Enclosed is a copy of the City of Boynton Beach Development Order for site plan
approval granted on January 21, 2003, by the City Commission for major site plan
modification to elevations and floor plans of nineteen (19) townhouse units in a Planned
Unit Development (PUD). The approved site plan (including elevations and floor plans)
is valid for one year from the original date of final approval (January 21, 2003). The
Community Redevelopment Agency (CRA) approved the revised elevatIOns and floor
plans on March 11, 2003 The CRA determined that the proposed plans comply with
Condition of Approval No. 46, which stated.
"Final far;:ade changes pursuant to the above condition shall return to the Board to
confirm compliance prior to pulling a building permit"
Please recall that this approval is conditioned upon reducing the proposed building
colors, namely the #841 Nuevo Terra and #GH77 Capri, by two (2) color shades.
In order to maintain vested status, a building permit must be secured or an extension
granted within one year of final site plan approvaL To continue this project through the
development process, please revise relevant pages of your approved site plan to
incorporate all conditions of approval as applicable. The full rectified site plan set is to
be submitted as part of your permit plan package to the Building Division. The person
managing your permit applications should be made aware of any additional documents
and third party letters listed in the conditions of approval that need to be submitted with
your permit package.
The Building Division is committed to speedy and efficient completion of the building
permit process for your project. However, please note that failure to meet all applicable
development order conditions in the submitted rectified plan set may produce
unnecessary delays in permit issuance. Feel free to contact any TRC member for
additional clarification of comments(s).

In cases when we are dealing with an atypical change in the process, and which involves someone unfamiliar with our
process, I think the active role is the best. Didn't we provide something in writing to Land Design South or Centex
regarding The Harbors project? Which could be used in this case. Please check and tailor it for this case. We just need
to remind them of that condition and what it requires prior to pulling a building permit. How much time is should be
submitted prior to eRA and the dates of the CRA meetings. Thanks, MR.

had not time to think about it. Since we wouldn't want the inconsistency to exist, which wouldn't iook good on

Just a slight correction to what Eric just stated. The changes to return to the CRA do not move forward
to the Commission. This is unique but unless there are complications, it will end with the CRA's
confirmation of the facade changes, pursuant to the condition. If all goes well, we will be given time to
review and respond to the applicants (thinking for the CRA). If we feel they are in compliance with the
CRA's concerns, we move them forward. If not we need to recommend the proper changes to again
be reviewed by staff. Unlike The Harbors where an end run was performed based on time and closing
details, we should treat this almost like a third review in formality. Mike

Today (2/10103), I met with Jan from Dakota Lofts regarding the 19-unit townhouse
project that was recently approved by the Commission for floor plan and elevation
changes. Jan had requested that I "sign-off' on plans that she was getting ready to
submit for building permits. I assume that her boss, Dror Trigger wanted some
assurance that the plans that they're getting ready to submit for permits would be
acceptable to City staff. I did not sign off on anything but gave her verbal affirmation that
the plans seemed acceptable. However, at the end of our 45-minute discussion, I
instructed her to submit for the building permits and promised her that I would assist you
(Karen) when you review the permit plans.
When she submits for building permits and when you start to review them, let me know,
and I will try to review them with you. Also, we should try to get some feedback from Mike
and possibly Kevin to determine if the landscape plan meets the intent of some of the

CRA's landscaping related conditions. We should not have to do this (review a project 2x
by 2 different people) but this Dakota Lofts will be the exception. Thanks,

his word and his attorney talks out oflWO .ides of his mouth. Sometimes sizing up your opponent is as

We fuund that the rooftine of the fi..e and six unit buildings had a very straight line and changed them to
reflect the same breaks in the roof that the eight unit building shOW<:d. By designing these two buildings
with the same modular look as the eight unit, it makes fur a more uniConn look to the community.
The fi..e unit building had no mullions in the windows at the side and rear so we added them to the new
elevatioo. The six unit did not have them on the sides so these were also added. We fl:lt that since
dill'e"""l .id... uf lhe buildings face the roads, having alllhe windows with mullion. ..... a mote elegant
look than ooly doing it hallWay.
The balconies on tbe seeond floor were originally inside the line oftbe building. whicb gave it a very flat
look. We kIt that by edending the balconies outside it would give more dimension and detail to the

on the property.

