outside. The 2 floor fllan
options are repeated at all 3 buildings.
These are the changes we have made to the elevation with a strong believe that these
changes provide a high class look fur the community which will provide the new
residents with a luxurious community look and value fur their property.

on January 21, 2003, by the City Commission for major site plan modification to elevations and
floor plans of nineteen (19) townhouse units in a Planned Unit Development (PUD). Site plan
approval is valid for one year from the date of final approval. In order to maintain vested status, a
building permit must be secured or an extension granted within one year of final site plan
approval.
To continue this project through the development process, please revise relevant pages of your
approved site plan to incorporate all conditions of approval as applicable. The full rectified site
plan set is to be submitted as part of your permit plan package to the Building Division. The
person managing your permit applications should be made aware of any additional documents
and third party letters listed in the conditions of approval that need to be submitted with your
permit package.
The Building Division is committed to speedy and efficient completion of the building permit
process for your project. However, please note that failure to meet all applicable development
order conditions in the submitted rectified plan set may produce unnecessary delays in permit
issuance. Feel free to contact any TRC member for additional clarification of comments(s).
Important: If you plan to introduce any changes to your approved site plan over and above those
required by conditions of approval, please contact our staff before submitting a permit package
