Per our conversation, thank you for allowing me to explain the reasons for
the delay in Obtaining our first construction permit for the Dakota Lofts
project and our application for extension of site plan approval. Followlng
approval of the site plan, the ownership interests in the property were revised
over several months. The new principals then finalized architectural and
engineering plans and entered into a contract with AGM, INC., as general
contractor for the project in August, 2002. Since then, substantial progress
has been made with respect to permitting the project, including processing
the project for county health department approval (which has been obtained),
utility approval (which has been obtained), paving and drainage approval
(verbal approval obtained), and the first building construction permit is in
process. We already have 90% of the plan~ for our first building permit
approved by the City.
We have secured all necessary construction and site-development financing.
Also we have reservations on several lots in the project booked by potential
purchasers, and there are several other potential purchasers who would like
to book, but we have stopped the sales process until thc situation is resolved
with respect to the plat_
The plat approval has been delayed primarily due to an issue regarding
Bamboo Lane which was raised by the City officials in October, 2002. We
believed that this issue had been discussed and agreed upon during the site
plan approval process. This is the main reason we need the requested
extension, so that the plat can be recorded and we can pull the required

permits to bel :onslnlction. We have been actively work;"'" with the City
Attorney and orner city officials regarding the plat and be. e that we will
be able to address all requirements for plat approval (including Bamboo
Lane) so that we can proceed with the project. However, we do not expect
these issues to be resolved prior to expiration of the site plan approval.
Accordingly, we are requesting an extension of site plan approval pursuant
tn the City Code.