Per our discussion, below pltlllllt: Jiud the main different points of the Elevation change at
the Dakota Loft Project:
1. We have made all the building fuces (Front, Rear, and Sides) unifonn.
2. We insuretl that all windows have the mullion lines.
3. Roofline was made to be a repeated look between the different buildings.
4. Although we stayed at the same setback, we provided an extra 4 feet in front of
the garage to insure easy maneuvering by residents to go in and out of garages.
5. Balcony in front and back is buiJt outside of the building face instead of into the
building, to add extra sllape to buikling and to break l.hc:: llat look of the building.
6. FJoorplans have minor changes, we stayed with only 2 floor plan options to
insure the buildings will have fl uniform look from outside. 1be 2 floor fllan
options are repeated at aU 3 buildings.
1bese are the changes we have made to the elevation with a strong believe that these
changes provide a high class look for the community which will provide the new
residents with a luxurious community look and value fur their property

fixed glass windows, to prevent the occupants of these units from looking down on

In accordance with your facsimile dated December 10, 2002 to this office, you asked that all contact
concerning this project be via your office, henceforth we are addressing this letter to you.
This Division is in receipt of the (second) revised proposed record plat noted above, received on December
9, 2002 from the plat preparer. Again, we have reviewed this document in accordance with Chapter 177,
F.S. (Land Boundaries) Part I Platting, Chapter 472, F.S. (Land Surveying), and Chapter 61G17-6 FAC.
(Minimum Technical Standards) and those applicable codes section relating to the Land Development
Regulations of the City We still have found numerous discrepancies and/or omissions that will require the
attention of the preparer of this document that have not addressed satisfactorily In addition, we have noted
additional comments, which require attention. Once all of these items have been addressed, a (third) revised
proposed record plat shall be required as a re-submittal for final review and approval prior to obtaining any
(and all) signatories. Only at this point will the record mylar document of the proposed record plat be
submitted for City Commission approval and acceptance.
Having prefaced the review procedures, we offer the following comments on this submittal. Please note that
we will address the responses to the original September 13th comment review letter first. Then we will put
forth any additional comments observed, second. Finally, we will delineate any procedural needs required in
order to accept the proposed record plat by the City

or westward of the other private adjacent property owners, language in regards to the limited

shown in strips of land and labeled correctly All easements are to be labeled "UTILITY
EASEMENT(S)"; we do not specify them as one type of utility or another. Secondly, the correct
width of the easement is required to be shown, most notably the 12-foot (minimum) strip for the
easement. However, dimensioning to the centerline is permitted. For clarity, relocate the
bearing/distance ofthe centerline of the utility easements lying east of Lots 1 - 8, and south of Lots 9
- 14 after reflection of the easement bands.
In order to achieve this and provide clarity, you may have to change the scale of the drawing (ie, I" =

In reference to the Jeffrey A. Levine, Esq. letter of December 4th, I compliment him on the
chronological research performed on the R. P Swetrnan tract (since 1950) of which this proposed
record plat is a part thereof. However, his sixth (6th) event noted that Palm Beach County filed a
foreclosing action in 1970 to take quiet title on "numerous streets in the area because of failure to pay
taxes." I have asked our City Attorney's Office to obtain a copy of the final Order entered by the
Court on May 28, 1970, in order for me to determine ifin fact Bamboo Lane is a component to that

