In response to your request for the administrative review and approval of the modifications proposed to
the above-referenced, approved site plan, please be informed that the addition of a volleyball court and
a basketball court as shown on the site plan date stamped 03/01102 are "minor", as defined within the
Land Development Regulations, Chapter 4- Site Plan Review.
This project may continue to be processed by the Building Division as a permit application. Be advised that
the proposed changes may require a modification to the building permit. Please contact me at (561) 742-

Dear Sir or Madam:
We hereby request approval for minor modifications to the approved site plan based on
the guidelines per Chapter 4 provIded to us.
The improvements to the above property are as described under:
1) AddItion of a sand volley ball court 70'x 40' with poles and nets. No lighting
is bemg provided at this time
2) Construction of a half basketball court 40'x 40' The court will be constructed
of 4" thick concrete slab pitched to provide positive drainage on to the
adjacent pervIOUS area. This minor change to the ImpervIOus area does not
require any modifications to the drainage plan.
These are minor modifications that we believe qualify for the minor modification
process, per Chapter 4 of the Zoning Code.

Minor Modification
A change to an approved site plan or built site which Qualifies as a minor
modification ;s defined by criteria listed in the land Development Regulations,
Chapter 4. Site Plan Review. Modifications qualifying as Nminor" may be approved
administratively. This process Is initiated with four sets of plans showing the
proposed modifications, e cover letter describing In detail the proposed changes and
reQuesting the determination of .mino!"', and a fee of 5100.00. The determination
will be made within approXimately one week. Those projects deemed "major' must
be proceased through the complete site plan process initiated by requesting a pre-
application meeting. Once determined "minor", applicatIons for building permits may
be submitted to the Building Division by the applicant or his/her designee.
NOTE: INTENSIFICATION OF NON-CONFORMING SITES, OR CHANGES IN
USE, MAY INITIATE REVIEW AND RECTIFICATION OF EXISTING NON-
CONFORMITIES SUCH AS NUM8ER OF PARKING SPACES, PARKING LOT
LAYOUTS, AND LANDSCAPING.
In making a minor/major modification determination, the following shall be
conSidered:
a. Does the modification increase the buildable square footage of the" NO .
development by more than five (5) percent.
b. Does the modification reduce the provided number of parking spaces below the
required number of parking spaces. NO .
c, Does the modification cause the development to be below the development
standards ror the zoning district in which it is located or other applicable
standards in the Land Development Regulations. ~
d. Does the modification have an adverse effect on adjacent or nearby property or
reduce reQuired physIcal buffers. such as fences, trees, or hedges. f.O

Request is submitted to Planning and Zoning Director and consists of:
a. Four sets of plans or drawings clearly showing the proposed changes on the
appropriate documents (e,g. site plan, landscaping plan, elevation drawings,
etc.). All tabular data should be updated, or provided, to reflect proposed
changes. Changes affecting impervious surfaces may warrant submittal of a
drainage plan.
b. A cover letter requesting minor modifications and listing/describing the
specifio proposed Changes.
c. A $100.00 processIng fee.
d. A current survey may be required depending on the magnitude of any
building expansions,
The review is conducted Within approximately one week (see item #4 below).
The Director generates a letter documenting the results (Major or Minor) and
forwards it to applicant and the Building Division. A pre-application meeting Is
optional, but a direct discussIon with a planner prior to submittal is required.
If Minor:

Administrator.
"Building permit applications are filed by applicant, Ineluding the approval letter,
or revisions flied If minor modifications differ from permit drawings (if submitted
prior to approvQI of minor modification.
If Major:
"Modifications must be processed through the full site plan review process
required of new site plans or major modifications to existing plans or Sites.
"A pre-application meeting must be held prior to submittal for major
modificatiOns.
QUESTIONS/ANSWERS
Q: -Hew long does it take for "minor' determlnaUon?
A: The review period ia a factor of the magnitude of propo$ed changes. The
review penod requIred for the simplest of proposed Changes is approximated
one week. However, if 1I1e changes are significant, which warrants revIews Oy
other TRC members, and addlUonal infonnation and feedback frem the
applicants. !WO to four '.\leeks msy be required for thOse requests involving
extensive revisions to the site, the TRC review process may be warranted which
could increase the review time and the processing fee (based on duration and
hourly rate of revlewers).
Q: *What information is reviewed for /'minor" determimJtion?
A: Generally, this review targets whether the proposed changes impact the size
or appearance of the site plan or existing improvements. This review will also
attempt to anticipate and resolve site plan design issues fllat may be initiated by
the proposed changes (e.g. impact of the proposed changes en solid waste
removal by Public Works). Staff 'NIII also consider application of regulations on
non-conforming uses and sites as indicated in Chapter 2. Zoning, Sectlol'1 11.1.

Specific limitations are placed on the expansion and improvements to non-
conforming uses and proper1iee.
Q: *If the proposed changes .to d..med minoT, can the changes be made
without involving thQ permIt process?
A: No, the minor modification process is not a $ubstilute for the permit process.
If permit applications were filed prior to requesting "minor" determination, the
permit applications must be revised for consistency with the proposed changes.
Q: -If the project Is d..",.d "mino,.", are the plans automatically
forwarded to the Building Divi$/on for p.nnit review?
A. No, as the miner modification process i$ separate from the permit review
process. All applications for permit must be submitted by the applicant or
his/her designee.