Order. At this point in time, I believe that Palm Beach County is the underlying owner of this parcel
ofland.
However, having not reviewed the above yet, one (I) of two (2) tasks need to happen in order to
resolve the status of Bamboo Lane. This augments Mr. Levine's fifth (5th) event where a survey and
legal description was prepared for Bamboo Lane. These tasks scenarios are as follows:
(I) If it is determined that Palm Beach Countv is the owner of this parcel of land, they would
need to be petitioned to declare this parcel of land as shown on the Hager, Palbicke & Associates,
Inc. survey to be an Ingress, Egress and Utility Easement to serve the intended purpose. It would
need to be filed with the Clerk of the Circuit Court's Office. Then it could be shown on this proposed
plat, citing the ORB and Page number, as the legal access to the proposed Tract "A" of this plat. It
would also serve the City's Utilities Department in extending a new 6-inch water main along Bamboo
Lane to serve those properties lying easterly of this plat (pursuant to City Commission direction).
This needs to be accomplished prior to the recording of this record plat; this action would be labeled
on the plat as 'existing'
(2) If it is determined that G. A. Homes. Inc. is the owner of this parcel of land (via a Quit Claim
deed), they would need to declare it as an Ingress, Egress and Utility Easement via being a
participant to this proposed plat, setting it forth in a tract letter designation, and as a signatory to the
record plat concurring to the easement dedication. This would be on the lead record plat sheet. In
addition, Palm Beach County would also be a signatory to the plat (as an acceptor of this portion of
the dedication) using the City's Record Plat Form V-7, since this parcel of land lies in the
unincorporated portion of Section 4, Twp. 46S, Rge. 43E.
There is an alternative to (2) above, but it is long and cumbersome, and would delay the project
longer than the developer would desire.
It is obvious that the sheets (pages) of this proposed record plat need to be thoroughly checked and
coordinated by the consulting land surveyor. Quality control is the responsibility of the plat preparer - not
the Engineering Division's staff.
After these proposed record plat comments have been addressed and re-submitted to this Division for another
review, once approved, a field review of the required monumentation will be undertaken. To facilitate this
effort, it will be requested of the surveyor-or-record to 'lathe and flag' all monuments and P C.P.s for

I am in receipt of your letter dated November 15, 2002, to Gerald L. Knight of the firm of
Holland and Knight. Our mutual client, Dakota, has askcd me to respond to your letter Actually,
Dakota has hired three (3) attorneys to assist it in resolving the issues that the City and you have
raised, eonsisting of Gerald Knight, Michael Weiner and me. It is tbe desire and intention of our
client to work as closclywith you as possible and to provide you and any other official o[the City
with any and all information that you require.
1 am primarily rcsponsib1c for investigating and evaluating title to thc DakoL.1. property and
the access question for Bamboo Lane. I have spent a great deal of timc over the last few weeks
working extremely closely with officials of Attorneys' Title Insurance Fund, Inc. to establish the
ansWers to the questions you previously raised. We have undertaken a thorough invcstigation due
to the fact that the issues that the City raised created some novel questions. As an aside, T anl sure
it was not Michael Weiner's intention to circumvent any of the questions that you previously asked
or cause any problems for you or the City in regard to his recent letter. JfMic!Jael's letter to Mr.
Rumpf caused you any concern, plcasc accept the apology on behalf of my client.
With all of the abovc being said, I would like to provide you with thc following information
(and copi.es of the pertinent back-up data) concerning the street known as Bamboo Lane;
1. In 1950, Robert P Swetman and Loretta T Swctman acquired a large tract of land
(including what is now Bamboo Lane) from Edwin T. Osteen. Said Deed was
recorded in Deed Book 908, at Page 241, of the Public Records of Palm Beach
County, Florida.

2. Mr. and lMrs. Swelrnan initiated the sale of various parcels of the tract ofland that
they acquired to many individuals. In fact, they prepared, but did not file, an
unrecorded Plat known as R.P Swetman Property. They then commenced a
systematic sale and conveyanec ofthe propertics by metes and bounds descriptions,
of the various "lots" as designated on thc urrfiled Plat. They did not convey thc
"strect" known as Bamboo Lane to any third party
3 On the 31st day of December, 1952, the Swctmans conveyed certain property within
the arca (including Bamboo Lane) to the Robert P Swctman Trust dated December
31,1952. Said Deed was recorded inDeed Book 1002, at Page 691, o[the Public
Records ofPalmBcach County, Florida.
4 The Fund cannot find any indication that the Swetmans or Mr. Swetman as Trustee
ever conveycd the property known as Bamboo Lane to any third party.
5. J ames Hager of Hager, Palbicke and Associates prepared a sketch of survey and legal
description which specifically shows Bamboo Lanc and indicates that said street is
contiguous on the southern border to the Dakota Lofts' property.
6. Tn 1970, Palm Beach County instituted an action (Case No. 70c2933) to foreclose
and/or quict title to numerous streets in the area because ofa failure to pay taxes. I
am enclosing a copy of an Order entered by thc Court on May 28, 1970 which
appears to establish that matter.
7 Mr. and Mrs. Swetman, who were residents of Florida, passed away many years ago.
We havc established that Mr. Swetman predeceased Mrs. Swctman. Mrs. Swelrnan's
probate was conducted in Orange County, Florida, in the Probate Division evidenced
by Case No. 76-1564 Mrs. Swetman had designatcd the Barnett Bank of Winter
Park, N.A. (now known as Bank of Amcrica) and attorney Glenn W Gilson II as
Personal Representatives of her Will. This individual and the bank were also the
final Trustees o[the Swetman Trust referred to above.
8. For many ycars, neither the Swetmans nOT anyone on their bchalf, paid taxes on the
property known as Bamboo Lane. We have established, and we will discuss later in
this lctter, Ulat thc Swetmans' fiduciaries and their heirs maintain that they have no
interest whatsocver in the Bamboo .Lanc area.

We have been in communication with the last Personal Representativcs and Trustees of the
Swctmans. They have been kind enough to executc and deliver to us a Quit Claim Deed for the arca
known as Bamboo Lane. The Grantee on the Quit Claim Deed is G.A. Homes, Inc., which is a
company that is wholly owned by one of the principals of Dakota Lofts Development Corporation.
The deeds (executed in counterparts) were rccorded on December 4, 2002 and 1 am enclosing
certified copies of the recorded instruments.
The title ofC.A. Homes, Inc. to "Bamboo Lanc" is subject to the rights of residents and
property owners (as well as any othcrrnembers ofthc public) to use and enjoy Bamboo Lane, which
rights may have been cstablished by law due to the historical, open, notorious, visible and
uninterrupted usc of the street.

Dear Michael:
Enclosed are aerial photographs which we obtained from Palm Beach County for
the area surrounding Bamboo Lane. The first photograph is labeled Exhibit "A" and is
dated April 4, 1965 The second photograph is labeled Exhibit "8" and is dated February
17,1984
I have highlighted Bamboo Lane in each of the photographs with a pink highlighter
Accordingly, it is evident that Bamboo Lane existed before 1965 We also point out to you
that at some point between 1965 and 1984, a new property was developed on the north
side of Bamboo Lane I have highlighted this property in yellow on Exhibit "8" Certainly,
the issue of ingress and egress to Federal Highway using Bamboo Lane was examined
and successfully resolved before granting permits to build this house. This road could only
be open forthis continuous period if constructed, paved and maintained by a governmental
agency as most roads are
Therefore, it is clear that Bamboo Lane has been dedicated for the public to use to
provide public ingress and egress. Even if you assume for a moment that Bamboo Lane
has not been dedicated, it would be a public street as an easement by prescription. It
meets the requirements of an easement by prescription. First, the public has had a
continuing and an un.interpreted use of Bamboo Lane for at least twenty (20) years.
Secondly, as evidenced by the aerial photograph, Bamboo Lane can be identified in its
length, location and width. Finally, the use has been adverse under claim of right.

Additionally, since there is no proof that any taxes or special assessments have
been levied or collected on the land, this also leads to the conclusion that there has been
a dedication of Bamboo Lane.
For all of these reasons, Bamboo Lane is a public street. See, for example,
Waterman v. Smith, 94 SO.2d 186 (1957), a case decided by the Florida Supreme Court
on similar facts.
